The Prosecutor Of The Icc: Too Political, Not Political Enough, Or Both?, Chandra Lekha Sriram May 2009

The Prosecutor Of The Icc: Too Political, Not Political Enough, Or Both?, Chandra Lekha Sriram

Human Rights & Human Welfare

Much of the criticism of the behavior of the prosecutor of the International Criminal Court, Luis Moreno-Ocampo, revolves around two apparently contradictory criticisms, although both may well be true: that he is too political, and that he is not political, or politically savvy, enough. Certainly, his rush to pursue high-profile indictments, contemporaneous with his pursuit of the “low-hanging fruit” (supposedly easy cases such as that of Thomas Lubanga Dyilo), suggest a prosecutor with sharp political instincts and a recognition of the need for a new institution to have a few “quick wins.” Yet, simultaneously, his blundering approach with respect to …

The International Criminal Court, Mark Gibney May 2009

The International Criminal Court, Mark Gibney

Human Rights & Human Welfare

I believe I speak for many when I say that the International Criminal Court (ICC) has not been anywhere near the institution that it was anticipated as being, and the latest manifestation of the ICC’s shortcomings is the humanitarian disaster that has ensued after the Court issued an arrest warrant against Sudanese President Bashir. Since no other UN action is anticipated, all that remains is to count the ever-growing number of Sudanese deaths that will result from what now appears to be a purely symbolic act that was all-too predictable.

Case Posed: But Can The Prosecution Rest?, Charli Carpenter May 2009

Case Posed: But Can The Prosecution Rest?, Charli Carpenter

Human Rights & Human Welfare

Julie Flint and Alex de Waal have published a damning article about the ICC prosecutor Luis Moreno Ocampo which reads, by extension, as a trouncing of the entire institution. I’m not in the loop with the court’s day-to-day politics well enough to offer an informed counter-argument, so instead, by way of playing devil’s advocate, let me agree for argument’s sake with a number of the authors’ claims, hyperbolic and partisan though they sound at places, and then (again for argument’s sake), push back on the assumptions the authors make about the implications of those claims.

Foundational Competencies: Innovation In Legal Education, David E. Van Zandt

Faculty Working Papers

Spurred by a rapidly changing legal environment and a desire to differentiate and maximize the success of our graduates, Northwestern Law recently completed a major strategic planning initiative resulting in a revolutionary report entitled Plan 2008: Preparing Great Leaders for the Changing World. Plan 2008 is the most recent installment of a long-term process to enhance our student quality and programs. The new initiatives build upon a strategic plan that we have been refining since its implementation in 1998. Under the prior plan, we introduced the evaluative admissions interview and work-experience policy for applicants.1 We also added a number of …

Making The Leap To Management: Tips For The Aspiring And New Manager, Femi Cadmus Jan 2009

Making The Leap To Management: Tips For The Aspiring And New Manager, Femi Cadmus

Faculty Scholarship

As the result of innate ability, a fortunate few are able to effortlessly transition from line positions. However, most of us need to plot the path to management astutely and with deliberation. Library professionals might also become "accidental" managers, finding themselves thrust into an unplanned and perhaps unwanted managerial position for which they were not prepared. This is particularly true in the current climate of constrained budgets characterized by restructuring, job freezes, and layoffs.

Commentary, Session 1: Deciding To Become A Dean, Linda L. Ammons

Linda L. Ammons

Deciding to become a dean is a difficult decision. How do you know when you are ready and how do you need to prepare? Mentorship, leadership skills, risk-taking, vision, and energy are just some of the attributes needed by deans in today’s law school environment.

Military Values In Law, Diane H. Mazur May 2007

Military Values In Law, Diane H. Mazur

Duke Journal of Gender Law & Policy

Congress, for example, takes inappropriate advantage of the tremendous deference given by courts to its constitutional powers to raise and support Armies, to provide and maintain a Navy, and to make Rules for the Government and Regulation of the land and naval Forces.\n In a court-martial involving a military defendant and a civilian victim of sexual assault, application of the psychotherapist-patient privilege raises no difficult issues related to professional military values. When both the victim and the defendant are members of the military, however, the victim's assertion of privilege is at least potentially inconsistent with the victim's professional obligation to …

Reflections On Leadership, Robert H. Jerry Ii

Faculty Publications

When I first sought to become more familiar with the available academic literature on leadership a few years ago, I encountered servant-leadership theory and the writings of Robert Greenleaf. In those materials I found a much more developed articulation of this philosophy, and it is the essence of that philosophy of leadership that I embrace. Stated succinctly, leadership has its roots in service, and effective leadership is based on service to others. Effective leadership comes from the desire to put the well-being of others first-whether they are students, faculty, employees, customers, or community-and to give priority to the interests of …

