Women's Rights And The Proposed Family Protection Act, Karen Flax

In this article, the author examines the potential ramifications of the Family Protection Act, a bill recently introduced in the Senate by Senators Jespen and Laxalt. The author criticizes the bill both as a mechanism for legislatively enforcing the traditional role of women in American society and as a threat to civil liberties in general.

The "no fault divorce" revolution continues apace. Since publication of Professor Fox's and my survey of non fault divorce legislation in the Journal of Family Law in the summer of 1973, seven more states have amended their divorce laws to provide in some way for non fault divorce. Today more than forty states are in the non fault column.

It took the Supreme Court 105 years to discover that the Fourteenth Amendment guarantees a personal right of privacy that invalidates state statutes forbidding abortion except to save the mother's life. As Mr. Justice Rehnquist pointed out, in a dissent that no member of the Court attempted to answer, at least thirty-six states had such anti-abortion statutes when the Fourteenth Amendment was adopted. None was attacked on the ground that they offended the newly adopted amendment. Marriage as we know it in America is undergoing rigorous re-examination and even hostile attack in the last third of the twentieth century in part because of the doubt expressed in some quarters that this venerable institution meets the psychological and sociological needs of the mass of men and women. Effective January 1, 1972, Michigan adopted a no-fault divorce law. Since that time, at least two firms in the Detroit area have gone into the business of providing assistance to people wishing to process their own divorces. These enterprises, which have been dubbed divorce firms or divorce kit firms, have come under heavy attack from the organized bar. The State Bar of Michigan has instituted court proceedings against one firm for the unauthorized practice of law, and a court on its own initiative has already issued an injunction against the other. The family is the basic unit in our society. When there is a breakdown in this unit, specifically in the marital relationship, the effect upon the husband, wife, and children can be devastating in terms of poverty, abuse, and cost to society. The frequent inability of the poor to obtain counseling and legal assistance in resolving family relationships perpetuates the social and psychological results of a poor marriage. From those who regard marriage as a perpetual and indissoluble bond instituted by God to those who consider it a terminable contract between a man and a woman, every shade of opinion can be found. A problem contiunally encountered in the enforcement of child support payments ordered in a proceeding in Bastardy arises when the mother of the child, in whose custody the child remains, refuses to allow the putative father reasonable periods of visitation. In numerous cases, visits with child are denied, even when the putative father regularly pays the weekly support and, in addition, expresses a genuine affection and concern toward the well-being of the child. Assuming that the putative father desires an association with his illegitimate child which the mother refuses, what remedies does or should the putative father have?
