Cardozo Journal of Equal Rights & Social Justice

The note examines the implications of the Supreme Court's decision in 303 Creative LLC v. Elenis, which upheld the First Amendment protection for a website designer refusing to create designs contrary to her beliefs, thereby invalidating part of Colorado's antidiscrimination law. This ruling undermines LGBTQ+ public accommodations protections, highlighting the need for federal legislation, such as the Equality Act, to safeguard these rights and address First Amendment concerns.

Emerging water pollutants are a growing global concern due to their ubiquitous presence in water resources worldwide and their potential adverse effects on human health and ecosystems. Limited scientific understanding of sources of emerging pollutants’ emissions to water bodies and their pathways, behaviour, and fate in aquatic environments, as well as human health and ecological effects, is a significant hindrance in managing emerging water pollutants. This Article introduces the new interdisciplinary field of Environmental Geography and Law, which has deep roots in ecology, social science, and law. Environmental and natural resources laws are situated in specific times and places where the climate, ecosystems, history and political economy influence both the land and the law. These places drive and constrain the way law develops. In turn, the law shapes places, from the dispossession and forced migration of indigenous groups, to land development via railroad land grants, to patterns of resource extraction and infrastructure development. Since the financial crisis of 2008, left-leaning legal thought has experienced a renaissance within the American academy. From law and political economy to critical race theory to feminist legal studies to Marxist legal theory, new perspectives have flourished, and marginalized traditions have been revived and revised. These new perspectives and revisionist projects all share an intellectual debt to the critical legal studies (“CLS”) movement of the late 1970s and 1980s. That movement’s critique was focused on functional accounts of law: accounts that understood legal change as primarily responsive to the demands of extralegal social and economic forces. Trump v. Anderson and Trump v. United States were two momentous decisions in a momentous Supreme Court term. Sharing then former — and now current — President Trump as a party, the decisions hold important implications for presidential power and accountability.

Anderson arose from a suit brought by Colorado voters to challenge Trump’s inclusion on the Republican primary ballot in that state. They argued that Trump organized and incited the mob that attacked the Capitol on January 6, 2021, and disrupted the Electoral College vote count and certification. Felicia Sonmez alleges that the Washington Post violated the D.C. Human Rights Act by banning her from covering certain stories because she is a woman and a sexual-assault survivor. Op. 2-3. After finding Sonmez’s detailed allegations plausible, a panel of this Court rejected as premature the Post’s First Amendment defense that its decision was driven not by discrimination but by a desire to maintain an appearance of objectivity. Social robots are a class of emerging smart consumer electronics devices that promise sophisticated experiences featuring emotive capabilities, artificial intelligence, conversational interaction, and more. With unique risk factors like emotional attachment, little is known on how social robots communicate these promises to consumers and whether they adequately deliver upon them within their overall product experiences prior to and during user interaction.

Animated by a consumer protection lens, this paper systematically investigates manufacturer claims made for four commercially available social robots, evaluating these claims against the provided user experience and consumer reviews. We find that social robots vary widely in the …

Background: Florfenicol, an antibiotic permitted in veterinary medicine, currently lacks an established maximum residue limit (MRL) in meat products in Thailand, effectively mandating undetectable residue levels. In May 2024, Thailand Pesticide Alert Network reported florfenicol residues in swine, raising concerns about consumer safety, rational veterinary drug use, and the potential for antimicrobial resistance (AMR). A vibrant press is vital to meaningful self-government. Indeed, the indispensability of investigative journalism to democracy raises the stakes of the news industry’s ongoing collapse. Many of the country’s most prominent outlets are shedding jobs as local operations shutter entirely. The downstream effects of this market contraction frustrate the informed exercise of popular sovereignty.

Because journalism is a public good in the economic sense, the state must intervene to provision it. To this end, scholars have generally endorsed one of two legal bases for government action. Workers from the Global South with temporary immigration status provide a transitory, cheap, exploitable workforce that is responsive to economic vicissitudes and supremacist anti-migration discourse. They are created as an exceptional category of persons “essential” for their work but with no right to remain and claim citizenship-type entitlement to the Global North. The programs in agriculture are rooted in the legacies of indentureship, plantation, and other forms of racialized coerced labour. These programs continue to entrench a neocolonial racial capitalist global order where “unfree labour” is sanctified by contemporary liberal laws. How did the United Nations - an international organization built on 19th century worldviews and state-centric structures, integrate 21st century challenges of environmental protection into its mission and programs? The UN Charter includes no mandate for environmental protection. Ecological integrity was not included in the scope of peace and security held by member states when they ratified the UN Charter. Yet, despite this and other historical, philosophical and structural limitations, the UN became the leading body for the development of global environmental policy.

In order to keep America’s armed forces deadly, ESC must be decriminalized. The MCM’s 2019 update to start including non-heterosexual marriages and affairs tragically expands the reach of ESC. This Note presents new data on charging patterns of ESC in the Marines, highlighting the crime’s active use. ESC continues to overcompensate for behavior prejudicial to good order and discipline or service discrediting; this overcompensation results in subjecting non-prejudicial and non-service-discrediting behavior to criminal action, simultaneously infringing on service members’ constitutional rights and serving as fodder for public outcry. We Were All Originalists . . . For A Minute: Has The Supreme Court Abandoned The Search For Original Public Meaning? Should It?, Steven Semeraro

Predicting the Supreme Court’s next turn is tricky business. The two obstruction-of-justice cases considered here may turn out to be what used to be called “sports,” i.e., cases where the Court used a mode of analysis that it abandons in future cases without explanation. Perhaps, though, these cases hold the promise of a new, more open frontier of judicial interpretation in the service of our self-governing spirit. Is the in-person registration requirement Nevada’s last-ditch effort to keep what happens in Vegas, in Vegas? This Comment argues that Nevada violates the Dormant Commerce Clause by requiring in-person registration for online sports betting. Part II introduces Nevada’s sports gaming regulations, history, regulatory scheme, and the potentially impacted industries. Part III discusses the relevant law on the Dormant Commerce Clause under a discrimination test. El presente artículo analiza las dinámicas de sostenibilidad ambiental en comunidades mayas del estado de Yucatán, México, enfocándose en los riesgos ambientales y las respuestas adaptativas desarrolladas frente al cambio climático. El trabajo se desarrolló en tres comunidades: Yaxunah, caracterizada por la producción artesanal y la sobreexplotación del árbol de Chaká (Bursera simaruba); Ixil, que enfrenta disputas territoriales e inundaciones recurrentes; y Sotuta, afectada por la contaminación acuífera derivada de una granja porcina en zonas aledañas. Taking Proportionality Seriously: A Countercultural Approach, Suzanne Chiodo

Proportionality was introduced into Ontario’s Rules of Civil Procedure in 2008. A plain reading of Rules 1.04(1) and (1.1) is the ‘traditional’ interpretation of proportionality: that proportionality is merely the means of furthering efficiency and economy in individual cases, with the aim of better securing substantive justice on the merits in those cases. The relative measure is what is at stake in the individual case. This article suggests a counter-cultural interpretation: that proportionality is equal in importance to substantive justice and that, in certain circumstances, substantive justice in individual cases must give way to proportionality, in order to secure the …

Part I of this Note discusses the purpose of chimera research, various ethical arguments, and the current perception of chimera research in the United States to address aspects of the proposed legislation. Chimeras are unique in that they have both human and animal cells.
