Financial Peacekeeping From Imf And Ibrd Income, Samuel A. Bletcher Jun 1967

Financial Peacekeeping From Imf And Ibrd Income, Samuel A. Bletcher

Washington Law Review

Professor Bleicher asserts that the present method of financing United Nations peacekeeping operations through annual contributions by Members is unsatisfactory. Not only can it cause a financial crisis when certain Members refuse to pay, but also it may impair the United Nations peacekeeping function. After exploring several alternatives for providing stable income for peacekeeping operations, Professor Bleicher concludes that portions of the substantial net income of the International Monetary Fund and the Bank for Reconstruction and Development should be transferred to a United Nations peacekeeping fund. He then analyzes the various methods of achieving the transfers and suggests that the …

The Sabbatino Case And The Sabbatino Amendment: Comedy--Or Tragedy--Of Errors, William H. Reeves Mar 1967

The Sabbatino Case And The Sabbatino Amendment: Comedy--Or Tragedy--Of Errors, William H. Reeves

Vanderbilt Law Review

The issues and decisions in the Sabbatino litigation and the significant concepts of the Sabbatino legislation are here reviewed and considered in five parts. Part I discusses the mistaken beliefs of the Congress as to the reasons for proposing and enacting the Sabbatino Amendment. Part II then examines the relations between Cuba and the United States, explaining how Cuba's insult made possible the judicial errors in the Sabbatino decisions, which were reversed by the Supreme Court, and also prompted the subsequent Sabbatino legislation. In Part III, proof will be given of congressional misinterpretations of foreign law and foreign court decisions …

A Divided Country In Foreign Courts-Recent Litigation Involving Germany's Legal Status And The Zeiss Stiftung, Herbert L. Bernstein Mar 1967

A Divided Country In Foreign Courts-Recent Litigation Involving Germany's Legal Status And The Zeiss Stiftung, Herbert L. Bernstein

Michigan Law Review

The partition of countries in the wake of the second World War accounts for two Asian battlefields: Korea and Viet Nam. In Europe, where a dividing line was drawn through Germany, military hostilities have been avoided thus far. Instead, the controversies originating from that line are fought out at the conference table, through public and private media of communication, and in the courthouses.

Legal Aspects Of The French Nuclear Tests, Anthony D'Amato

Faculty Working Papers

Even at the level of scholarly or diplomatic argumentation it is important to inquire into the competing interests and legal factors involved in the atmospheric tests. This is true not only because differing political expectations or even measures might depend on the consensus as to the legality or illegality of the French tests, but also because the precedential value of the tests will be of greater or less force depending upon whether there is agreement at the time of the tests that France was or was not acting within her international legal rights.

Warsaw Convention: Treaty Under Pressure, Jay Levine Jan 1967

Warsaw Convention: Treaty Under Pressure, Jay Levine

Cleveland State Law Review

The major United States and foreign airlines have agreed to absolute liability for provable damages up to $75,000 for injury or death of passengers on Warsaw Convention flights to, from, or stopping in, the United States. For the vast majority of Americans on international flights, the Agreement disposes of the Convention's liability limit of $8,300.3 And the Lisi opinion of the Second Circuit may make the Convention a dead letter for accidents occurring before the Agreement.

Human Rights And Non-Intervention In The Inter-American System, José A. Cabranes Jan 1967

Human Rights And Non-Intervention In The Inter-American System, José A. Cabranes

Michigan Law Review

The long silence of the inter-American system is remarkable when contrasted with the continuing efforts of the United Nations to elaborate an International Bill of Rights and the significant accomplishments of the Council of Europe in implementing on a regional basis the principal values enunciated in the Universal Declaration of Human Rights. The OAS' lack of interest, until quite recently, in undertaking a similar international program to protect human rights in the American republics is a function of several very special factors, the most important of which is the traditional Latin American repudiation of intervention, in whatever form and for …

The Canada-United States Controversy Over The Columbia River, Ralph W. Johnson Aug 1966

The Canada-United States Controversy Over The Columbia River, Ralph W. Johnson

Washington Law Review

In a comprehensive study of the recent dispute between Canada and the United States over the Columbia River, Professor Johnson traces its history through the birth of the Harmon doctrine in 1898, the signing of the Boundary Waters Treaty in 1909, and the first Canadian claim to downstream benefits in the early 1950's. Against this background, he analyzes the negotiations and events—particularly the Canadian proposals to divert the Columbia into the Fraser, and to develop the Peace River instead of the Columbia—that culminated in the Columbia River Treaty in 1961. Before Canadian ratification of the Treaty, however, additional problems presented …

The Common Market: A New Legal Order, Dennis Thompson Jun 1966

The Common Market: A New Legal Order, Dennis Thompson

Washington Law Review

This term, the "new legal order," was first used by the Court of Justice in the First Tariff Commission case; I use the expression in its widest possible sense. This new legal order which springs from the Treaty of Rome, and which brings the citizens of the Community within the protection of the Treaty, also applies to the relations between the member states. The constitutional position of the member countries has been radically altered by the terms of the Treaty, and their relationship is no longer one which exists between fully sovereign countries. They have all—and equally—subscribed to build the …
