การใช้ภาพเล่าเรื่องซึ่งเป็นการสะท้อนเสียงของพลเมืองในการแก้ไขปัญหาความขัดแย้งที่ดินในอุทยานแห่งชาติทับลาน, จุฬารัต ผดุงชีวิต, อาแว มะแส

วัตถุประสงค์หลักของบทความวิจัยมุ่งอภิปรายการใช้ภาพเล่าเรื่องเพื่อเป็นเสียงสะท้อนผ่านการสื่อสารที่สามารถมองเห็นในชุมชนท้องถิ่นโดยคนในชุมชนเป็นผู้เล่าและสะท้อนเสียงส่วนลึกที่สุดในการแก้ไขปัญหาที่ดินในอุทยานแห่งชาติทับลาน อนึ่ง ผู้เข้าร่วมในการศึกษามีจำนวน 6  คน จาก18 คนในงานวิจัยเพื่อร่วมในการวิจัยภาพถ่ายเล่าเรื่อง ได้แก่ ชาวบ้าน เอ็นจีโอ และพระนักพัฒนาในตำบลไทยสามัคคี ซึ่งประโยชน์จากการใช้ภาพถ่ายเล่าเรื่องจะช่วยบันทึกเรื่องราว สะท้อนแง่มุม และแลกเปลี่ยนเรียนรู้ ถือเป็นประจักษ์พยานในการศึกษาปัญหาที่ดิน อีกทั้งช่วยพัฒนาความสามารถของพลเมืองในการถกแถลงสาธารณะโดยใช้ภาพถ่าย ดังนั้นการศึกษานี้นำมาสู่การจุดประกายให้เห็นถึงบทบาทของการใช้ภาพเล่าเรื่องว่าเป็นวิธีการในการเข้าถึงแก่นแท้ในความรู้สึกเชิงศีลธรรมของประชาธิปไตยแบบปรึกษาหารือผ่านมุมมองของประชาชนในการพัฒนาชุมชนร่วมกันและเข้าถึงผู้กำหนดนโยบาย ทั้งนี้การนำผลงานวิจัยไปใช้เน้นเพื่อการพัฒนานโยบายสาธารณะและการเติมเต็มการศึกษาประชาธิปไตยแบบปรึกษาหารือในการจัดการปัญหาความขัดแย้งเรื่องที่ดิน

บทความเรื่องนี้ศึกษาปัญหาอาชญากรรมลูกผสมที่เป็นปัญหาสำคัญในสังคมไทย โดยวิเคราะห์ปัญหาจากการสังเคราะห์เอกสาร พบว่าปัญหาอาชญากรรมในสังคมไทยในศตวรรษที่ 21 ถูกปรับเปลี่ยนจากการเป็นรูปแบบเดี่ยวมาเป็น “อาชญากรรมลูกผสม” ซึ่งเป็นการผสมผสานกันระหว่างอาชญากรรมรูปแบบต่าง ๆ ทั้งอาชญากรรมรูปแบบเดิม อาชญากรรมรูปแบบใหม่ อาชญากรรมรูปแบบอื่น ๆ และที่อาจจะเกิดขึ้นในอนาคต ทำให้เป็นอาชญากรรมแบบเบ็ดเสร็จ มีความซับซ้อน เชื่อมโยงสาเหตุจากปัจจัยการเปลี่ยนแปลงสังคมโดยเทคโนโลยี ปัจจัยด้านสภาพแวดล้อมทางสังคมในระดับมหภาค ปัจจัยด้านสภาพแวดล้อมทางสังคมในระดับจุลภาค ปัจจัยด้านกายภาพ/ชีวภาพ และปัจจัยด้านจิตวิทยา ที่ประสานสอดคล้องกับวิธีการก่ออาชญากรรม ทำให้ไม่สามารถเข้าใจรูปแบบที่แท้จริงของอาชญากรรมที่เกิดขึ้นได้โดยง่าย นอกจากนี้แล้วอาชญากรรมลูกผสมจะแตกต่างกันขึ้นอยู่กับอาชญากรผู้วางแผนเพื่อให้บรรลุเป้าหมายของการก่ออาชญากรรมนั้น โดยมีลักษณะสำคัญ ได้แก่ ผู้กระทำผิดหรืออาชญากรมีการรวมตัวกันเป็นเครือข่าย/องค์กรมากขึ้น กระทำการข้ามรัฐ/ไร้พรมแดน พึ่งพาเทคโนโลยี และใช้วิธีการที่หลากหลายซึ่งส่งผลกระทบในวงกว้าง ไม่จำกัดช่วงเวลาและสถานที่ สร้างการเลียนแบบ เข้าถึงเป้าหมายได้ง่าย ไม่จำเป็นต้องเผชิญหน้ากับเป้าหมาย คุ้มค่ามากที่สุดในการก่อเหตุต่อครั้ง เกี่ยวข้องกับการใช้ชีวิตประจำวัน ติดตามตัวผู้กระทำผิดมาลงโทษได้ยาก ทำให้ต้องใช้บุคลากรและงบประมาณจำนวนมากในการปราบปราม ป้องกันและแก้ไข

