How Universal Is The United Nations' Universal Periodic Review? An Examination Of The Discussions Held On Female Genital Mutilation In The First Cycle Of Review, Gayatri Patrel
Intercultural Human Rights Law Review
Hailed as the most innovative and unique human rights monitoring mechanism at the United Nations, the Universal Periodic Review (UPR) process promises to promote and protect the universality of all human rights issues and concerns in an objective, universal, and transparent manner. With the interactive dialogue session being at the heart of the review, coupled with the possibility of peer States potentially raising any international human rights norm to hold States accountable, there is a possible challenge to the universality of human rights norms, vocalized by State representatives when certain contentious issues are raised during State reviews. This paper explores …

Adultery: Trust And Children, Margaret F. Brinig
Journal Articles
Deborah Rhode writes that while adultery is admittedly not good, it should not be criminal. She argues that it should not generate a tort action either, because the original purposes for which the torts of alienation of affections and criminal conversation come from a time with quite different views about marriage and gender, while no-fault and speedy divorce today give adequate remedies to the wronged spouse. Further, adultery should not affect employment (as a politician or in the military) unless it directly impacts job performance.
My own reluctance to disengage adultery and law stems from the seriousness of adultery. First, …

Get Real: Why And How Clinicians Should Record, Transcribe And Study Actual Client Consultations, Linda F. Smith
Get Real: Why And How Clinicians Should Record, Transcribe And Study Actual Client Consultations, Linda F. Smith
Utah Law Faculty Scholarship
This article will argue that the legal academy has much to learn by recording, transcribing and systematically studying student-client and attorney-client consultations. Clinical faculty can utilize conversation analysis and other social science techniques to do this. Social scientists and medical providers have studied doctor-patient conversations in this way over many years. Through this systematic study researchers have reached conclusions about effective doctor-patient consultations that form the basis for teaching these skills in medical school. This article will highlight some of these studies and their findings. Some have contended that attorney-client conversations simply cannot be recorded and studied in the same …

Multivoiced Authors, Lior Zemer
Multivoiced Authors, Lior Zemer
Cardozo Arts & Entertainment Law Journal
From many sources we have inherited a rich panoply of images about the "good author." The prevalent image of the good author as a unique individual who deserves a right in the works he creates and recognition for his contribution to the common stock of knowledge, occupies contemporary legal scholarship on copyright. Scholars argue that the law privileges owners with entitlements incompatible with the social nature of the creative act, and in this way disturbs the expectation that copyright law will "promote the Progress of Science and the useful Arts." In their arguments they claim that authorship is less an …

Beyond Walls And Fences: Exploring The Legal Geography Of Gated Communities In Mixed Spaces, Manal Totry-Jubran
Beyond Walls And Fences: Exploring The Legal Geography Of Gated Communities In Mixed Spaces, Manal Totry-Jubran
Journal of Law and Policy
In the last three decades, a new type of physical seclusion has appeared around the world: the gating and walling of urban and suburban spatial residences. This phenomenon, led mainly by dominant socio-economic groups, is referred to as “gated communities.” This article focuses on the legal challenges that gated communities raise in ethnocratic societies that share a legacy of segregation and of unequal distribution of land. The main argument is that, due to this legacy, the legality of gated communities and walls that separate communities generate legal debates that goes beyond classic legal claims of rights violations of non-residents of …

This white paper delves into:
• The past and present state of journal publishing
• Current alternatives to the corporate publisher model
• Steps to realize sustainable, open access-friendly journal models of the future
This paper argues democratization of journal publishing is the key to lowering journal production costs and facilitating OA. Members of the academic community, either at established not-for-profit organizations or through informal groups of editors and advocates, must break up the corporate publisher conglomerate by taking control of journals and developing funding, access, and distribution models that work for their disciplines. This paper explores how widespread adoption …

