Attorney Advertising Over The Broadcast Media, I. Terry Currie
Attorney Advertising Over The Broadcast Media, I. Terry Currie
Vanderbilt Law Review
This Note will examine the first amendment issues that broadcast attorney advertising raises. The Note will begin with a general discussion of the analytical approach adopted by the Supreme Court in freedom of speech and commercial speech cases. Next, the Note will explore the "special problems" and unique characteristics of the broadcast media as they relate to the interests affected by broadcast attorney advertising, concluding that the benefits afforded to consumers outweigh the potential risks created by such advertising. The Note will also briefly consider various regulations on broadcast advertising adopted by the bar at both the state and federal …
The Changing Meaning Of "Gift": An Analysis Of The Tax Court's Decision In Carson V. Commissioner, Jeffrey Schoenblum
The Changing Meaning Of "Gift": An Analysis Of The Tax Court's Decision In Carson V. Commissioner, Jeffrey Schoenblum
Vanderbilt Law Review
This Article will focus on the Carson case in an effort to identify the emerging meaning, if any, of gift. Following a consideration of the factual background of the case in Part II, Part HI will analyze critically and in-depth each of the five Carson opinions in an effort to decipher the various currents at play and any common ground that may still be shared by a majority of the court. Finally, Part IV will consider the decision's likely consequences and the long-term prospects for a settled meaning for gift, one that is not only workable, as is the case …
The Pursuit Of A Client's Interest, Warren Lehman
The Pursuit Of A Client's Interest, Warren Lehman
Michigan Law Review
There has been recently a resurgence of interest in how the lawyer serves his client. Much of that interest has been occasioned by the indigestibility of the idea that the lawyer is, as it is said, a hired gun. There are those who think that instead the lawyer ought to act toward his client as a therapist. Others are concerned with rationalizing for the lawyer the ethical discomforts of servantship (which many might guess have been brought to the fore by Watergate). Yet others see the client as victim of a structure - represented by the lawyer - that frustrates …
Untangling The Strands Of The Fourteenth Amendment, Ira C. Lupu
Untangling The Strands Of The Fourteenth Amendment, Ira C. Lupu
Michigan Law Review
This Article explores such trends in the context of several recent cases and in the broader context of established patterns of constitutional law. Section II shows how the different strains of fourteenth amendment activism over the past century have tangled the strands of the fourteenth amendment in a thick, almost impenetrable knot. Section ill studies the tangle's reflection in three cases raising fundamental rights problems - Maher v. Roe, Moore v. City of East Cleveland, and Zablocki v. Redhail. Finally, Section N offers what Sections II and III suggest is missing from fourteenth amendment case law- a theory, abstract …

The complexity of detail that characterizes the Internal Revenue Code (Code) has been the subject of intense criticism and only faint praise. Yet, one of the more striking anomalies of the Code is that its often suffocating detail coexists with the sparest definitions of many key terms. The term "gift" is a prime example. Although its meaning plays an instrumental role in income and gift taxation, the Code nowhere defines the term. As a result, the task of fleshing out its meaning has largely fallen on the Treasury, through the issuance of regulations and rulings, and on the courts, which …
Dolphin Conservation In The Tuna Industry: The United States' Role In An International Problem, Laurel Lee Hyde
Dolphin Conservation In The Tuna Industry: The United States' Role In An International Problem, Laurel Lee Hyde
San Diego Law Review
Thousands of dolphin die annually in the international tuna fishery. This Comment explores the history of that problem and the domestic and international attempts to alleviate it. Foreign legislation, positions of international organizations, and documents of the United Nations Law of the Sea Conference are reviewed as potential sources of an international solution. The Comment emphasizes the need for active United States involvement in international programs, comprehensive data on the dolphin populations, and immediate action to avoid excessive exploitation. It concludes with a suggestion that increased public concern for dolphin may be utilized effectively to support conservation initiatives.

The seduction of power is as perennial as the threat of power spurned. Power is a medium for good and evil. Lawyers and politicians and their victims—Nixon and his cronies, for examples—come and go; but the moral problems of how to use power, how to live with it and leave it behind, remain.
One way to look at the moral problem of power is to ask how a virtuous person uses power, and lives close to power, without losing the sense of self which is necessary to negotiate the temptations of power. We propose to ask that question with respect …

The California Sea Otter: Emerging Conflicts In Resource Management, James J. Armstrong
San Diego Law Review
This Article examines the sea otter, it's history, and its present status with regard to federal safeguards now protecting otters and California 's attempts to prevent economic burdens caused by these federal safeguards. The Article begins by discussing the sea otter in general and man's exploitation of the sea otters for their fur.