ความก้าวหน้าของเทคโนโลยีดิจิทัลได้ส่งผลกระทบอย่างรวดเร็วและรุนแรงต่อระบบเศรษฐกิจและสังคมในปัจจุบัน ภาครัฐจึงจำเป็นต้องปรับตัวเพื่อให้มั่นใจว่าการเปลี่ยนผ่านในทางเศรษฐกิจและสังคม และการจัดสรรผลประโยชน์จากเทคโนโลยีได้รับการจัดการอย่างมีประสิทธิภาพ ที่ผ่านมา แม้ประเทศไทยจะมีการกำหนดยุทธศาสตร์การพัฒนาเทคโนโลยีดิจิทัล แต่การเปลี่ยนผ่านสู่สังคมดิจิทัลที่เท่าเทียมกันยังคงเป็นความท้าทาย งานวิจัยนี้ใช้แนวทางเชิงคุณภาพ ศึกษาการดำเนินงานด้านเทคโนโลยีดิจิทัลของภาครัฐในปัจจุบัน ผ่านระบบการให้บริการในรูปแบบอิเล็กทรอนิกส์ ประกอบด้วยระบบการออกใบกำกับภาษีอิเล็กทรอนิกส์และระบบให้บริการรับคำร้องขอหนังสือเอกสารอิเล็กทรอนิกส์ของกรมสรรพากร ระบบการจดทะเบียนนิติบุคคลทางอิเล็กทรอนิกส์ กรมพัฒนาธุรกิจการค้า ระบบพิธีการศุลกากรอิเล็กทรอนิกส์ กรมศุลกากร และระบบการชำระค่าธรรมเนียมทางอิเล็กทรอนิกส์ สำนักงานประกันสังคม รวมทั้งศึกษาองค์ประกอบความสำเร็จการใช้งานระบบดังกล่าว ผลการศึกษาพบว่าองค์ประกอบความสำเร็จของการปรับใช้ภาครัฐดิจิทัลอยู่ที่การลดความเหลื่อมล้ำด้านดิจิทัล การส่งเสริมทักษะด้านดิจิทัล และการออกแบบสถาปัตยกรรมของภาครัฐเพื่อให้ตอบสนองความต้องการและความคาดหวังของประชาชนได้ดียิ่งขึ้น

บทความเรื่องนี้ได้นำเสนอความเข้าใจเกี่ยวกับความคิดทางการเมืองของ John Stuart Mill ว่าด้วยแนวทางการป้องกันทรราชของเสียงข้างมาก โดยใช้วิธีการศึกษาแบบปรัชญาการเมือง ผ่านการวิเคราะห์ตีความตัวบทอย่างละเอียด ผลการศึกษาพบว่าทรราชของเสียงข้างมาก ในทัศนะของ Mill คือ สภาวะที่คนฝ่ายเสียงข้างมากในสังคมกดขี่หรือละเมิดเสรีภาพของคนฝ่ายเสียงข้างน้อยในสังคม ซึ่งมีอยู่ด้วยกัน 2 ประเภท คือ (1) ทรราชของเสียงข้างมากโดยกฎหมาย (2) ทรราชของเสียงข้างมากโดยสังคม หรือทรราชของเสียงข้างมากโดยมติความคิดเห็นและอารมณ์ความรู้สึกที่แพร่หลายของคนส่วนใหญ่ในสังคม Mill หวาดกลัวทรราชของเสียงข้างมาก และถือว่ามันเป็นความชั่วร้ายประการหนึ่งในสังคมประชาธิปไตย ดังนั้นเพื่อป้องกันทรราชของเสียงข้างมาก Mill จึงเสนอว่าปัจเจกบุคคล สังคม และรัฐ ต้องมีหลักการสำคัญอันเป็นแนวคิดและแนวปฏิบัติร่วมกัน ซึ่งได้แก่ (1) หลักแห่งอรรถประโยชน์ (2) หลักแห่งเสรีภาพของปัจเจกบุคคล (3) หลักแห่งขันติธรรม (4) หลักแห่งความเป็นภัยอันตรายแก่ผู้อื่น (5) หลักแห่งการมีส่วนร่วม (6) หลักแห่งการปกครองแบบมีตัวแทน และ (7) หลักแห่งการกระจายอำนาจและการปกครองท้องถิ่น

