Brokered Abuse, Thomas E. Kadri

This chapter examines how data brokers, companies that collect, sell, and trade personal information, enable and intensify interpersonal abuse. The article analyzes the data brokerage industry’s role in undermining personal obscurity, the relative safety that comes from being difficult to find or understand, and explores how current laws not only fail to address these harms but can make them worse. The chapter argues that existing privacy regimes, particularly those requiring victims to request data removal from individual brokers, impose psychological burdens and can retraumatize victims.

Dirty luxuries are items that are pleasant or nice to have, not necessities, that absolutely bludgeon the environment. From the merely affluent to the ultra-rich, consumers enjoying dirty luxuries, such as luxury clothing, private jets, superyachts, SUVs, and vacation cruises, drive one of the most polluting types of consumption on the planet. This Article explores the climate costs of dirty luxuries, considers the current and proposed international efforts to address the climate impact of these luxuries, and proposes structures by which these luxuries may be taxed to either reduce consumption or compensate for negative externalities.

The issue of restitution for sexual and physical abuse of survivors of Indian residential schools has gained litigative traction, leaving the issue of reparations for cultural loss in the shadows. This Comment explores the idea of a new tort of cultural loss to more holistically address the systematized harm experienced by Aboriginal children forced into residential schools in Canada. Based on the qualitative experiences of survivors of residential schools, this Comment suggests a taxonomy of cultural loss that may further inform efforts to use tort law as a vehicle for reparative justice. This paper was prepared for a Symposium marking the centennial of the Supreme Court’s decisions in Meyer v. Nebraska (1923) and Pierce v. Society of Sisters (1925). At their inception, Meyer and Pierce reflected constitutional principles of economic freedom and parental control of their children’s education. Part I traces the path of ideas put in motion by Meyer and Pierce. These include the decline of their economic freedom component and the broader grounding of their doctrines of parental authority. This essay discusses the forthcoming book, Fat Leonard: How One Man Bribed, Bilked, and Seduced the U.S. Navy (480 pp, Simon & Schuster, 2024), authored by Washington Post investigative reporter, Craig Whitlock. The book chronicles the extraordinary ''Fat Leonard" saga (or scandal), involving Glenn Marine, an Asia-based ship husbanding contractor, and its "business" with the U.S. Navy. The animating character, not surprisingly, is Leonard Francis, and the book spans his career and demise, which eventually prompted investigations (of hundreds of Naval servicemembers, including 90 admirals), multiple criminal plea bargains, and a staggering number of military administrative actions.

