Torts—Strict Products Liability For Retailers?—Ulmer V. Ford Motor Co., 75 Wash. Dec. 2d 537, 452, P.2d 729 (1969), Anon
Washington Law Review
In Ulmer v. Ford Motor Co. the Washington plaintiff brought suit against the manufacturer of an automobile which had gone out of control and crashed into a cement abutment due to a defectively installed "A frame" pivot bolt. Plaintiff, whose theory of recovery was based on strict liability, was denied relief in the trial court. The Supreme Court of Washington reversed and remanded, adopting the Restatement (Second) position and holding that plaintiff's theory reflected the import of cases previously decided by the court under the theory of breach of implied warranty. The court abandoned the implied warranty theory of recovery, …

Supplying Organs For Transplantation, Jesse Dukeminier Jr
Supplying Organs For Transplantation, Jesse Dukeminier Jr
Michigan Law Review
The possibility that a market for organs will develop arises as a result of recent scientific successes in interchanging human parts and the consequent imbalance that has arisen between the quantity of organs supplied and the quantity demanded. Currently, and in the foreseeable future, unless our laws are changed, the quantity supplied will not equal the quantity demanded at a zero price. When useful items are in short supply in a market economy monetary inducements to increase the supply are commonly offered. The question then arises whether society should permit such inducements in order to ensure a satisfactory supply of …

The Persistent Problem Of The Persistent Pesticides: A Lesson In Environmental Law, William H. Rodgers, Jr.
Articles
This article will present an interpretation and criticism of the Commission on Pesticides and Their Relationship to Environmental Health's conclusions, with a special emphasis on the treatment and relevance of the DDT issue. Each of the fourteen recommendations will be reviewed where relevant to the four major goals set forth above. The crucial and often decisive role of the law as a lever for reform, as a catalyst for transmitting scientific information to the political decision-maker and as a medium for planning to protect against the effects of pesticides pollution on the environment and the population will be emphasized. Obstacles …
Part One: Historical Perspective (Of The Chesapeake Bay), Kenneth Lasson
Part One: Historical Perspective (Of The Chesapeake Bay), Kenneth Lasson
All Faculty Scholarship
This study analyzes the legal problems in the development and management of Chesapeake Bay resources. There are threshold problems of definition - What is Chesapeake Bay? What are its resources? What role does law play in their development and management?
The "Historical Perspective" traces the political controversies that have involved the Bay since the colonies of Maryland and Virginia were first founded. In a rough sense, it defines the traditional resources of the Bay by isolating occasions when individuals, businesses and governmental bodies found themselves at cross-purposes as to how the Bay was to be used and shared.

Section 11 Of The Securities Act—A Proposal For Allocating Liability, John R. Allison
Section 11 Of The Securities Act—A Proposal For Allocating Liability, John R. Allison
Washington Law Review
Section 11 gives each non-issuer participant a right to recover contribution from the other participants subject to liability. This comment will show how the right to contribution may be used to make the consequences of participating in registration more predictable, by limiting a non-issuer participant's potential liability to the consequences of his own carelessness. Part I will review briefly the registration requirement, which determines the incidence of section 11 liability. Part I will then discuss the section 11 cause of action, and demonstrate the importance and function of the right to recover contribution. Finally, Part III will analyze the right …
Criminal Procedure—Lineups—Right To Counsel: "Independence" Of In-Court Identification Of Criminal Defendant From Previous Lineup Identification Inadmissible Due To Absence Of Counsel.—State V. Redmond, 75 Wash. Dec. 2d 64, 448 P.2d 938 (1968, Anon
Washington Law Review
Virginia Rohn, alone in her beverage store, was robbed by an unmasked man who remained in the store for approximately five minutes. At a police lineup, five days later, she identified defendant as the robber. Defendant's counsel filed a pre-trial motion to suppress the lineup identification because defendant had not been afforded prior opportunity to contact counsel and counsel had not been present at the lineup. After a preliminary hearing, the trial judge suppressed the lineup identification but ruled that Virginia Rohn was not legally precluded from making an in-court identification. Upon conviction, defendant appealed assigning error to the admission …

O'Callahan V. Parker: Sounding The Death Knell Of Military Justice, Peter W. Bowie
San Diego Law Review
Although the question had been tangentially noted on numerous occasions and in various contexts, until O’Callahan v. Parker, the Supreme Court had never directly considered whether a court-martial had jurisdiction to try a serviceman for commission of a non-service connected offense. In a monumental 5-3 decision, the Court held that where there was no sufficient overriding military interest, a court-martial could not exercise jurisdiction over an offense civil in nature, although the alleged offender was a member of the regular forces on active duty…

Manifest Intent And The Generation By Treaty Of Customary Rules Of International Law, Anthony D'Amato
Manifest Intent And The Generation By Treaty Of Customary Rules Of International Law, Anthony D'Amato
Faculty Working Papers
I shall argue in this essay that the World Court used a method which might be called the rule of manifest intent in the North Sea Continental Shelf Cases, that this method differs from a more traditional approach found in the writings of publicists, and that this new method accords well with the growing need to objectify and place upon a scientific basis the methodology by which one may determine what in fact are the rules of customary law.