การวิจัยนี้มีวัตถุประสงค์ เพื่อ 1) สำรวจภาวะห้องแห่งเสียงสะท้อนจากการสื่อสารทางการเมืองในพื้นที่ออนไลน์ของผู้ออกเสียงเลือกตั้งครั้งแรก ในช่วงของการเลือกตั้งทั่วไป พ.ศ.2562 2) ศึกษาความสัมพันธ์ระหว่างภาวะของห้องแห่งเสียงสะท้อนในพื้นที่ออนไลน์กับทัศนคติทางการเมือง 3) ศึกษาปัจจัยที่ส่งผลต่อภาวะห้องแห่งเสียงสะท้อน โดยใช้พหุวิธีวิจัย การศึกษาพบว่าองค์ประกอบหนึ่งของห้องแห่งเสียงสะท้อนในแง่ข้อมูลหรือชุดความคิดหลักหนึ่ง ๆ ได้รับการตอกย้ำและกระจายออกไปผ่านการทำซ้ำและการสนับสนุนในกลุ่มแบ่งขั้ว ส่วนลักษณะการกลั่นกรองและคัดสรรข้อมูลโดยระบบอัลกอริทึมพบในบางวิธีศึกษา ขณะเดียวกัน ภาวะห้องแห่งเสียงสะท้อนมีความสัมพันธ์กับทัศนคติทางการเมืองของบุคคล ซึ่งสร้างภูมิทัศน์ทางความคิดรายรอบแต่ละบุคคลเอาไว้ เมื่อผนวกกับประเด็นเรื่องปัจจัยทางเทคโนโลยีและการรวมกลุ่มสังคมจะทำให้เกิดการสร้าง “พื้นที่ทางความคิด” ขึ้นมา สำหรับปัจจัยที่ส่งผลต่อภาวะห้องแห่งเสียงสะท้อนในการวิจัยนี้ ได้แก่ 1) อัลกอริทึมสร้างภาวะฟองสบู่ตัวกรอง 2) แนวทางในการเปิดรับข้อมูลข่าวสารทางการเมืองของผู้ใช้ออนไลน์ 3) ทัศนคติทางการเมืองและบริบท/สถานการณ์แวดล้อมทางการเมือง และ 4) รูปแบบเครือข่ายทางการสื่อสารที่มีส่วนร่วมในพื้นที่ออนไลน์

การปฏิรูปโครงสร้างการอภิบาลน้ำของไทยเกิดขึ้นหลังจากเหตุการณ์น้ำท่วมใหญ่ พ.ศ. 2554 เพื่อลดความเสี่ยงอุทกภัยและสร้างความมั่นคงในภาคการผลิต มีผลต่อสมดุลอำนาจทั้งในการกำหนดนโยบายและการปฏิบัติตั้งแต่ในระดับชาติจนถึงท้องถิ่น บทความปริทัศน์ชิ้นนี้สะท้อนความก้าวหน้าและความท้าทายในการจัดการน้ำของประเทศไทยภายใต้กรอบแนวคิดการอภิบาลน้ำแบบมีส่วนร่วม ผลการศึกษาพบว่าการจัดการน้ำในปัจจุบันเริ่มให้ความสำคัญต่อวิถีชีวิตผ่านการใช้พื้นที่รับน้ำนองและโครงการจัดการน้ำชุมชนด้วยข้อมูลสารสนเทศ แต่มิได้ทำให้เกิด “จุดเปลี่ยนแห่งความร่วมมือ” อย่างแท้จริง เนื่องจากการเปลี่ยนศูนย์อำนาจการจัดการน้ำไปสู่ระบอบรัฐราชการอย่างเข้มข้น ทำให้ชาวชนบทที่รองรับน้ำท่วมให้ภาครัฐมีวิถีชีวิตอยู่บนความไม่แน่นอน และยังเปิดโอกาสให้ภาคการเมือง ภาคประชาสังคม ชุมชนท้องถิ่น และภาคส่วนอื่น ๆ ในการมีส่วนร่วมกำหนดนโยบายน้อยเกินไป จึงขาดการบูรณาการความรู้ที่หลากหลาย และการกำหนดสิทธิในการจัดการน้ำร่วมกันอย่างเสรี การต่อรองระบอบอภิบาลน้ำควรต้องดำเนินต่อไปให้สอดคล้องกับความต้องการที่แท้จริงของสังคม