Administrative law – and by extension, government procurement law – is in a period of transition in the United States. The judiciary, sometimes alarmed by the perceived excesses of the administrative state, is reexamining the deference traditionally afforded agency interpretations of law. As part of that transition, the Supreme Court in Loper Bright Enterprises v. Raimondo (June 2024) overruled the test it first established in Chevron v. Natural Resources Defense Council (1984), which held that if a statute was ambiguous, the courts would defer to an agency’s reading of that statute so long as the agency’s interpretation was reasonable. This Comment argues that the third-party doctrine further alienates EU-U.S. partnerships because the doctrine subverts privacy interests as binding legal precedent. Part II will explore the history of the third-party doctrine up until the Carpenter decision and explain why U.S. privacy rights are linked with access to third-party information. This Comment will further outline EU data protection laws, EU legislation, and the CJEU’s Schrems II decision. In the summer of 2023, Hollywood froze when actors, writers, and crew took to the picket lines. Their gripe: the recent mega mergers by media conglomerates. The Writers Guild Association and Screen Actors Guild American Federation of Television and Radio Artists joined forces to protest recent acquisitions by Disney, Amazon, and Netflix; these companies vertically integrated within the industry, which allowed them to exploit workers, limit content, and raise prices for consumers. Renewed attention to equity in higher education is welcome because true equity helps us to reason together well. When administered correctly, the jurisprudence of equity models civil discourse and, therefore, can teach us how to carry out civic engagement reasonably. Equitable interpretation of the law teaches us how to understand each other charitably. And equity’s deference to law teaches us how to reason well together about our practical problems. Under section 503(b)(9) of title 11 of the United States Code (the "Bankruptcy Code"), administrative expenses should be allowed for "the value of any goods received by the debtor within 20 days before the date of commencement of a case under this