With Jurors In Mind: An Ethnographic Study Of Prosecutors’ Narratives, Anna Offit
Faculty Journal Articles and Book Chapters
This article focuses on prosecutors’ practices of drafting, critiquing and revising opening and closing statements for trial. Based on the observation of their real-time collaborative work, it argues that prosecutors’ concerns that they might be perceived as incredible or overzealous have substantive and structural impacts on their case preparation. In the process of commenting on evidence and witnesses and developing their authorial voices, prosecutors give definition to character traits and values they view as central to their jobs.
The Bamboo Ceiling: A Study Of Barriers To Asian American Advancement, Emily Cheng
The Bamboo Ceiling: A Study Of Barriers To Asian American Advancement, Emily Cheng
UROP Posters
The idea of cultural diversity in the workplace is a popular one, generating much discussion about the inclusion of and affirmative action toward minorities. However, these conversations rarely involve Asian Americans, who despite above-average levels of educational achievement, household income, and employment, find themselves underrepresented in and shut-out of upper-level management positions. In this project, I investigated the stereotype of East-Asian Americans as a model minority (created by non-Asians) to find out why East-Asian Americans are underrepresented in upper-level management in corporate workplaces, a phenomenon known as the “bamboo ceiling.” I explored a variety of scholarly sources that analyzed the …
The Ahistoricism Of Legal Pluralism In International Criminal Law, James G. Stewart, Asad Kiyani
The Ahistoricism Of Legal Pluralism In International Criminal Law, James G. Stewart, Asad Kiyani
All Faculty Publications
International criminal law (“ICL”) is legally plural, not a single unified body of norms. As a whole, trials for international crimes involve a complex dance between international and domestic criminal law, the specificities of which vary markedly from one forum to the next. To date, many excellent scholars have suggested that the resulting doctrinal diversity in ICL should be tolerated and managed under the banner of Legal Pluralism. To our minds, these scholars omit a piece of the puzzle that has major implications for their theory – the law’s history. Neglecting the historical context of the international and national criminal …
The Evolution Of Global Legal Pluralism, Paul Schiff Berman
The Evolution Of Global Legal Pluralism, Paul Schiff Berman
GW Law Faculty Publications & Other Works
Global Legal Pluralism is now recognized as an entrenched reality of the international and transnational legal order. Indeed, wherever one looks, there is conflict among multiple legal regimes. Some of these regimes are state-based, some are built and maintained by non-state actors, some fall within the purview of local authorities and jurisdictional entities, and some involve international courts, tribunals, arbitral bodies, and regulatory organizations.
It has been approximately 20 years since scholars first began pushing the insights of legal pluralism into the transnational and international arena. During those two decades, a rich body of work has established pluralism as a …

This study compared the characteristics and court-ordered evaluation questions and responses among 4,430 defendants to determine if differences existed between those represented by public defenders and private attorneys when receiving trial competency or responsibility psychiatric evaluations from a state department of mental health. Defendants represented by public defenders were more likely to be younger, to have less education, to have psychotic disorders, to have a history of inpatient psychiatric treatment, to live in urban or rural counties, and to be jailed at the time of the evaluation. In addition, defendants represented by public defenders were less likely to have a …

Confronting Mexico's Enforced Disappearance Monsters: How The Icc Can Contribute To The Process Of Realizing Criminal Justice Reform In Mexico, Rodolfo D. Saenz
Vanderbilt Journal of Transnational Law
In 2015, the United Nations Committee on Enforced Disappearances released a report on Mexico, concluding that there is a generalized context of disappearances in the country, many of which would meet the legal definition of enforced disappearance. Despite the recurring pattern of mass disappearances throughout the country in the last decade, including the recent disappearance of forty-three students in Iguala, Mexico has not convicted a single person for an enforced disappearance committed after 2006. Equally appalling is the fact that 40 percent of missing person cases in the country never get opened. Mexico has begun a process of reforming its …

Hunt Or Be Hunted, Jeremiah Cioffi
Vanderbilt Journal of Transnational Law
Bulgaria is the geographic and political center of the European migrant crisis, which has the Bulgarian citizenry uneasy about its security. Bulgaria's societal disdain for Middle Eastern migrants stems from hundreds of years of subjugation and non-Muslim Bulgarians' second-class citizenship under the Ottoman Empire. Roving bands of civilian migrant hunters have begun taking the law into their own hands by capturing migrants and turning them over to the Bulgarian authorities for deportation. This Note discusses the illegality of such migrant hunting under Bulgarian domestic law. It then discusses how the impunity enjoyed by migrant hunters is an abdication of Bulgarian …
Valuing Sacred Tribal Waters Within Prior Appropriation, Michelle Bryan
Valuing Sacred Tribal Waters Within Prior Appropriation, Michelle Bryan
Faculty Law Review Articles
Throughout the world water plays a central role in the spirituality of indigenous peoples. Focusing on the American West, this article first describes how tribal water needs touch upon the sacred and then explains how both federal law and state prior appropriation doctrine fail to adequately protect these important sacred views of water. Pivoting away from the classic federal law arguments, the article then advocates for an evolution in state water law regimes to provide yet unrecognized protections for tribal sacred waters. Because international law plays an increasing role in this issue, the article also explores case studies from Ireland, …

Cultures Of Compliance, Donald C. Langevoort
Cultures Of Compliance, Donald C. Langevoort
Georgetown Law Faculty Publications and Other Works
There has been a "cultural turn" in discussion and debates about the promise of corporate compliance efforts. These efforts are occurring quickly, without great confidence in their efficacy. Thus the interest in culture. This article explores what a culture of compliance means and why it is so hard to achieve. The "dark side" that enables non-compliance in organizations is powerful and often hidden from view, working via scripts that rationalize or normalize, denigrations of regulation, and celebrations of beliefs and attitudes that bring with them compliance dangers. The article addresses how both culture and compliance should be judged by those …

National and international public–private partnerships, consortia, and government initiatives are underway to collect and share genomic, personal, and healthcare data on a massive scale. Ideally, these efforts will contribute to the creation of a medical information commons (MIC), a comprehensive data resource that is widely available for both research and clinical uses. Stakeholder participation is essential in clarifying goals, deepening understanding of areas of complexity, and addressing long-standing policy concerns such as privacy and security and data ownership. This article describes eight core principles proposed by a diverse group of expert stakeholders to guide the formation of a successful, sustainable …
