Ideology Between Fiction And Fantasy, Slavoj Zizek Mar 1995

Ideology Between Fiction And Fantasy, Slavoj Zizek

Cardozo Law Review

In his movie version of Franz Kafka's The Trial, Orson Welles accomplished an exemplary anti-obscurantist operation by way of reinterpreting the place and the function of the famous parable on "the door of the Law." In the film, we hear it twice: at the very beginning, it serves as a kind of prologue, read and accompanied by (faked) ancient engravings projected from lantern-slides; then, shortly before the end, it is told to Josef K., not by the priest (as in the novel), but by K.'s lawyer (played by Welles himself) who unexpectedly joins the priest and K. in the …

Domestic Partnership: Recognition And Responsibility, Raymond C. O'Brien Feb 1995

Domestic Partnership: Recognition And Responsibility, Raymond C. O'Brien

San Diego Law Review

time of this Article, partnerships had conferred benefits only: both business and political. This author argues that domestic partnerships should also include responsibilities of support, commitment and obligation within the economic partnership construct of emerging family law. The author concludes that this inclusion of responsibility in domestic partnerships by homosexual couples would lend credence to due process arguments of both equality and substance.

Designing And Teaching Advanced Legal Research And Writing Courses, Lucia Ann Silecchia Jan 1995

Designing And Teaching Advanced Legal Research And Writing Courses, Lucia Ann Silecchia

Duquesne Law Review

As more and more law schools have realized the importance of basic research and writing skills, they have devoted significant resources to improving first-year training in these areas - and rightfully so. However, developments in recent years have caused an explosion in the number of legal research resources with which attorneys must become familiar. At the same time, the bench and bar have expressed consistent dissatisfaction with the research and writing abilities of law school graduates. Taken together, these two trends indicate that providing advanced legal research and writing training is becoming increasingly important. This article explores the issue of …

"We Can Do... Better":* Rights Of Singular Peoples And The United Nations Draft Declaration On The Rights Of Indigenous Peoples, Keith D. Nunes

St. Thomas Law Review

In the multiplication of European voyages of discovery and exploration between the years 1487 and 1780, the slow process of direct sea contact between regions and continents ultimately yielded a worldwide network of relationships for a new era, an era in which humankind continues to participate. North America was opened to European settlement as a result of an aborted series of English, French, and Dutch voyages intended to find a northern route to Asia. These voyages were attempts to erase the claim of monopoly to the navigation of trade routes in the Treaty of Tordesillas of 1494, as well as …

Human Nature And Moral Responsibility In Lawyer-Client Relationships, Thomas L. Shaffer Jan 1995

Human Nature And Moral Responsibility In Lawyer-Client Relationships, Thomas L. Shaffer

Journal Articles

My interest here is ethics—whether observation, intuition, the ability to make appeals to human nature, and insight into the workings of the human heart are useful as guides for legal judgments in relationships between lawyers and clients. A modern American lawyer and her client use power as certainly as Solomon used power and, I suppose, are as manifestly subject to indirection in deciding how to use power as the kings of Israel were. In both cases the enterprise is undertaken, as W.H. Auden put it, on "a moral planet tamed by terror."

The Saga Of Indigenous Peoples In Brazil: Constitution, Law And Policies, L. Roberto Barroso Jan 1995

The Saga Of Indigenous Peoples In Brazil: Constitution, Law And Policies, L. Roberto Barroso

St. Thomas Law Review

In 1979, when the military rule in Brazil was coming to an end, I dedicated some of my time to student political activity supporting the return of democracy. Several students used to show their political beliefs by posting banners on the windows of their cars. I had several in my car. One of them, probably the one that raised the most curiosity, read: "For the demarcation of indigenous lands." It was very charming, but none of us knew exactly its real meaning and implications. As far as I can remember, that was the first time I ever cared about Indians. …

Individual Versus Society: The Cultural Dynamics Of Criminalizing Suicide, Benjamin P. Fay Jan 1995

Individual Versus Society: The Cultural Dynamics Of Criminalizing Suicide, Benjamin P. Fay

UC Law SF International Law Review

Various societies try to deal with the problem of suicide by criminalizing assisted suicide, attempted suicide, and sometimes even suicide itself. In the United States, suicide and attempted suicide are generally no longer criminalized. However, many states are grappling with the question of whether to criminalize assisted suicide. This Note examines suicide laws in two very different cultures, England and India, in order to determine whether there is a common lesson to be learned. The author concludes that the resolution of the question of whether to criminalize suicide or attempted suicide involves weighing the individual's interest in self-determination against the …