Community-Owned Forests: Possibilities, Experiences, and Lessons Learned (June 16-19)

Community-owned forests may be the answer for some U.S. communities now confronting unanticipated and unwanted large scale land use changes – changes that could irrevocably change their local landscapes and quality of life. Across the country, millions of acres of private forest lands are being put up for sale as the forest products companies who own them find other, cheaper sources of supply. If, as is likely, purchasers divide and convert the forests to residential or other development uses, nearby communities face losing the critical economic, environmental, recreational, social, cultural, and aesthetic values and benefits those forests have traditionally provided. …

Thinking About Presidents, John C. Yoo, Robert Delahunty Dec 2004

Thinking About Presidents, John C. Yoo, Robert Delahunty

John C Yoo

Why are some Presidents great and others not? Does their attitude toward the Constitution have anything to do with it? What do legal scholars have to contribute to presidential studies? This paper reviews and uses data from the book "Presidential Leadership" to suggest possible relationships between presidential success and their approach to constitutional interpretation. It argues that the formalist versus functionalist debate over the separation of powers has reached a stalemate, and that constitutional law can gain by study of political science approaches to the Presidency. It also suggests that presidential studies, which views reliance on a president's constitutional powers …

"Facilitative Adr's Global Popularity And Promise", Nancy D. Erbe

ExpressO

This article presents the results of research evaluating the effectiveness of cross cultural leadership to dispute resolution process in the Balkans, Cameroon, Nepal and Ukraine. Unexpectedly, universal themes emerge that passionately advocate facilitative and inclusive multicultural dispute resolution. At the very least, they call for closer scrutiny and consideration of facilitative dispute resolution's global potential.

Leaders, Followers, And Free Riders: The Community Lawyer's Dilemma When Representing Non-Democratic Client Organizations, Michael Diamond, Aaron O'Toole

Fordham Urban Law Journal

This article explores various aspects of the dissonance between the democratic ideal and the reality of groups in disenfranchised and disempowered communities. The authors discuss the intersection of democracy and community action by examining the sociology of groups and the social psychology of leaders and followers. They also examine the role of, and choices presented to, an attorney working in a community and for a local community group.

Deans And Stories, William Michael Treanor Jan 2004

Deans And Stories, William Michael Treanor

Georgetown Law Faculty Publications and Other Works

Professor Howard Gardner's superb book Leading Minds is a study of leadership that, while prominent in the discipline of education, has received relatively little attention in the legal literature. Leading Minds thoughtfully argues that effective story-telling is critical to effective leadership. In this essay, the author explores in a very preliminary way the relationship between Gardner's thesis and what deans do or should do in order to lead their law schools and, more broadly, the different constituencies they represent.

In his group of 11 leaders, Gardner includes an academic leader--Robert Maynard Hutchins, who was dean of Yale Law School and …

When "Reason" Is In The Eye Of The Beholder: A Reexamination Of The "Reasonable Man" Standard As Applied To Organizational Management, James R. Jones

Marketing and Management Faculty Proceedings & Presentations

“Specifically, issues of race, gender, disability, status, etc. provide a new context in which to judge the reasonableness of an individual’s actions.” The concept of the "reasonable man" is one of long standing in the legal profession of the United States. As the United States has become an increasingly polyglot society, the need to reexamine the sufficiency of a single "reasonable man" standard is clear. Specifically, issues of race, gender, disability status, etc. provide a new context in which to judge the reasonableness of an individual's actions.

Race And Political Empowerment: The Crisis Of Black Leadership, William E. Nelson Jr.

William Monroe Trotter Institute Publications

W.E.B. Du Bois demonstrated poignant insight into the character of American society when he predicted in 1901 that the fundamental problem of the 20th Century would be the problem of the color line. Du Bois was writing in the aftermath of the first reconstruction that saw the institutionalization of Jim Crow and white dominance across the South. This period was symbolized by the infamous Plessy v. Ferguson decision in 1896. It was also marked by the capitulation of white Republican custodians of Reconstruction to the racist demands of southern politics, including the massive ejection of Black politicians from public office, …

Henry Moore Bates, Roscoe Pound Jun 1949

Henry Moore Bates, Roscoe Pound

Michigan Law Review

It has been my uniform practice never to read from a manuscript or use notes when I am speaking to an audience, but in speaking of so old and dear a friend I feel a certain inhibition of emotion that stands in the way of an adequate oral speech. Moreover, when I think of Dean Bates' unswerving adherence to exact, accurate statement, his abhorrence of all exaggeration, of all overstatement, I feel that he would not be satisfied with one who followed the relatively loose method of oral statement instead of adhering to a carefully and meticulously prepared manuscript for …
