The Legality Of Nuremberg, F. Regan Nerone
The Legality Of Nuremberg, F. Regan Nerone
Duquesne Law Review
Twenty years have now passed and still the controversy continues as to whether or not the trials at Nuremberg were in compliance with international law. Although the trials of the major war criminals are now left to the historian, they are still of great importance to the formulation of present international law and are therefore of great interest to the legal profession. Throughout the history of man war has plagued our society. At no time prior to the adoption of the Charter of the International Military Tribunal did the creation of war constitute a crime. The basic problem faced by …
Arrest, Prosecution And Police Power In The Federal Republic Of Germany, Cyril D. Robinson
Arrest, Prosecution And Police Power In The Federal Republic Of Germany, Cyril D. Robinson
Duquesne Law Review
During the past few years numerous articles have examined arrest and prosecution procedures in the United States. Two aspects, in particular, have been criticized-the injustice of the bail system to the lesser offender and the attempted resolution of important social problems by penal legislation. Somewhat similar criticism concerning the frequency of arrest and the length of detention has been leveled at German criminal procedure. In order to correct these deficiencies, substantial amendments were made to the German Code of Criminal Procedure in December, 1964, effective April 1, 1965.

The Act Of State Doctrine After Sabbatino, William J. Bogaard
The Act Of State Doctrine After Sabbatino, William J. Bogaard
Michigan Law Review
The United States Supreme Court recently decided, in Banco Nacional de Cuba v. Sabbatino, that American courts must enforce a recognized foreign government's expropriation decree even though the decree violates international law. The Court, contrary to the views of respected international lawyers, found this result dictated by the "act of state doctrine," which bars American courts from reviewing the validity of another nation's official acts. The decision, amid frequent revolutionary confiscations and national programs of expropriation, seriously draws into question the wisdom of further investments in developing countries. This is unfortunate because American foreign investments benefit the receiving country …
Toward Supremacy Of Treaty-Constitution By Judicial Fiat: On The Margin Of The Case, Eric Stein
Toward Supremacy Of Treaty-Constitution By Judicial Fiat: On The Margin Of The Case, Eric Stein
Michigan Law Review
Increased interdependence of states in modem times has shaken the nineteenth century doctrines of extreme dualism and positivism. These doctrines would build an impenetrable wall between the international and national legal orders; they would elevate the state to the position of exclusive actor and deny the individual any standing in the international legal order; and, in the interpretation of a rule of law, they would exclude any regard for the political, economic, and social context in which the rule is applied.

Developments In Space Law, Albert Gore
Developments In Space Law, Albert Gore
Vanderbilt Law Review
A democratic society could not long endure without the voluntary support of its citizens of application of legal proceedings for settlement of disputes. Perhaps few take the time to consider the extent to which our daily lives are affected by the judicial machinery which a free people have established. Here I refer not merely to the deterrent effect of criminal laws by which we deal with offenses against society. I refer also to our system for the legal settlement of controversies arising between individuals. After all, without our courts and our lawyers, questions involving tort and breach of contract would …
International Law-Treaties-Inheritance Rights Of Residents Of Yugoslavia, Charles F. Niemeth
International Law-Treaties-Inheritance Rights Of Residents Of Yugoslavia, Charles F. Niemeth
Michigan Law Review
All the heirs at law of a Pennsylvania resident who died intestate resided in Yugoslavia. The Orphans' Court found that the distributees would not have the actual benefit, use, enjoyment or control of their intestate shares. In accordance with a state statute providing for such contingency,1 the funds were ordered paid, without escheat, into the state treasury. On appeal, held, affirmed, one judge dissenting. Because the statute is custodial rather than confiscatory, it is not repugnant to the most-favored-nation clause of the treaty between the United States and Yugoslavia which provides for reciprocal rights of inheritance between citizens of …

Maritime Contiguous Zones, Lloyd C. Fell
Maritime Contiguous Zones, Lloyd C. Fell
Michigan Law Review
During the past two centuries, various states which had previously limited their claims of full sovereignty to narrow marginal seas have also asserted special types of jurisdiction over high seas zones outside what they claimed (or what others accepted) as territorial waters. This comment deals with such claims to contiguous zones of the high seas over which the littoral state asserts authority: which may affect the interests of other states.

International Law And The Third World, A. A. Fatouros
International Law And The Third World, A. A. Fatouros
Articles by Maurer Faculty
After a detailed examination of the unique position of the emerging nations, the "third 'world," Professor Fatouros urges that the Western nations should ndertake a change in approach and a reassessment of the objectives of international law since the present situation of international society is so dissimilar to that in which the law evolved. He concludes that special, new rules should be formulated, based on a broad and positive consideration of the urgent need of the emerging nations to develop their natural resources as effectively and as rapidly as possible-a need 'which international law must take into account if it …
