Rogue Prosecutor Panic, Michael L. Smith
Rogue Prosecutor Panic, Michael L. Smith
The Scholar: St. Mary's Law Review on Race and Social Justice
Discussions of criminal law, enforcement, and reform are frequently messy and misleading. Anecdotes distract from systematic abuse, and perceptions of crime frequently win out over existing trends. This essay identifies Zack Smith and Charles Stimson’s book, Rogue Prosecutors: How Radical Soros Lawyers are Destroying America’s Communities, as an example of this shoddy discourse. Smith and Stimson’s claim that “Radical Soros Lawyers” are being mobilized to destructive ends crumbles under minimal scrutiny, and I identify several core defects throughout their narrative, including a failure to demonstrate a truly unified scheme of ideology and funding amongst the prosecutors they identify, baseless assumptions …
Tinkering With The Machinery Of Death: Execution Through Nitrogen Hypoxia, Emiliano Villarreal
Tinkering With The Machinery Of Death: Execution Through Nitrogen Hypoxia, Emiliano Villarreal
The Scholar: St. Mary's Law Review on Race and Social Justice
The modern era of the death penalty in the United States began in 1976 when the Supreme Court reinstituted the death penalty just four years after having found it to be unconstitutional. Since then, various states, as well as the federal government, have experimented with different methods of execution to find the most “humane” way of carrying out an execution. In 2018, Alabama legalized the use of nitrogen hypoxia as a method of execution, and in 2024, became the first state to execute a person with this new, previously untested method. However, the use of nitrogen hypoxia has been the …

Indigent Defense: How The Attorney Shortage Crisis Raises The Continued Need For Public Defense In Rural Areas Of The Lone Star State, Cody Jess Huffman
The Scholar: St. Mary's Law Review on Race and Social Justice
Abstract: The Sixth Amendment provides numerous rights, one of the most important being the right to counsel. The right to an attorney is crucial because it attaches at adversarial hearings such as interrogations, arraignments, and other serious matters as an individual weaves throughout the obstacles of the criminal justice system. An important distinction in that right to counsel as the admonishments are delivered is that not only does an individual have the right to counsel, often meaning one can be retained, but if an individual cannot afford to hire a private attorney, one will be appointed to them. As times …

The Case For Racial Literacy, Joni Schwartz
The Case For Racial Literacy, Joni Schwartz
Publications and Research
Racial literacy is widespread in America, and as adult literacy educators our mission is to address illiteracy in all its manifestations. We teach literacies in reading and writing, numeracy, computer, speaking, listening, visual, health, and media, each vital to making sense of our world and functioning effectively in it. Racial literacy is just as vital and should be taught as well. I argue that racial literacy is critical to a meaningful civic and community life. Some scholars believe it is critical to the perseverance of democracy. At the very least, many adult learners do not possess an understanding of what …

Decolonizing Community Re-Entry: Effective Case Studies Of Community-Led Programs And Services To Support Formerly Incarcerated Individuals In Canada, Ardavan Eizadirad, Rai Reece
Education Faculty Publications
Decolonizing re-entry programs require rethinking traditional approaches in supporting formerly incarcerated individuals and challenging colonial and deficit frameworks embedded in the criminal legal system, which often has an exclusive focus on punishment. This article names the risk factors and systemic barriers faced by equity-denied individuals during reintegration with a focus on the Canadian context. Two community-led programs in Ontario are highlighted as innovative case studies for effectively supporting reintegration of individuals exiting carceral institutions. Key characteristics of these programs which are offered by the Youth Association for Academics, Athletics, and Character Education (YAAACE) and Walls to Bridges (W2B) are outlined. …

Finding Black Girl Joy: The Lived Experiences Of Rural Black Girls, Tisha Scott-Addison
College of Education
This qualitative study examines the lived experiences of rural Black girls to gain a deeper understanding of how structural inequities manifest in their daily school lives. Grounded in intersectionality theory, the research examined how the convergence of race, gender, age, and geography influences the treatment and perceptions of Black girls within rural school settings. The central research questions guiding the study were: How do rural Black girls describe their experiences with school discipline, adultification, and a sense of belonging, and how do these experiences shape their educational journeys? Twenty Black female students in rural schools participated in semi-structured interviews. Data …

Restorative Justice: How Can It Be Effectively Implemented In Schools To Resolve Conflicts And Improve Student Behavior And School Culture?, Aaron Melander
School of Education and Leadership Student Capstone Projects
Schools have addressed student misbehavior and conflict resolution in many ways. Historically, many interventions have been punitive and have done little to help students develop healthy conflict resolution skills. Restorative justice is an approach that seeks to empower students to participate constructively in the conflict-resolution process. This capstone project is a professional development series that addresses the research question: Restorative Justice: How Can It Be Effectively Implemented in Schools to Resolve Conflicts and Improve Student Behavior and School Culture? Research concludes that restorative justice can benefit students, teachers, and school communities by actively teaching skills such as reflection, empathy, self-awareness, …

