Constitutional Law - First Amendment - Freedom Of The Press - Constitutional Privilege For Defamation - Private Individual - Libel - Damages, William Richard Carroll

Duquesne Law Review

The United States Supreme Court, applying the first amendment to a libel action, has held that a publisher enjoys no constitutional privilege for defamation of a private individual; the states may allow an award of actual damages under any standard that does not impose strict liability, but "actual malice" must be shown for recovery of presumed or punitive damages.

Separate Statutory Treatment Of The Close Corporation In California: Progress And Problems, Kevin M. Hennessy Jan 1975

Separate Statutory Treatment Of The Close Corporation In California: Progress And Problems, Kevin M. Hennessy

UC Law Journal

California's new General Corporation Law, which will go into effect on January 1, 1977, contains several sections which deal exclusively with close corporations. After considering the new law's definition of a close corporation, the mechanics of electing, revoking, and forfeiting close corporation status, and the statutory benefits such status will confer, the author examines the effectiveness of the new law in meeting the common problems encountered by close corporation participants in agreeing on the management of their corporation and the voting of their shares, in restricting the transfer of their stock, and in avoiding the loss of limited liability because …

New York's Right Of Privacy – The Need For Change, Kent Greenawalt Jan 1975

New York's Right Of Privacy – The Need For Change, Kent Greenawalt

Faculty Scholarship

In 1890 Samuel Warren and Louis Brandeis wrote a famous article on the right to privacy. Concerned especially with newspaper publications about private and family matters, they urged that courts recognize an explicit right to privacy from unreasonable publicity. According to Warren and Brandeis, certain already recognized rights did in fact protect a person's wish to keep his private thoughts private, though these 1ights were founded on some more traditional legal theories. For example, the privilege of a writer of a letter to bar anyone's publication of the letter had been articulated in decisions as a property right, even when …

The Effects Of Tucker On The Fruits Of Illegally Obtained Statements, Jeffery P. Reinhard Jan 1975

The Effects Of Tucker On The Fruits Of Illegally Obtained Statements, Jeffery P. Reinhard

Cleveland State Law Review

Although the Court has been careful to point out that illegally obtained statements are not admissible in the prosecution's case in chief, Michigan v. Tucker has done much to erode even that principle. In Tucker, the Court found admissible the testimony of a witness whose identity was learned solely on the basis of a statement obtained from the defendant in violation of the guidelines set forth in Miranda. Despite the Court's statement that it was significant that the interrogation preceded Miranda, and notwithstanding its reiteration of the principle that the defendant's statements would not have been admissible in the prosecution's …

Federal And State Regulations Pertaining To Systematic Collections. I. A Case Of Inadvertent Violation Of Federal Regulations, Jerry R. Choate, Hugh H. Genoways

University of Nebraska State Museum: Mammalogy Papers

First paragraph:

On 25 April 1975, at the twenty-second annual meeting of SWAN (i.e. Southwestern Association of Naturalists), at the University of Oklahoma Biological Station, President Keith A. Arnold appointed one of us (Choate) to investigate current regulations pertaining to collection and transport of scientific specimens in the region of representation (including Mexico) or SWAN. This charge involves both Federal and State laws, several of which are undergoing change and many of which doubtlessly are not familiar to the membership of SWAN. In order that SWAN members might be made aware of these regulations and not unwittingly commit violations, it …
