A Critical Analysis Of Health And Human Services' Proposed Health Privacy Regulation In Light Of The Health Insurance Privacy And Accountability Act Of 1996, A. Craig Eddy
Annals of Health Law and Life Sciences
Dr. Eddy inquires, through a detailed analysis of relevant statutory provisions, whether it is likely that the HIPAA legislation or the Standards for Privacy of Individually Identifiable Health Information Regulations (SPIIHI) proposed by HHS will efficiently and cost effectively defend the privacy issues they were intended to safeguard. His paper critically analyzes the extremely broad and expensive course of action and tactics HHS has chosen to employ in this effort to determine whether HHS' proposal is an efficient use of health care dollars. To introduce his analysis, Dr. Eddy addresses the general concept of medical privacy and attempts to define …

The Establishment Of A U.S. Federal Data Protection Agency To Define And Regulate Internet Privacy And Its Impact On Us-China Relations: Marco Polo, Where Are You?, 19 J. Marshall J. Computer & Info. L. 169 (2000), Omar Saleem
UIC John Marshall Journal of Information Technology & Privacy Law
The desire to explore new worlds and to exchange ideas and goods should be the impetus behind the Internet, the virtual Silk Road connecting the east and west. The Chinese government considers the Internet a vital part of its modernization plans. There are millions of Chinese citizens online and that number continues to grow. China’s policy towards online privacy regulation will have a significant impact on the rest of the world. Technology has outpaced law in the arena of privacy regulation. Some scholars believe the Internet should be unregulated. Others fear that commerce will overrun privacy concerns. The sheer volume …

Protection Of Cultural Heritage Found On Private Land: The Paradigm Of The Miami Circle And Regulatory Takings Doctrine After Lucas, Patty Gerstenblith
St. Thomas Law Review
In Part I, this article will first review the development of protection in the United States for archaeological sites, including particularly Native American burials. In Part II, this article will analyze current Supreme Court and lower court jurisprudence concerning regulatory takings, particularly in the aftermath of the Supreme Court's 1992 decision, Lucas v. South Carolina Coastal Council, in order to determine what would be the permissible extent of regulation and protection of archaeological sites located on private land and the disposition of objects found in such sites and burials. Part III examines the extent to which current state statutes protect …

Grounded Visions: Native American Conceptions Of Landscapes And Ceremony, Russel L. Barsh
St. Thomas Law Review
When the first wild strawberries flowered, my friend Chris Jocks, a Mohawk professor of comparative religion at Dartmouth, took his students to meet me at the old beaver pond on Thetford Hill. As the sun set behind a warm sprinkling of rain, we sat on top of the beaver dam and listened to successive waves of croaking, roaring, warbling, chirping, and hooting. "In the beginning," we explained that ''the Beaver made the world out of mud from the bottom of the waters. All the animals came and thanked the Creator. That is the way it was, and the way it …
The League Of The Iroquois: From Constitution To Sovereignty, Charles Radlauer
The League Of The Iroquois: From Constitution To Sovereignty, Charles Radlauer
St. Thomas Law Review
Iroquois oral tradition relates that in early pre-colonial times, a peacemaker came to the Five Nations of the Iroquois, bringing a message of peace and establishing the Iroquois Confederation. The peacemaker, Deganawidah, also established a system of governance for the Five Nations,' which was incorporated into the earliest constitution of an American people. Numerous authors such as Bruce Johansen, Donald Grinde, and Gregory Schaaf have suggested that this oral tradition served as the foundation for the American Constitution. Other authors, such as Eric Jensen, have described these writings as fanciful and not based in fact; believing that many of the …