Concurrent Acl And Medial/Lateral Meniscal Repair In A Collegiate Soccer Player: Disablement Model Case Study, Rebecca L. Perry, Angelica Alicea, Jeanette Welch, Carl White, Emily E. Hildebrand, Peter Lisman
Clinical Practice in Athletic Training
This case examines a 19-year-old female Division I collegiate soccer player who underwent anterior cruciate ligament (ACL) reconstruction with medial and lateral meniscal repairs. Though meniscal tears often occur in conjunction with ACL injury, incidence of concurrent medial and lateral tears with presence of a displaced bucket-handle lesion is rare. This patient attempted to tackle an oncoming opponent in which contact caused forceful trunk rotation away from her planted right foot. Sideline evaluation revealed medial and posterior knee pain with active knee range of motion deficits. Further evaluation revealed apprehension and muscle guarding during Lachman’s, anterior drawer, and valgus stress …

Caregiver Perspectives About Implementing Educational Goals For Children Of Incarcerated Parents In A Head Start Program, Alissa Jane Stark
Walden Dissertations and Doctoral Studies
The problem addressed in this study is that caregivers of children with incarcerated parents inconsistently implement the mandated educational goals developed through the Head Start program. Grounded in Bowen’s family systems theory, the purpose of this qualitative case study was to explore caregiver’s perspectives on implementing Head Start Educational goals for children of incarcerated parents and their views on the resources or training needed to support these goals. For this case study, 12 former caregivers from a Head Start program in a women’s correctional facility in Oregon were interviewed. Data were collected through semistructured interviews and analyzed thematically with the …

Bard College: An Ecosystem Of Engagement, Jonathan Becker
Journal of Community Engagement and Higher Education
Despite its moderate size and rural location, Bard’s civic engagement efforts resonate locally, nationally, and internationally, and have significant public policy impacts. Bard has achieved success by making engagement central to its institutional mission, viewing liberal arts and sci-ences education as both a means and an end of civic engagement efforts, and forging an “ecosystem of engagement” that encourages organizational engineers, links student-led and in-stitutional initiatives, and unites a network of partners across the globe.

The Pedagogical Experiences Of Online Correctional Education English Composition Faculty, Candace Chambers
The Pedagogical Experiences Of Online Correctional Education English Composition Faculty, Candace Chambers
Journal of Prison Education Research
With increasing efforts to expand correctional education college programs, previous research has primarily explored the experiences of instructors teaching in face-to-face settings. However, little is known about the experiences of faculty teaching in online correctional education programs within the United States. This qualitative, transcendental phenomenological study addresses this gap by examining the experiences of five online English composition correctional education instructors. Data collection methods included semi-structured interviews, document analysis, and a focus group. Findings revealed that instructors adapted their teaching practices to accommodate the online format, faced challenges in building relationships with students, and desired more professional development. These insights …

Preschool Teachers’ Perspectives Regarding Children’S Aggressive Behavior And In-School Suspension, Martha Baker
Preschool Teachers’ Perspectives Regarding Children’S Aggressive Behavior And In-School Suspension, Martha Baker
Walden Dissertations and Doctoral Studies
Aggressive behavior can lead preschool students to be suspended in and out of school. The problem in this study was the high rate of in-school suspension (ISS) among preschool students in response to child aggressive behavior. Informed by Harvey’s domain model of social reasoning and social information processing, the purpose of this basic qualitative study was to explore perspectives of preschool teachers working in childcare centers in one city in Texas regarding children’s aggressive behavior that may lead to ISS as a response to that behavior. Four research questions probed how preschool teachers describe the level of choice exercised by …

Counselors With A History Of Sexual Abuse Who Work With Sexually Violent Offenders, Chandra L. Goodwin
Counselors With A History Of Sexual Abuse Who Work With Sexually Violent Offenders, Chandra L. Goodwin
Walden Dissertations and Doctoral Studies
Research on counselors who treat sexually violent offenders has emphasized professional challenges, ethical dilemmas, and vicarious trauma, while less attention has been given to clinicians with personal histories of sexual abuse who may face added strain yet also bring unique empathy and resilience to their work. Addressing this gap is critical for the counseling profession, as it informs how training, supervision, and wellness practices can be structured to better support clinicians with lived trauma histories. This qualitative study explored the lived experiences of counselors with personal histories of sexual abuse who work with sexually violent offenders. Grounded in interpretative phenomenological …
Your Turn Texas: A Failed Bill For Conviction Integrity Units And Funding, Jasmine Silva
Your Turn Texas: A Failed Bill For Conviction Integrity Units And Funding, Jasmine Silva
The Scholar: St. Mary's Law Review on Race and Social Justice
This comment reviews the history and consequences of wrongful convictions, explores the proposed Conviction Integrity Act of 2021, and scrutinizes Texas's role in exonerations. The root of wrongful convictions depends on various factors. However, the slow overturn of wrongful convictions largely depends on the lack of funding conviction integrity units and innocence organizations receive. The devastating truth is that there are many known wrongfully incarcerated persons sitting in prison because of the amount of funds necessary to reinvestigate a possible exoneration. This comment walks through the Conviction Integrity Act of 2021, a bill proposed by Senator Klobuchar and Senator Cornyn, …
