The Comprehensive Environmental Response, Compensation, and Liability Act (1980), more commonly known as Superfund, delegates the responsibility for cleanup of more than 1,300 hazardous waste sites to the federal Environmental Protection Agency (EPA). This thesis is designed as a case study to investigate the Superfund program through the lens of the Allied Paper Landfill portion of the Kalamazoo River Superfund Site. Through interviews with key stakeholders an evaluation was completed based on the following research questions: 1) are the current goals of Superfund appropriate, 2) is the funding mechanism sufficient to fulfill the goals of Superfund, and 3) is the …

Beyond Baby Steps An Empirical Study Of The Impact Of Environmental Justice Executive Order 12898, Elizabeth Ann Glass Geltman, Gunwant Gill, Miriam Jovanovic

This study evaluated the impact of Executive Order (EO) 12898 to advance environmental justice. We conducted a review evaluating the frequency and effective use of EO 12898 since execution with particular focus following President Obama’s Plan EJ 2014. We found that both EO 12898 and Plan EJ 2104 had little, if any, impact on federal regulatory decision making. To the extent federal agencies discussed EO 12898, most did so in boilerplate rhetoric that satisfied compliance but was devoid of detailed thought or analysis. In the 21st year, with the exception of the Environmental Protection Agency, very little federal regulatory activity …

Drilling For Common Ground: How Public Opinion Tracks Experts In The Debate Over Federal Regulation Of Shale Oil & Gas Extraction, Elizabeth Ann Glass Geltman

Public interest in environmental and health impacts from shale oil and gas extraction (what the public calls “fracking”) is growing. Industry claims the public outcry against the new technology is not grounded in science. In February 2013, Resources for the Future (“RFF”) published a list of high priority “risk pathways” that experts from NGOs, academia, government, and industry all agreed were real concerns about fracking. This article used the risk matrix to evaluate whether public comments in dockets of federal agencies that proposed regulation concerning hydraulic fracturing tracked expert concern. Progressive religious leaders are playing an increasingly important role in the effort to combat climate change. Through a combination of unstructured in-depth interviews and primary source analysis, this thesis highlights nine U.S. religious leaders from various denominations of Christianity, Judaism and Islam who are actively involved in working on climate issues. Drawing on literature in social movement theory, I explore how clergy are uniquely influential in climate issues because of the organizational advantage and moral authority they hold through their positions as religious leaders, granting them the ability to highlight social justice implications of climate change with distinctive legitimacy. This paper presents a close analysis of the Mapuche Conflict and its implications from an Environmental Justice perspective. It serves to outline the plight of the Mapuche, a South American indigenous group, in their continued struggle to gain the rights to autonomic control over their ancestral territory from the Chilean government. By utilizing a holistic approach to research, this paper serves to provide a background on the conflict as well as to incorporate claims to justice. Ballot-Box Environmentalism Across The Golden State: How Geography Influences California Voters’ Demand For Environmental Public Goods, William Skyler Lewis

In California, voters frequently face ballot propositions dealing directly or indirectly with environmental protection. Records of these votes provide powerful evidence of the character of voters’ demand and willingness-to-pay for environmental public goods (e.g., air quality, watershed ecosystem services, parks and recreation), and have been used in past environmental econometrics research to produce aggregated income and price effect estimates. Using neighborhood-level voting records on seven environmental-related ballot propositions in California between 2002 and 2010, this econometric study investigates the nature of voters’ demand for environmental public goods, focusing on the effect of household income on pro-environment voting. While (urban) resilience has become an increasingly popular concept, especially in the areas of disaster risk reduction (DRR) and climate change adaptation (CCA), it is often still used as an abstract metaphor, with much debate centered on definitions, differences in approaches, and epistemological consider- ations. Empirical studies examining how community-based organizations (CBOs) “practice” resilience on the ground and what enables these CBOs to organize and mobilize around resilience are lacking. This thesis uses a case study of the Community Home Energy Retrofit Project (CHERP) and it analyzes the larger statewide effort in California to increase energy efficiency in existing residential buildings to reduce greenhouse gas emissions. CHERP’s primary strategy is to embed itself into a community, educate residents on the multiple benefits of energy efficiency, and inspire them to take energy-saving actions in their own homes. It then builds its own community by connecting like-minded individuals together and provides an opportunity for them to exercise their political agency. A considerable number of quantitative analyses have been conducted in the past several decades that demonstrate the existence of racial and socioeconomic disparities in the distribution of a wide variety of environmental hazards. The vast majority of these have been cross-sectional, snapshot studies employing data on hazardous facilities and population characteristics at only one point in time. Although some limited hypotheses can be tested with cross-sectional data, fully understanding how present-day disparities come about requires longitudinal analyses that examine the demographic characteristics of sites at the time of facility siting and track demographic changes after siting. This thesis evaluates the equity performance of a recent state environmental justice policy, California’s Senate Bill 535 (S.B. 535). “Environmental justice” refers to the disproportionate environmental harm imposed on low-income and minority communities. S.B. 535 uses competitive grants to provide funding to these communities. The research is centered around two questions: (1) to what extent has S.B. 535 experienced successful implementation in its first year of operation, and (2) how can policy actors improve implementation while balancing performance and equity goals? The reliance upon and depletion of fossil fuels as an energy source puts pressure on individuals, communities, energy companies, and policy-makers. Hydraulic fracturing – known colloquially as fracking – as a method of drilling for oil and natural gas temporarily alleviates this pressure since it allows for the extraction previously inaccessible fossil fuels in shale rock deposits deep beneath the Earth’s surface. There are a large number of chemical facilities that emit toxic chemicals in Michigan, and there is a concern regarding toxic chemical exposure to the residents of Michigan counties. However, it is uncertain whether chemical companies that emit toxic chemicals in Michigan are influenced by county demographic factors in deciding whether to engage in voluntary pollution prevention (P2) activities and whether this decision influences U.S. Environmental Protection Agency's (U.S. EPA) Risk-Screening Environmental Indicators (RSEI) scores. Studies in the US have found that both exposure to environmental toxins and children's general health status negatively impact children's academic achievement. This Thesis will be made of up two papers. The first examines the impact of exposure to residential air toxins from a variety of sources on student's academic achievement and the second paper incorporates a measure of children's general health status into the statistical model from the first paper. This qualitative research is a transcendental phenomenology seeking to understand Latin@ high school students’ perceptions and standpoints as they participated lessons that addressed border environmental justice issues in an underrepresented, marginalized community. Seven students from Borderland High School, enrolled in a senior level course, Environmental Science, participated in the study which focused on their experiences in an environmental justice air quality thematic unit built around the complex issues surrounding a local refinery, American Smelting and Refining Company (ASARCO).