title in which the goods have been sold to the debtor in the ordinary course of such debtor’s business." Courts uniformly analyzed the Uniform Commercial Code’s (the "UCC") definition of “goods” in the absence of a definition in the Bankruptcy Code. Carbon capture, utilization, and storage (CCUS) presents a new way of using an old resource: the subterranean rock structures and their interstitial “pore” space that make up the subsurface of the earth. Injecting carbon into these structures also raises a number of new legal questions about their ownership and the relations between the owners of the structures and the owners of other subsurface resources contained within them, like oil and gas, coal, coalbed methane, and geologically native carbon dioxide. This Article expands upon the seminal work by Cheryl Harris entitled Whiteness as Property by exploring the intersection of race and property through Indianness. Indianness has been constructed as a form of property conferring rights and privileges to its holders which this Article examines through the inertial relationship between race and legal status. Tracing the historical evolution of Indianness from the slavery era to the modern era demonstrates the complex relationship between tribal sovereignty, citizenship and Indian identity. Matthew Desmond made the claim in Evicted, his powerful work on housing insecurity, that those concerned with alleviating poverty should focus not merely on ensuring that poor people have higher disposable incomes, but on countering the exploitative price gouging that depresses the value of whatever income they have. This suggests the possibility that it might be a worthwhile anti-poverty strategy for courts to use the unconscionability doctrine to regulate exploitative contracts.

เอกัตศึกษาฉบับนี้ มีวัตถุประสงค์เพื่อมีมาตรการ หรือแนวคิดริเริ่มเพื่อส่งเสริมธุรกิจอาหารทางเลือกจากพืชในประเทศไทยให้เติบโตมากขึ้น เพื่อสร้างประโยชน์ในระยะยาวให้กับเศรษฐกิจและสังคมไทยอย่างยั่งยืน ประโยชน์ของธุรกิจดังกล่าวส่งผลกระทบในด้านต่าง ๆ ดังนี้ (1) ประโยชน์ด้านสุขภาพ สามารถช่วยให้มีสุขภาพดีขึ้น รวมถึงลดความเสี่ยงต่อโรคต่าง ๆ (2) ประโยชน์ด้านสิ่งแวดล้อม การรับประทานอาหารทางเลือกจากพืชใช้ทรัพยากรต่าง ๆ เช่น ที่ดิน แหล่งน้ำ และพลังงาน น้อยกว่าอาหารที่มีส่วนผสมจากเนื้อสัตว์ จึงถือเป็นการประหยัดพลังงานและช่วยรักษาสิ่งแวดล้อมได้เป็นอย่างดี (3) ประโยชน์ด้านความมั่นคงทางอาหาร สามารถช่วยลดความเสี่ยงจากการขาดแคลนอาหาร เนื่องจากกระบวนการผลิตอาหารทางเลือกจากพืชใช้ทรัพยากรด้านต่าง ๆ น้อยกว่าผลิตภัณฑ์จากสัตว์ และ (4) ประโยชน์ด้านสวัสดิภาพสัตว์ การรับประทานอาหารทางเลือกจากพืชถือเป็นการคุ้มครองสัตว์ เพราะเป็นการลดการผลิตผลิตภัณฑ์จากเนื้อสัตว์ในฟาร์มเอกัตศึกษาฉบับนี้ มีการดำเนินการวิจัยด้วยวิธีการศึกษาเชิงเอกสาร (Documentary Research) โดยการศึกษาค้นคว้า รวบรวม วิเคราะห์ข้อมูล จากหนังสือ บทความ ตำรา วิทยานิพนธ์ เอกัตศึกษา เอกสารสิ่งพิมพ์ หลักภาษีอากร โดยมีการใช้ฐานข้อมูลออนไลน์ ที่มีบุคคลอื่นได้บันทึกหรือตีพิมพ์เผยแพร่ไว้เกี่ยวกับมาตรการเพื่อส่งเสริมธุรกิจอาหารทางเลือกจากพืช ทั้งในประเทศไทยและต่างประเทศ จากนั้นนำข้อมูลที่รวบรวมได้มาทำการศึกษา เรียบเรียง และวิเคราะห์อย่างเป็นระบบ เพื่อเสนอแนวทางการสร้างแรงจูงใจให้กับผู้ประกอบธุรกิจอาหารทางเลือกจากพืชจากการศึกษา พบว่า ในปัจจุบัน ไทยยังขาดมาตรการส่งเสริมธุรกิจอาหารทางเลือกจากพืชที่ชัดเจนและครอบคลุม เมื่อเทียบกับหลายประเทศที่ให้ความสำคัญกับเรื่องนี้ เช่น สหรัฐอเมริกา สหภาพยุโรป และสิงคโปร์ ทั้งนี้ เพื่อส่งเสริมธุรกิจอาหารทางเลือกจากพืชในไทยให้เติบโตอย่างยั่งยืน ควรมีการดำเนินการดังนี้ (1) จัดทำแผนยุทธศาสตร์ระดับชาติ และกฎหมายเฉพาะเพื่อส่งเสริมอาหารทางเลือกจากพืช: กำหนดเป้าหมายและแนวทางการดำเนินงานที่ชัดเจน (2) บูรณาการนโยบาย เชื่อมโยงนโยบายด้านอาหารกับนโยบายอื่น ๆ เช่น สุขภาพ สิ่งแวดล้อม และเศรษฐกิจ รวมถึงการสนับสนุนการวิจัยและพัฒนา เพื่อส่งเสริมการพัฒนานวัตกรรม ซึ่งจะเป็นองค์ประกอบสำคัญในการพัฒนาผลิตภัณฑ์ใหม่ ๆ และเทคโนโลยีที่เกี่ยวข้อง (3) ส่งเสริมด้านสิทธิประโยชน์ทางภาษีเพื่อส่งเสริมธุรกิจอาหารทางเลือกจากพืช ทั้งในส่วนที่ส่งผลกับอาหารทางเลือกจากพืชโดยตรง เช่น การพิจารณาปรับลดอัตราภาษีมูลค่าเพิ่มสำหรับอาหารทางเลือกจากพืช และส่วนที่เกี่ยวข้องกับการให้สิทธิประโยชน์ทางภาษีทางอ้อม เช่น การหักค่าใช้จ่ายที่ใช้สำหรับการวิจัย (4) สร้างความตระหนักรู้ และประชาสัมพันธ์ข้อมูลเกี่ยวกับประโยชน์ของอาหารจากพืช ทั้งต่อผู้บริโภคเอง และต่อสังคมในภาพรวม (5) สนับสนุนเกษตรกร และส่งเสริมการปลูกพืชที่ใช้เป็นวัตถุดิบในการผลิตอาหารจากพืชการดำเนินการเหล่านี้จะช่วยให้ไทยมีอุตสาหกรรมอาหารทางเลือกจากพืชที่แข็งแกร่ง สามารถแข่งขันในตลาดโลก และตอบสนองความต้องการของผู้บริโภคที่ใส่ใจสุขภาพและสิ่งแวดล้อมมากขึ้น นอกจากนี้ …

ลิขสิทธิ์ถือเป็นทรัพย์สินอย่างหนึ่งที่มีบทบัญญัติกฎหมายบังคับใช้ไว้โดยเฉพาะ อันได้แก่ พระราชบัญญัติลิขสิทธิ์ พ.ศ.2537 แต่เมื่อผู้สร้างสรรค์งานอันมีลิขสิทธิ์เป็นบุคคลผู้สมรสตามกฎหมาย หากพิจารณาตามเจตนารมณ์ของการให้ความคุ้มครองลิขสิทธิ์ ลิขสิทธิ์ที่ได้มาระหว่างการสมรสนั้นควรถือว่าเป็นสินส่วนตัวของคู่สมรสฝ่ายที่เป็นผู้สร้างสรรค์ เนื่องจากนิยามของคำว่าลิขสิทธิ์ซึ่งได้กำหนดไว้ในมาตรา 4 หมายถึงสิทธิแต่ผู้เดียวที่จะกระทำการใดตามพระราชบัญญัตินี้เกี่ยวกับงานที่ผู้สร้างสรรค์ได้ทำขึ้น แต่หากพิจารณาตามประมวลกฎหมายแพ่งและพาณิชย์เมื่อลิขสิทธิ์เป็นทรัพย์สินที่ได้มาระหว่างการสมรสอาจถือเป็นสินสมรสได้ตามมาตรา 1474 ผู้เขียนได้ศึกษาเปรียบเทียบกฎหมายลิขสิทธิ์ และประมวลกฎหมายแพ่ง มลรัฐ Louisiana ของประเทศสหรัฐอเมริกา ซึ่งมีแนวคำพิพากษาของศาลกรณีของลิขสิทธิ์ที่ได้มาระหว่างการสมรส ประมวลกฎหมายทรัพย์สินทางปัญญา และประมวลกฎหมายแพ่ง ของประเทศฝรั่งเศส ซึ่งมีบทบัญญัติกฎหมายที่ชัดเจนเกี่ยวกับลิขสิทธิ์กรณีที่ผู้สร้างสรรค์เป็นผู้สมรส