Internal Conflict And Article Three Of The Geneva Conventions, James E. Bond Jan 1971

Internal Conflict And Article Three Of The Geneva Conventions, James E. Bond

Faculty Articles

This article suggests that the laws of war should apply to internal conflicts. The legislative history of the present rules of war began in draft agreements before formally being expressed in international compacts, and that internal conflicts observe similar rules has also been advocated by scholars in draft agreements. It appeared in limited form Article Three of the 1949 Geneva Convention, which gives hope that something tangible will be developed by the United Nations to protect vulnerable populations during internal conflicts. The article continues that in the meantime Article Three should be utilized as a diplomatic tool to hold countries …

Internationally Uniform Probate Law--A Method For Improving Administration Of Multinational Estates, John G. Webb, Iii Jan 1971

Internationally Uniform Probate Law--A Method For Improving Administration Of Multinational Estates, John G. Webb, Iii

Vanderbilt Journal of Transnational Law

The need to coordinate succession laws of different nations was recognized as early as 1893 at the first Hague Conference where attempts were begun to coordinate the laws of succession on death through multilateral conventions. Notwithstanding so early an effort, however, the administration of multinational estates has remained plagued by diversity of national laws governing succession on death. The resulting confusion and inefficiency of administration has often frustrated the testamentary intentions of decedents of many nationalities. While no viable uniformity has been attained among nations, the need for consistency increases. Half a million United States civilian citizens live abroad, and …

Liability For Transfusions Of Hepatitis Infected Blood Jan 1971

Liability For Transfusions Of Hepatitis Infected Blood

University of Richmond Law Review

Legal resolution of the liability of a supplier of a useful and desirable product which, in the present state of human skill and knowledge, is unavoidably and necessarily dangerous to the user is fraught with difficulty. A major portion of the law in this area revolves around cases of hepatitis resulting from blood transfusions. The crucial problem encountered is the nondetectibility of the hepatitis virus in the blood donor. Even though no specific viral detection test has been perfected which can be applied practically to blood banking or plasma pooling, recent observations hold promise for a more accurate method of …

The Canadian Arctic Waters Pollution Prevention Act: New Stresses On The Law Of The Sea, Richard B. Bilder Nov 1970

The Canadian Arctic Waters Pollution Prevention Act: New Stresses On The Law Of The Sea, Richard B. Bilder

Michigan Law Review

The Canadian Pollution Prevention Act is of interest in several respects. It opens a new round in the historic and multifaceted struggle over freedom of the seas. It raises complex questions of international law and policy regarding the legal regime of Arctic waters, the concept of contiguous zones, the status of waters within archipelagoes, and the doctrines of innocent passage and international straits. It illustrates both the perception of an increasing number of coastal states that existing international law and international arrangements are inadequate to protect their legitimate interests, and the strong pressures within such states for unilateral action to …

Logic Vs. Value Judgment In Legal And Ethical Thought, Thomas R. Mccoy Nov 1970

Logic Vs. Value Judgment In Legal And Ethical Thought, Thomas R. Mccoy

Vanderbilt Law Review

Drugs. Abortion. Race. War. Dissent. Civil disobedience and disruption. Air, water, noise pollution. The standard fare with which we are assaulted by the daily news. American society is swamped in a sea of questions that appear to defy answer. It is the thesis of this paper that the unanswerability of many social questions persists because of the inadequacy of the thought patterns through which they are approached. These thought patterns fail because they reflect the structure of our language rather than the structure of reality. This thesis is not new; it has been set forth several times in different forms …

Nuisance As A Modern Mode Of Land Use Control, William H. Wilson Oct 1970

Nuisance As A Modern Mode Of Land Use Control, William H. Wilson

Washington Law Review

Recognizing the inflexibility inherent in present zoning mechanisms, this comment analyzes the concept of nuisance as an additional, more versatile means of land use control. In an exhaustive categorization and evaluation of Washington cases and those from other jurisdictions, the author sets forth the principles of nuisance law and the factors affecting court decisions on nuisance. Both private and public actionable nuisances are discussed, along with available remedies, within a concise analytical framework.
