The Illinois Criminal Code Of 1961 And Code Of Criminal Procedure Of 1963, Charles H. Bowman

University of Michigan Journal of Law Reform

Illinois had no "Criminal Code" in the sense of a codified, systematic body of law functioning as an instrument of social control in a modern community. Many provisions had remained unchanged since Judge Lockwood, in submitting a revised draft of the Laws of Illinois to the Illinois General Assembly of 1827, described the small chapter on criminal jurisprudence as deriving primarily from a volume of the Laws of New York of 1802 which he brought with him to Illinois, and a volume of the Laws of Georgia which he located in the office of the Secretary of State. In fact, …

Negligence And Liability Without Fault In Tort Law, Cornelius J. Peck Jan 1971

Negligence And Liability Without Fault In Tort Law, Cornelius J. Peck

Washington Law Review

Though negligence is emphasized as a basis for determining liability in tort law, Professor Peck points out that liability without fault has always played a major role in that area and, in fact, underlies most torts which are recognized today. After examining these types of torts and distilling some general principles governing the application of liability without fault, he concludes that these principles are also applicable to automobile accident litigation, thus predicting the demise of negligence as a principle of liability in that field.

Theories Of Water Pollution Litigation, Peter N. Davis Jan 1971

Theories Of Water Pollution Litigation, Peter N. Davis

Faculty Publications

The common law has traditionally provided the rules that govern relationships among landowners in their use of watercourses. These rules are embodied in the eastern United States in the doctrine of riparian rights, which addresses itself both to water quantity, and to water quality. Persons complaining of pollution of waters abutting their lands have, in addition to redress by complaint to the state pollution control agency, redress by lawsuit against the alleged polluter. This common law supplements the body of statutory law regulating the waters of the state for the benefit of the people.

Freedom To Hear: A Political Justification Of The First Amendment, John M. Steel Jan 1971

Freedom To Hear: A Political Justification Of The First Amendment, John M. Steel

Washington Law Review

Historical analysis of the first amendment reveals that it was adopted primarily to safeguard and promote self-government through the communication of political ideas and attitudes among citizens. The author argues that these political underpinnings support the recognition of a freedom to hear corresponding to the freedoms of speech and press. Implementation of this freedom, recognizing its political basis, would eliminate many infringements on activity the Framers intended to protect. A freedom to hear would also provide a useful analytic tool in alleviating much of the repressive influence on political activity exerted by the private sector.

Section 2-318 Of The Ucc: The Sleeping Giant, William Michael Karnes Jan 1971

Section 2-318 Of The Ucc: The Sleeping Giant, William Michael Karnes

Cleveland State Law Review

The acceptance, application, and development of Section 2-318 of the Uniform Commercial Codemhas caused more trouble and confusion than the appearance of Darwin's theory of evolution in Tennessee. Overlooking the obvious possible solution of amending Section 2-318, most states have retained a written but unexercised statute and thereby compelled courts to stretch, bend and squeeze breach of warranty into the realm of strict liability in tort.

Death Of Charitable Trust Corporation Law, B. Richard Sutter Jan 1971

Death Of Charitable Trust Corporation Law, B. Richard Sutter

Cleveland State Law Review

Since the subject of non-profit corporations covers such a broad area, this paper will be limited to "Type B corporations" (i.e., the "charitable" type) as described in the new New York Not-For-Profit Corporations Law. These classifications of the new statutory concept (Types A, B, C, D) look to the general purpose of the organization, rather than to a very specific purpose, or to whether or not stock is issued. The New York law further provides for the possibility of any corporation having multiple and overlapping purposes, thus providing a very rational and simple (though debatable as to policy) test to …