เพื่อนำมาเป็นแนวทางในการวิเคราะห์และเสนอแก้ไขปรับปรุงกฎหมายของประเทศไทย จากการศึกษาพบว่า บทบัญญัติกฎหมายและแนวทางการพิจารณาเรื่องการได้มาซึ่งลิขสิทธิ์ระหว่างการสมรสของประเทศไทยยังไม่มีความชัดเจนและเหมาะสม การพิจารณานำเรื่องของอำนาจการจัดการสินสมรส และการแบ่งสินสมรสมาปรับใช้กับลิขสิทธิ์ในฐานะของสินสมรสกับกรณีที่คู่สมรสฝ่ายใดฝ่ายหนึ่งเป็นผู้สร้างสรรค์นั้นไม่มีความเหมาะสมและส่งผลให้เกิดปัญหาความยุ่งยากตามมาผู้เขียนจึงเสนอให้ลิขสิทธิ์ที่ได้มาระหว่างการสมรสเป็นสินส่วนตัวของคู่สมรสฝ่ายที่เป็นผู้สร้างสรรค์ โดยให้แก้ไขประมวลกฎหมายแพ่งและพาณิชย์เพิ่มเติม (5) ในมาตรา 1471 เกี่ยวกับสินส่วนตัว ได้แก่ “สิทธิในทรัพย์สินทางปัญญา ที่คู่สมรสฝ่ายใดฝ่ายหนึ่งเป็นเจ้าของโดยการสร้างสรรค์” ซึ่งจะหมายความรวมถึงลิขสิทธิ์ด้วย และเสนอแก้ไขโดยเพิ่มเติมมาตรา 15/1 ในพระราชบัญญัติลิขสิทธิ์ พ.ศ.2537 กำหนดให้สิทธิแต่ผู้เดียวตามมาตรา 15 เป็นสิทธิของคู่สมรสฝ่ายที่เป็นผู้สร้างสรรค์ ในกรณีที่คู่สมรสฝ่ายใดฝ่ายหนึ่งเป็นเจ้าของลิขสิทธิ์โดยการสร้างสรรค์ และไม่ถือเป็นสิทธิที่ได้มาระหว่างการสมรสในฐานะสินสมรส เพื่อให้สอดคล้องกับเจตนารมณ์แห่งการให้ความคุ้มครองลิขสิทธิ์

แนวทางการพัฒนามาตรฐานการจ้างแรงงานภาคเกษตรกรรม : ศึกษากรณีลูกจ้างในงานเพาะปลูก, อิทธิ วงษ์บุญธรรม

วิทยานิพนธ์ฉบับนี้มุ่งศึกษาถึงกรอบแนวคิด และหลักการทั่วไปเกี่ยวกับมาตรฐานการจ้างแรงงานภาคเกษตรที่มีลักษณะการทำงานพิเศษเฉพาะตามฤดูกาล โดยศึกษาเปรียบเทียบกับประเทศที่มีการรับรองสิทธิแรงงานและให้การคุ้มครองแรงงานภาคเกษตร ได้แก่ ประเทศสาธารณรัฐฟิลิปปินส์ ประเทศญี่ปุ่น ประเทศสหรัฐอเมริกา และประเทศไทย จากการศึกษาพบว่า หลักการกำหนดเงื่อนไขการจ้างแรงงาน และการคุ้มครองแรงงานภาคเกษตรของประเทศสาธารณรัฐฟิลิปปินส์ ประเทศญี่ปุ่น ประเทศสหรัฐอเมริกา และประเทศไทย มีองค์ประกอบของการคุ้มครองสิทธิแรงงาน โดยปัญหาที่พบจากการศึกษาในบริบทการจ้างแรงงานภาคเกษตรของประเทศไทย คือ การกำหนดเงื่อนไขการจ้างแรงงานภาคเกษตร เช่น งานเพาะปลูก ซึ่งมีลักษณะต้องผันแปรตามภูมิอากาศทั่วไป และความแปรปรวนของสภาพภูมิอากาศ อีกทั้งบริบทเรื่องสิ่งแวดล้อมที่สำคัญจำเป็น ได้แก่ ดิน น้ำ อากาศ เหตุปัจจัยที่กล่าวมาเป็นมาตรที่บ่งชี้เงื่อนไขการจ้างงานในเรื่อง เวลาการทำงาน เวลาพัก วันหยุด ค่าจ้าง สวัสดิการ ความปลอดและอาชีวอนามัย รวมทั้งแรงงานหญิงและเด็ก ดังนั้น ปัญหาของการกำหนดเงื่อนไขการจ้างงาน อาจเกิดจากนายจ้างบางรายมิได้ปฏิบัติให้ถูกต้องตามสิทธิทางแรงงานที่ลูกจ้างพึงมี ซึ่งตามหลักการและทางปฏิบัติมักมีปัจจัยที่ทำให้ลักษณะการทำงานแตกต่างไปจากงานประเภทอื่น การนี้เองทำให้เงื่อนไขการจ้างงานเคร่งครัดเข้มงวดไปกับลักษณะของงานเกษตรบางประเภท เช่น งานเพาะปลูก ในส่วนของเงื่อนไขการคุ้มครองแรงงานภาคเกษตร มีพื้นฐานมาจากสิทธิแรงงาน ซึ่งสิทธิแรงงานยังไม่มีความเสมอภาคควรมีการแก้ไขในประการนี้ให้สอดคล้องกับหลักดังกล่าว ด้วยเหตุนี้ กฎหมายแรงงานภาคเกษตรจึงควรได้รับการพัฒนาโดยการกำหนดมาตรฐานการจ้างแรงงานให้แตกต่างไปจากงานประเภทอื่น

