Recognition is the act whereby the executive of a nation formally acknowledges the existence of a new state or government and determines all of the legal consequences flowing from this act to the new state or government. The author of this note proposes that recognition should be founded upon international legal standards, rather than political considerations.

The purpose of this essay is to discuss analytically the overseas arms sales policies of the three major Western supplier nations--the United States, Britain, and France. It is appropriate to group them together because they all have similar goals and characteristics. All are Atlantic Area NATO nations. They are democratic and are based upon largely private economies. The three nations have general histories of cooperation and alliance dating back to before the beginning of this century.

It is a pleasure to welcome a well-written book on arms control, and one, moreover, that has grown out of the exigencies of an undergraduate course and is designed to meet the needs of students. Because INTERNATIONAL ARMS CONTROL: ISSUES AND AGREEMENTS was the work of several hands, its lucidity and consistency are the more admirable. Comprehensive in scope, it goes just far enough in setting arms control in its various contexts (political, military, cultural, and ethical) without straying out of bounds. In the fall of 1975 the United States, in a much publicized step at the United Nations, introduced an abortive resolution calling for world-wide amnesty for political prisoners. Admittedly, this draft resolution was withdrawn because of crippling amendments, and it may well be that this American initiative was launched more to deflect criticism to others than to help political prisoners. But it seems to be the case--at least from a Western perspective--that political prisoners are becoming a more salient subject in world affairs. The case of General 'Tomoyuki Yamashita, the subject of this thesis, established a precedent in international law, at least so far as the United States respected that law, Its successful prosecution prepared the way for the prosecution of numerous, subsequent war crimes cases, upon a standard of liability developed and approved by the United States in Yamashita, and without regard for the attenuated procedural protections granted in American civil courts. General Mac-Arthur played an important part in Yamashita’s trial, and this essay shall also discuss the extent of his interest and involvement in the case.

The irrational and utopian note of the revolution remained constant through its long and eventful history. I will try to show that the idea of modern revolution is not simply an attack on an established authority, but a phenomenon sui generis, i.e., an attack on order as such, based on an identifiable metaphysical position. The present article may be regarded as an attempt to contribute through an uncovering of the spiritual roots of the revolution, to an understanding upon which depends the survival of personal values in the social order, at a time when that order seems threatened from without …

This article asserts that Captain David Graham, writing in this issue of the Washington and Lee Law Review, savages amended Article 1 of draft Protocol I to the 1949 Geneva Conventions. Specifically, he attacks the Article on the following grounds: (1) it is politically motivated by third-worlders determined to remake international law according to their own preferences; (2) it is poorly drafted and therefore cannot be implemented effectively; and (3) it would legitimize wars of national liberation and lead to discriminatory treatment of combatants.
