Washington Timber Deeds And Contracts, Ralph W. Johnson Apr 1957

Washington Timber Deeds And Contracts, Ralph W. Johnson

Articles

The law of Washington concerning the interests conveyed by timber deeds and contracts is foggy. Many vital questions are still totally unanswered, or have been left in confusion, by the cases in point. The principal area of doubt revolves around the question of whether standing timber, which has been sold separately from the land on which it stands, is realty or personalty. The answer is vital for many reasons. It determines whether a husband has power as manager of the community to convey community-owned timber without his wife's signature, which statute of frauds applies to a timber transaction, which recording …

An Analysis Of Marriage Trends And Divorce Policies, Robert S. Redmount Apr 1957

An Analysis Of Marriage Trends And Divorce Policies, Robert S. Redmount

Vanderbilt Law Review

Divorce law, theoretically, is the embodiment of policies governing the dissolution of marriage. It is the legal expression of the values attached to marriage and implicitly states the law's understanding of the marital relationship, at least that part of it that reflects conflict and disturbance.

The analytic discourse which follows briefly assesses the roles and meanings of marriage, the sources and consequences of marital disharmony and the complications of marriage dissolution. The history and composition of divorce policies and laws is carefully savored and sharply scrutinized for fidelity to the reason and experience of marriage. The outcome of this analysis …

Justice William Cushing And The Treaty-Making Power, F. William O'Brien S.J. Feb 1957

Justice William Cushing And The Treaty-Making Power, F. William O'Brien S.J.

Vanderbilt Law Review

Although the work of the Supreme Court during the first few years was not great if measured in the number of cases handled, it would be a mistake to conclude that the six men who sat on the Bench during this formative period made no significant contribution to the development of American constitutional law. The Justices had few if any precedents to use as guides, and therefore their judicial work, limited though it was in volume, must be considered as stamped with the significance which attaches to all pioneer activity. Moreover, most of this work was done while on circuit …

Judge Hand's Views On The Free Speech Problem, Robert S. Lancaster Feb 1957

Judge Hand's Views On The Free Speech Problem, Robert S. Lancaster

Vanderbilt Law Review

Judge Learned Hand has been for many years a lawyer's lawyer. His opinions are liberally sprinkled through the case books; commentaries on legal matters cite his opinions with increasing respect and admiration; but to many people he is the judge who upheld the conviction of the eleven communists in New York on a question involving the limits of free speech. Scholars of parts and even some lawyers do not know that he anticipated the Supreme Court's "clear and present danger" test by two years, or that his contribution to the law of free speech is by no means confined to …

Nonprofit Corporation Statutes: A Critique And Proposal, Ralph E. Boyer Jan 1957

Nonprofit Corporation Statutes: A Critique And Proposal, Ralph E. Boyer

Michigan Legal Studies Series

The nonprofit corporation has become an important factor in the social and economic life of the American people. The American predisposition to organization and affiliation has led to an enormous number of such organizations, which in itself is a significant factor. Further, many nonprofit corporations have become national and international entities yielding tremendous economic and political influence. In spite of these factors, however, these organizations have largely escaped the serious study and academic analysis so generously bestowed upon the regular business corporation. This study is directed at an analysis of the legal framework within which such organizations operate. Its aim …

International Law And The United Nations, University Of Michigan Law School

Summer Institute on International and Comparative Law

In June, 1955, the University of Michigan Law School held a six-day Summer Institute dealing with problems of international law and of the United Nations. This was the eighth in the series of annual Summer Institutes dealing with important problems in areas of public concern, often with particular emphasis upon the comparative or international law aspects involved. The 1955 Institute came at the time of the tenth anniversary of the signing of the United Nations Charter on June 26, 1945, and approximately a decade after the termination of hostilities in World War II. The growth of the United Nations during …

Introduction To Advocacy: Suggestions And Rules For Case Club Work, University Of Michigan Law School

Miscellaneous Law School History & Publications

The transition from classroom to courtroom requires much time and effort on the part of the aspiring law student. Case Club work is an aid to the student in making this transition. Since the Case Clubs play such an important role in the Law School program, the editors have prepared this pamphlet to explain their purpose and functioning.

Our aims in preparing this pamphlet have not deviated since the publication of the first edition. We feel confident that the success of this edition will match that of the first. -- Executive Committee

Radiation Injury: A Technical And Legal Survey, Andrew J. Humphrey Jan 1957

Radiation Injury: A Technical And Legal Survey, Andrew J. Humphrey

Cleveland State Law Review

In the field of radiation damage much has been written and many scientific opinions have been given. As to legal decisions, there is much to criticize from a technical point of view in the early X-ray cases, particularly in regard to the leeway allowed to physicians in treating their patients through use of a new tool. The following survey is intended to serve to give to the lawyer a basic working knowledge of the subject of radiation. With this, plus knowledge of general principles of law, common sense should enable him to get his client's point across to the judge and …

Fluoroscopic X-Ray Shoe Fitting Devices, Donald D. Weisberger Jan 1957

Fluoroscopic X-Ray Shoe Fitting Devices, Donald D. Weisberger

Cleveland State Law Review

Exposure to X-rays or other radiation over and above a certain cumulative tolerance limit can be damaging to the human body. This fact is thoroughly explained in Mr. Humphrey's article on Radiation in this issue of this law review. But a person thus injured by x-ray radiation from so-called fluoroscopic fitting machines in shoe stores will find it virtually impossible to make out a cause of action in negligence against the owners and operators of the machines. Yet, use of such machines now is known to be seriously harmful, unless that use is closely controlled.

Psychosomatic Injury, Traumatic Psychoneurosis, And Law, Paul David Cantor Jan 1957

Psychosomatic Injury, Traumatic Psychoneurosis, And Law, Paul David Cantor

Cleveland State Law Review

This paper deals with court decisions on liability claims for injuries to the mind rather than for broken bones alone. This subject now is as important to practitioners and students of the law as it long has been to medical men. Much medical knowledge is now reflected in new interpretations by the courts, so that today the legal fact is established that a person's emotional security as well as his physical security must be protected and compensated. The author's purpose is to focus attention on the developments of recent years as well as those of earlier times, and to demonstrate …

Tort Liability For Death By Poisoning, Lawrence Landsroner Jan 1957

Tort Liability For Death By Poisoning, Lawrence Landsroner

Cleveland State Law Review

Liability in deaths resulting from accidental ingestion of harmful material, toxic food, or drug product often is difficult to ascertain. Lack of compliance with the Federal Food and Drug Statutes, or with the State or Municipal Code, often is the critical problem. Determination of liability in these cases usually rests on one of three major bases, in cases involving manufacturers and distributors: (a) That the product is improperly labeled. (b) That it is not labeled in compliance with the municipal, state or federal laws. (c) That it is an inherently dangerous product. If any one of these bases is established, …