ข้อยกเว้นด้านความมั่นคงตามมาตรา XXI(b) แห่งความตกลงองค์การการค้าโลก (WTO) ทวีความสำคัญขึ้นในปัจจุบัน เนื่องจากประเทศสมาชิกนำมาใช้เป็นเครื่องมือจำกัดการค้าระหว่างประเทศมากขึ้น การศึกษานี้มุ่งวิเคราะห์การตีความและการบังคับใช้ข้อยกเว้นดังกล่าว โดยเปรียบเทียบกับบทบัญญัติมาตรการที่กระทำได้ (Non-Precluded Measures Clause: NPM) ในกฎหมายการลงทุนระหว่างประเทศ โดยตั้งสมมติฐานว่าการพิจารณาเพียงเงื่อนไขตาม (i)-(iii) ของมาตรา XXI(b) เป็นเกณฑ์ที่อาจทำให้ประเทศสมาชิกยกอ้างข้อยกเว้นความมั่นคงได้โดยง่ายเกินไป การศึกษาใช้วิธีวิจัยเชิงเอกสารโดยวิเคราะห์คำวินิจฉัยของคณะกรรมการระงับข้อพิพาทของ WTO คำชี้ขาดของคณะอนุญาโตตุลาการด้านการลงทุนระหว่างประเทศ ตลอดจนประวัติการเจรจาและวัตถุประสงค์ของมาตรา XXI ผลการศึกษาพบว่า WTO ยังขาดกฎเกณฑ์ที่ชัดเจนในการตรวจสอบการใช้ดุลพินิจของรัฐ แม้ไม่อาจนำกฎเกณฑ์ของกฎหมายการลงทุนระหว่างประเทศมาใช้โดยตรงเนื่องจากลักษณะธุรกรรมและความสัมพันธ์ที่แตกต่างกัน แต่มีส่วนที่สอดคล้องกันคือการใช้วลี "it considers necessary" ที่สะท้อนลักษณะบทบัญญัติแบบอัตวินิจฉัย (self-judging) ทั้งนี้ แนวปฏิบัติจากกฎหมายการลงทุนระหว่างประเทศสามารถนำมาประยุกต์ใช้ในการตรวจสอบการใช้ดุลพินิจของรัฐภายใต้กรอบ WTO ในส่วนของหลักสุจริตได้ อย่างไรก็ตาม ความกังวลสำคัญคือการใช้ข้อยกเว้นด้านความมั่นคงในทางที่ผิดอย่างต่อเนื่อง อาจทำให้ข้อยกเว้นกลายเป็นหลักปฏิบัติปกติ ซึ่งทำลายเจตนารมณ์ดั้งเดิมและส่งผลกระทบต่อเสถียรภาพของระบบการค้าระหว่างประเทศ การศึกษานี้จึงเสนอแนะให้พัฒนาแนวทางการตีความที่ชัดเจนขึ้น สร้างกลไกการตรวจสอบที่มีประสิทธิภาพ และสร้างความสมดุลระหว่างการคุ้มครองผลประโยชน์ด้านความมั่นคงของรัฐและการรักษาเสถียรภาพของระบบการค้าระหว่างประเทศ

The last great confrontation between courts and the regulatory state occurred at the turn of the previous century. As courts in the first decades of the twentieth century resisted regulatory laws designed to protect workers and curb market excesses, they sustained broad legal and public critique, including claims that they were guardians of corporate power and monied and propertied interests. The showdown, as is familiar fare, was seemingly resolved in the New Deal, with the Supreme Court and judiciary largely accepting the constitutionality of federal and state regulatory laws. This Essay interrogates the reasoning behind the retrenchment toward LGBTQ rights progress that has taken place since marriage equality. With marriage rights for same-sex couples now "on the books," the Supreme Court's treatment of same-sex couples in both Masterpiece Cakeshop, Ltd. v. Colorado Civil Rights Comm'n and 303 Creative LLC v. Elenis reveals the status quo's hesitancy to recognize same-sex relationships on equal footing. Retrenchment, however, only describes the moment itself; it alludes to but offers no comprehensive or satisfying theory that identifies the motives behind the moves.
