Civil Liability For Damage Resulting From Genetically Modified Organisms (Gmos): A Comparative Study, Dr. Abdul-Rahman Mohamed Salem
Civil Liability For Damage Resulting From Genetically Modified Organisms (Gmos): A Comparative Study, Dr. Abdul-Rahman Mohamed Salem
مجلة جامعة الإمارات للبحوث القانونية UAEU LAW JOURNAL
The most serious damage to human and other living organisms at present is the damage of genetically modified organisms, where they can eventually be used as weapons of mass destruction in the form of a bacteriological war that destroys human civilization, we will present the problem in terms of: Identification of genetically modified organisms by determining their scope, and to identify the aspects of the damage resulting from them, and how to compensate each type of species, whether it is related to plant, animal, human or the environment. We then present the legal basis for civil liability resulting from damage …

Vulnerability As A Launching State: Why The United States Should Adopt Explicit Indemnification Procedures In Response To The Growth Of The Commercial Space Industry, Mollie Carney
St. John's Law Review
(Excerpt)
This Note argues that the current United States launch license requirements should be amended to include explicit indemnification procedures, should the United States be held liable for damages as a Launching State under the Liability Convention. Part I of this Note examines the evolution of the space industry from a field marked by Cold War tensions to one that is dominated by private industry, and the risks that are associated with the rapid growth of the commercial space industry. Part II will explain the current legal regime by (1) setting a framework of liability generally, (2) examining the Liability …

Mixed Emotions: How Lower Courts Misconstrue Transunion And Have Since Created A New Judicially Cognizable Injury For Stand-Alone Emotional Distress, Varun Elangovan
Nebraska Law Bulletin (Selected Issues)
In TransUnion, LLC v. Ramirez, the United States Supreme Court held that “in a suit for damages, mere risk of future harm, standing alone, cannot qualify as a concrete harm—at least unless the exposure to the risk of future harm itself causes a separate concrete harm.” Notably, the Court failed to take a position on what common law analog would suffice as a “separate concrete harm,” and instead, affirmed that an emotional distress injury caused by the risk of future harm may be a sufficient concrete injury. Resultingly, lower courts have construed TransUnion to stand for the proposition that an …

Animation As An Early Source For Metaphor Acquisition By Younger Children, Dr. Mahmoud Arif Edan
Midad AL-Adab Refereed Quarterly Journal
The purpose of this study is to highlight evidence the animations the primary source for younger children to acquire metaphors. They can make use of those cartoons to recognise and activate their conceptual maps. The study applied the Conceptual Metaphor Theory (CMT) by Lakoff, & Johnson (1980) to be the theoretical framework of this study. The data collection is one-on-one method interviews (or face to face) which is the major and commonest type of the data collection methods in research whose nature is qualitative, yet this research applies the mixed method that combines the prose of the quantitative and qualitative …

Human Rights In The Era Of Artificial Intelligence “Figures, Opinions And Solutions”, Dr. Heidi Issa Hassan
Human Rights In The Era Of Artificial Intelligence “Figures, Opinions And Solutions”, Dr. Heidi Issa Hassan
مجلة جامعة الإمارات للبحوث القانونية UAEU LAW JOURNAL
Technology has cast its shadow on us in most aspects of our lives and nothing has escaped its grip even human intelligence. Human intelligence now has a major rival known as "artificial intelligence" (AI). The main question is can machines think like humans?!
Since AI involves, in part, the dispensation with humans, then it is a matter that affects human rights, regardless of the manifestations, consequences or even scope of this dispensation.
Accordingly, this study has several problems to tackle: 1) the absence of adequate binding national and international provisions governing AI, 2) AI systems involve changing the way businesses …

Fordham Law Review Online
These remarks were delivered as part of the program entitled The Presidential Succession Act at 75: Praise It or Bury It?, which was held on April 6, 2022, and hosted by the Fordham University School of Law. The Presidential Succession Act sets out the presidential line of succession and other procedures for situations in which the president and vice president have both died, resigned, been removed, or become unable to discharge the presidency’s powers and duties. The Act also addresses succession scenarios before Inauguration Day. In light of the statute’s seventy-fifth anniversary, this program explored relevant history and analyzed …
The Promise And The Peril: Artificial Intelligence And Employment Discrimination, Keith E. Sonderling, Bradford J. Kelley, Lance Casimir
The Promise And The Peril: Artificial Intelligence And Employment Discrimination, Keith E. Sonderling, Bradford J. Kelley, Lance Casimir
University of Miami Law Review
Artificial intelligence (“AI”) is undeniably transforming the workplace, though many implications remain unknown. Employers increasingly rely on algorithms to determine who gets interviewed, hired, promoted, developed, disciplined, or fired. If appropriately designed and applied, AI promises to help workers find their most rewarding jobs, match companies with their most valuable and productive employees, and advance diversity, inclusion, and accessibility in the work- place. Notwithstanding its positive impacts, however, AI poses new perils for employment discrimination, especially when designed or used improperly.
This Article examines the interaction between AI and federal employment antidiscrimination law. This Article explores the legal landscape including …

The Dobbs Effect: Abortion Rights In The Rear-View Mirror And The Civil Rights Crisis That Lies Ahead, Terri Day, Danielle Weatherby
William & Mary Law Review Online
On June 24, 2022, seven weeks after the first-ever leak of a draft opinion, the United States Supreme Court circulated its decision in Dobbs v. Jackson Women’s Health Organization, defying stare decisis, overruling fifty years of precedent, and shattering the hopes of millions of Americans, who wished the leaked opinion was a fiction that would never come to be.
As the leaked draft forewarned, Roe v. Wadeis no longer the law of the land. No longer is a woman’s right to terminate a pregnancy—to exercise bodily autonomy and be free to control the trajectory of her life—protected as a fundamental …

