Intersections Of Race, Ethnicity, And The Law, Valerie P. Hans, Ramiro Martinez Jr.
Intersections Of Race, Ethnicity, And The Law, Valerie P. Hans, Ramiro Martinez Jr.
Cornell Law Faculty Publications
The development of law is inextricably linked to matters of race and ethnicity. The stories of minority citizens--the texture of their lives, the prejudices they have endured, and their struggles for fair treatment--have been documented in the pages of legal opinions, as judges over the years have wrestled with fundamental questions of racial bias and inequality. Studying race, ethnicity, and the law is challenging for many reasons, not the least of which is the prime difficulty of defining what we mean by race. Even the choice of words used to identify minority individuals has social and political ramifications. How law …

The Internationalization Of Children's Human Rights: Too Radical For American Adolescents?, Roger J.R. Levesque
Connecticut Journal of International Law
The largest gathering ever of heads of state met in New York in 1990, at the World Summit for Children.1 They met with the ambitious goal of galvanizing support for the United Nations Convention on the Rights of the Child (Convention) 2 and affirming their commitment to the world's children. 3 The Summit and Convention were quickly declared successes: the life chances of the world's children markedly improved4 and a record number of Nation States quickly became signatories to the Convention.
The United States, however, could hardly claim any success. 6 When it comes to children, the United States continues …

Daubert V. Merrell Dow Pharmaceuticals, Inc.: Epistemiology And Legal Process, Margaret G. Farrell
Cardozo Law Review
Justice Blackmun's majority opinion in Daubert v. Merrell Dow Pharmaceuticals, Inc. acknowledges that law and science have different goals, but it fails to recognize the implications of those differences for legal process. Recent increases in the scientifically-based claims brought in the federal courts, and in the size and complexity of the litigation in which such claims are made, have raised the stakes in the debate. At the same time, scientific concepts of relativity, uncertainty, and multiple causation are at odds with simple, legal notions about fact-finding and cause and effect. This disparity between legal and scientific understandings over the admission …

Learning To Love Japan: Social Norms And Market Incentives, J. Mark Ramseyer
Learning To Love Japan: Social Norms And Market Incentives, J. Mark Ramseyer
San Diego Law Review
This Article applies Japanese market behavior to Richard Epstein's theories in his book Forbidden Grounds: The Case Against Employment Discrimination. The author uses Japan to argue that economic incentives need not matter, and that whatever incentives markets and laws may provide, people may still ignore them. This Article suggests that if independent social norms can sustain systematically unprofitable behavior in Japan, then maybe they would have sustained Jim Crow policies in the American south. If Japanese routinely ignore economic incentives to perpetuate social norms, then whites might have ignored the market advantage to hiring African Americans and discriminated against their …

Of Richard Epstein And Other Radical Feminists, Mary Anne Case
Of Richard Epstein And Other Radical Feminists, Mary Anne Case
Articles
My goal in this discussion is to persuade all members of the Federalist Society that they are or should be feminists. I shall pursue this goal in two ways: first by setting forth an expansive definition of feminist jurisprudence; secondly by showing that anyone who combines the two commitments Richard Epstein urges on feminists-commitments to the descriptive message of sociobiology and to the normative message of libertarianism-must inevitably be, not merely a feminist, but a very radical feminist indeed. In short, feminism is for everyone, especially for Richard Epstein.

The New Natural Law Theory: A Reply To Jean Porter, Gerard V. Bradley, Robert George
The New Natural Law Theory: A Reply To Jean Porter, Gerard V. Bradley, Robert George
Journal Articles
The theory of practical reasoning and morality proposed by Germain Grisez, and developed by him in frequent collaboration with John Finnis and Joseph Boyle, is the most formidable presentation of natural law theory in this century. Although work by Finnis and others has brought this "new natural law theory" (NNLT) to the attention of secular philosophers, the theory is of particular interest to Catholic moralists. This is because NNLT provides resources for a fresh defense of traditional moral norms, including those forbidding abortion, euthanasia, and other forms of "direct" killing, as well as sexual immoralities such as fornication, sodomy, and …
