Legislating A Sustainable Land Ethic For New Zealand, Michèle D. Dominy
Legislating A Sustainable Land Ethic For New Zealand, Michèle D. Dominy
Pacific Studies
This article explores competing discourses of sustainability in New Zealand’s South Island. As active resource managers, high-country pastoralists’ conception of “country” contests predominant reductive and binary models of production/ conservation and economic resource/visual resource and suggests a more complicated dynamic between scientific and cultural paradigms of sustainability than has been acknowledged. This dynamic is captured in the internationally driven top-down concept of equitable sustainable land management with a dual commitment to both cultural and ecological diversity as defined locally, formulated as part of the United Nations Rio Declaration of 1992, agenda 21, chapter 13. I examine an emergent high-country “land …

Reclaiming The Beautiful Island: Taiwan's Emerging Environmental Regulation, Michael Scott Feeley
San Diego Law Review
In this Article, Mr. Feeley, provides an introduction to the Taiwanese environmental regulatory scheme emerging from Taiwan's unique circumstances (economic influence and ecological crises) and the potential economic impact that may result. The author reviews the development of the centuries-old colony into an independent and powerful state. He then provides an overview of the specific environmental laws, regulations and policies already in place and previews those being developed. Lastly, he discusses potential economic effects of the new environmental scheme. In conclusion, the author envisions the shrewd commercial acumen and diligence which fueled Taiwan's rise in the world market as a …

The Best And The Brightest?: Canadian Law School Admissions, Dawna Tong, W. Wesley Pue
Osgoode Hall Law Journal
This article assesses the admissions policies commonly employed by law faculties in common law Canada. These faculties rely heavily on admissions criteria and policies developed in the United States and, like their American counterparts, typically admit students on the basis of "index scores" produced by combining Law School Admissions Test (LSAT) performance with Undergraduate Grade Point Average (UGPA). The appropriateness of this American model to the Canadian context has never been rigorously assessed. This raises serious questions as to whether Canadian law school admissions policies serve either of their stated goals of finding the "best" students or of advancing social …
Treaties In The Mist, Jarred Kassenoff
Treaties In The Mist, Jarred Kassenoff
Cardozo Journal of International and Comparative Law
The note argues that the survival of the mountain gorilla, a critically endangered species with only 300–350 individuals remaining, depends on strengthening international environmental treaties like CITES and addressing broader socio-political and economic factors. While CITES and the African Convention on Conservation provide important frameworks, their effectiveness is hindered by weaknesses such as lack of implementation, inadequate resources, and insufficient enforcement. The note emphasizes the need for treaties to shift from goal-oriented to implementation-oriented approaches, coupled with increased public awareness, political will, and resource allocation, to ensure the species’ survival.

Banded Contracts, Mediating Institutions, And Corporate Governance: A Naturalist Analysis Of Contractual Theories Of The Firm, Timothy L. Fort, James J. Noone
Banded Contracts, Mediating Institutions, And Corporate Governance: A Naturalist Analysis Of Contractual Theories Of The Firm, Timothy L. Fort, James J. Noone
Law and Contemporary Problems
Fort and Noone relate business ethics to notions of transcendence found in nature and anthropology. They address the notion of contracts within corporate legal theory because contracts are used as a model both by those who advocate minimalist, agency business duties and by others who propound a broad business ethic.
On Teaching Mediation, Edwin H. Greenebaum
On Teaching Mediation, Edwin H. Greenebaum
Journal of Dispute Resolution
In this article, I will delineate the issues and explore the implications of resolving them in different ways. Part I develops a taxonomy of variations in models of mediation. In Part II, I analyze choices and constraints in course design. In Part III, I specify the choices I have made in structuring my own course in mediation. I will relate those choices to the context of my school, to my students' backgrounds and interests, and to my competencies and goals. The initial version of this paper was written for my students to read as they entered my course. Pedagogically, the …
Sovereignty's Alchemy: An Analysis Of Delgamuukw V. British Columbia, John Borrows
Sovereignty's Alchemy: An Analysis Of Delgamuukw V. British Columbia, John Borrows
Osgoode Hall Law Journal
In Delgamuukw v. British Columbia, the Supreme Court of Canada issued its long-awaited judgment on the status of Aboriginal title under section 35(1) of the Constitution Act, 1982. The decision was regarded as highly significant because it seemed to fundamentally alter the law of Aboriginal rights. This article suggests that while the case has somewhat positively changed the law to protect Aboriginal title, it has also simultaneously sustained a legal framework that undermines Aboriginal land rights. In particular, the decision's unreflective acceptance of Crown sovereignty places Aboriginal title in a subordinate position relative to other legal rights. This article examines …
Sex, Culture, And The Biology Of Rape: Toward Explanation And Prevention, Owen D. Jones
Sex, Culture, And The Biology Of Rape: Toward Explanation And Prevention, Owen D. Jones
Vanderbilt Law School Faculty Publications
For all that has been written about rape, its multiple causes remain insufficiently understood for law to deter it effectively. This follows, in part, from inadequately interdisciplinary study of rape causation. This Article argues that integrating life science and social science perspectives on sexual aggression can improve law's model of rape behavior, and further our efforts to reduce its incidence.
The Article first explains biobehavioral theories of sexual aggression, and offers a guide to common but avoidable errors in assessing them. It then compares a number of those theories' predictions with existing data and demonstrates how knowledge of the effects …