In November 2018, a Chinese researcher reported that his team had applied clustered regularly interspaced palindromic repeats or associated protein 9 to delete the gene C-C chemokine receptor type 5 from embryos and claimed that the 2 newborns would have lifetime immunity from HIV infection, an event referred to as #GeneEditedBabies on social media platforms. Although this event stirred a worldwide debate on ethical and legal issues regarding clinical trials with embryonic gene sequences, the focus has mainly been on academics and professionals. However, how the public, especially stratified by geographic region and culture, reacted to these issues is not …

The Centrality Of Data And Compute For Ai Innovation: A Blueprint For The National Research Cloud, Daniel E. Ho, Jennifer King, Russell C. Wald, Christopher Wan
Notre Dame Journal on Emerging Technologies
From the introduction: Artificial intelligence (AI) appears poised to transform the economy across sectors ranging from healthcare and finance to retail and education. What some have coined the “Fourth Industrial Revolution” is driven by three key trends: greater availability of data, increases in computing power, and improvements to algorithm design. First, increasingly large amounts of data have fueled the ability for computers to learn, such as by training an algorithmic language model on all of Wikipedia. Second, better computational capacity (often termed “compute”) and compute capability have enabled researchers to build models that were unimaginable merely ten years ago, spanning …

In Defense Of (Virtuous) Autonomous Weapons, Don Howard
Notre Dame Journal on Emerging Technologies
I will argue, we can construct effective means for norming the use of autonomous weapons short of a total ban by building upon the foundation of existing requirements stipulated in Article 36 of Protocol I to the Geneva Conventions that all new weapons technologies be reviewed for compliance with the International Law of Armed Conflict (ILOAC) and International Humanitarian Law (IHL). I begin with a critical review of several of the most commonly encountered arguments in favor of a ban. That is followed by a discussion of the moral opportunities afforded by enhanced autonomy. I conclude with a concrete policy …
The Moral Authority Of Original Meaning, J. Joel Alicea
The Moral Authority Of Original Meaning, J. Joel Alicea
Notre Dame Law Review
One of the most enduring criticisms of originalism is that it lacks a sufficiently compelling moral justification. Scholars operating within the natural law tradition have been among the foremost critics of originalism’s morality, yet originalists have yet to offer a sufficient defense of originalism from within the natural law tradition that demonstrates that these critics are mistaken. That task has become more urgent in recent years due to Adrian Vermeule’s critique of originalism from within the natural law tradition, which has received greater attention than previous critiques. This Article is the first full-length response to the natural law critique of …

Remedying The Immortal: The Doctrine Of Accession And Patented Human Cell Lines, Julia E. Fissore-O'Leary
Notre Dame Law Review
Importantly, though this Note employs Henrietta Lacks as the illustrative, paradigmatic case for the theory of accession it proposes, accession can be, and should be, broadly construed to apply to all like-situated patients. Part I of this Note briefly explains the timeless human-body-as-property debate. Next, Part II addresses the concept of accession—its theoretical underpinnings, definitions, and amenability to this and other lawsuits. Part III applies accession to HeLa and develops a methodology for calculating damages in this unique setting. This Note does not pretend to present a perfectly wrought formula. Instead, it offers several possibilities for determining compensation. Finally, …

Using Artificial Intelligence In The Law Review Submissions Process, Brenda M. Simon
Using Artificial Intelligence In The Law Review Submissions Process, Brenda M. Simon
Faculty Scholarship
The use of artificial intelligence to help editors examine law review submissions may provide a way to improve an overburdened system. This Article is the first to explore the promise and pitfalls of using artificial intelligence in the law review submissions process. Technology-assisted review of submissions offers many possible benefits. It can simplify preemption checks, prevent plagiarism, detect failure to comply with formatting requirements, and identify missing citations. These efficiencies may allow editors to address serious flaws in the current selection process, including the use of heuristics that may result in discriminatory outcomes and dependence on lower-ranked journals to conduct …
The New Mass Torts Bargain, Samir D. Parikh
The New Mass Torts Bargain, Samir D. Parikh
Fordham Law Review
Mass torts create a unique scale of harm and liabilities. Corporate tortfeasors are desperate to settle claims but condition settlement on the resolution of substantially all claims at a known price—commonly referred to as a global settlement. Without this, corporate tortfeasors are willing to continue with protracted and fragmented litigation across jurisdictions. Global settlements can be elusive in these cases. Mass torts are oftentimes characterized by heterogeneous victim groups that include both current victims and future victims—individuals whose harm has not yet manifested and may not do so for years. Despite this incongruence, future-victim claims must be aggregated as part …
The Improvised Implementation Of Executive Agreements, Kathleen Claussen
The Improvised Implementation Of Executive Agreements, Kathleen Claussen
University of Chicago Law Review
Implementation is at the core of lawmaking in our divided government. A rich literature covers the waterfront with respect to agencies’ implementation of legislative mandates, and another equally robust line of scholarship considers Congress’s implementation of treaties. Missing from those discussions, however, is another area of implementation central to U.S. foreign relations: the implementation of transnational regulatory agreements.
This Article examines how federal agencies have harnessed far-reaching discretion from Congress on whether and how to implement thousands of international agreements. Agencies regularly implement agreements by relying on a self-developed menu of options, much like they do in the domestic regulatory …
