Federal And State Regulations Pertaining To Systematic Collections. I. A Case Of Inadvertent Violation Of Federal Regulations, Jerry R. Choate, Hugh H. Genoways
University of Nebraska State Museum: Mammalogy Papers
On 25 April 1975, at the twenty-second annual meeting of the Southwestern Association of Naturalists (SWAN), at the University of Oklahoma Biological Station, President Keith A. Arnold appointed Jerry Choate to investigate current regulations pertaining to collection and transport of scientific specimens in the region of representation (including Mexico) or SWAN. This charge involves both Federal and State laws, several of which are undergoing change and many of which doubtlessly are not familiar to the membership of SWAN. In order that SWAN members might be made aware of these regulations and not unwittingly commit violations, it was decided that SWANEWS …

Intervention Between Parent And Child: A Reappraisal Of The State’S Role In Child Neglect And Abuse Cases, Judith C. Areen
Georgetown Law Faculty Publications and Other Works
Once a court agrees that it has sufficient cause to assume jurisdiction in order to protect a child, there is a high probability that the child will be separated from his family for months or years, or permanently. Despite the disruptive impact this process obviously can have on children and their families, at present there is little consensus about when a court should find that a particular child is neglected or abused. And just as there is little agreement on when intervention in a particular family is justified, there is little agreement about what forms of intervention are constructive.

Toward Meaningful Protection Of Worker Health And Safety, Joseph A. Page
Toward Meaningful Protection Of Worker Health And Safety, Joseph A. Page
Georgetown Law Faculty Publications and Other Works
In the annals of job health and safety, 1974 was a signal year. It produced an epidemic of occupational liver cancer associated with vinyl chloride disclosure of a plan to soft-pedal federal regulation of industrial hazards in return for contributions to the 1972 Nixon reelection campaign, and the publication of a brace of exposes decrying the human toll taken by workplace perils. These events furnish hard evidence that the bright hopes raised by passage of the landmark Occupational Safety and Health Act of 1970 remain far from fulfillment.
In the search for reasons for this ostensible failure, two books present …

Is The Citizen Suit A Substitute For The Class Action In Environmental Litigation? An Examination Of The Clean Air Act Of 1970 Citizen Suit Provision, Gabriel N. Steinberg
Is The Citizen Suit A Substitute For The Class Action In Environmental Litigation? An Examination Of The Clean Air Act Of 1970 Citizen Suit Provision, Gabriel N. Steinberg
San Diego Law Review
This Article attempts to show that the proper lawsuit may be a citizen suit action utilizing section 304 of the Clean Air Act. It points out similar provisions in other federal environmental legislation, and discusses several cases brought to implement the National Environmental Policy Act. Finally, it shows that the environmental class action has been limited by the Zahn and Eisen cases.

The Tennessee Rule Against Perpetuities: A Proposal For Statutory Reform, C. Dent Bostick
The Tennessee Rule Against Perpetuities: A Proposal For Statutory Reform, C. Dent Bostick
Vanderbilt Law Review
For several decades, there has been agitation for reform of the common-law Rule Against Perpetuities. For the most part, the reformers have urged that improvements in the Rule and the manner of its application be accomplished through legislative enactment.' Only a few jurisdictions have opted for reform by the judiciary. Thus far, there has been no legislative reform of the Rule in Tennessee; the appellate courts of the state continue to apply the Rule inits common-law form with all the confusing rubrics attached to it by centuries of development. The condition of Tennessee's law on the subject contrasts sharply with …

In the future, as in the past, one function of international law will be to formalize and clarify procedures to deal with emergent problems. The international environmental developments noted in this paper, e.g. global monitoring, supervision of the seabed, protection of endangered species, resource allocation, and many others, will require institutional arrangements differing from those with which nations have had experience. Innovation in legal principles and procedures is an almost certain consequence of such developments. Innovations in principle have been among the more obvious outputs of the international environmental conferences and programs since 1968. As these principles are translated, often …