การบริหารจัดการภัยพิบัติภายใต้ยุทธศาสตร์การเตรียมพร้อมแห่งชาติ (พ.ศ. 2560-2564) : กรณีศึกษาโรคติดเชื้อไวรัสโคโรนา 2019 (Covid-19) ในเขตอำเภอเมือง จังหวัดนครราชสีมา, วรัชยา เชื้อจันทึก

บทความวิจัยนี้มีวัตถุประสงค์ 1) เพื่อศึกษาระดับการบริหารจัดการภัยพิบัติภายใต้ยุทธศาสตร์การเตรียมพร้อมแห่งชาติ (พ.ศ. 2560-2564) และ 2) เพื่อเสนอแนวทางการพัฒนาการบริหารจัดการภัยพิบัติภายใต้ยุทธศาสตร์การเตรียมพร้อมแห่งชาติ (พ.ศ. 2560-2564) ใช้การวิจัยเชิงปริมาณ โดยใช้แบบสอบถาม (questionnaire) กับ 1) บุคลากรขององค์กรปกครองส่วนท้องถิ่น ประกอบด้วย นายกองค์กรปกครองส่วนท้องถิ่นหรือตัวแทน ปลัดองค์กรปกครองส่วนท้องถิ่น เจ้าพนักงานป้องกันและบรรเทาสาธารณภัย นักสาธารณสุขและสิ่งแวดล้อม จำนวน 104 คน 2) บุคลากรโรงพยาบาลส่งเสริมสุขภาพตำบล ประกอบด้วยผู้อำนวยการโรงพยาบาลส่งเสริมสุขภาพตำบล พยาบาลวิชาชีพชำนาญการ เจ้าพนักงานสาธารณสุขชำนาญงาน จำนวน 60 คน 3) ตัวแทนชุมชน จำนวน 140 คน รวมทั้งสิ้น 304 คน วิเคราะห์ข้อมูลด้วยสถิติเชิงพรรณนา ผลการวิจัยพบว่าระดับการบริหารจัดการภัยพิบัติภายใต้ยุทธศาสตร์การเตรียมพร้อมแห่งชาติ (พ.ศ. 2560-2564) ในภาพรวมอยู่ในระดับมาก (  = 4.06, S.D. = 0.52) เมื่อพิจารณาเป็นรายด้าน พบว่าด้านที่มีค่าเฉลี่ยสูงที่สุด คือ การพัฒนาศักยภาพระบบการเตรียมพร้อม (  = 4.15, S.D. = 0.54) รองลงมาคือ การเสริมสร้างความร่วมมือการเตรียมพร้อมรับมือ ( = 4.06, S.D. = 0.60) การบริหารจัดการแผนแบบบูรณาการ ( = 4.02, S.D. = 0.66) และการเสริมสร้างศักยภาพของทุกภาคส่วน ( = 3.89, S.D. = 0.43) ตามลำดับ 2) แนวทางการพัฒนาการบริหารจัดการภัยพิบัติภายใต้ยุทธศาสตร์การเตรียมพร้อมแห่งชาติ (พ.ศ. 2560-2564) ได้แก่ การเสริมสร้างศักยภาพของทุกภาคส่วน ประกอบด้วยการเสริมสร้างศักยภาพขององค์กรปกครองส่วนท้องถิ่น การเสริมสร้างศักยภาพของโรงพยาบาลส่งเสริมสุขภาพตำบล การเสริมสร้างศักยภาพของชุมชน การเสริมสร้างศักยภาพของอาสาสมัครสาธารณสุขประจำหมู่บ้าน (อสม.) และการเสริมสร้างศักยภาพของประชาชน

อินเดียกับการจัดการจลาจลในกรณีแคชเมียร์, สุรัตน์ โหราชัยกุล, สิริกร ธารีรัตนาวิบูลย์

นับตั้งแต่ได้รับเอกราชในปี ค.ศ. 1947 อินเดียก็เผชิญความท้าทายด้านความมั่นคงมาโดยตลอด ในบรรดาความท้าทายเหล่านั้น การก่อจลาจลในรูปแบบต่าง ๆ ที่เกี่ยวกับแคชเมียร์หรือในแคชเมียร์ ปัญจาบ ภูมิภาคตะวันออกเฉียงเหนือ และนักซาไลต์ เป็นภัยคุกคามที่บั่นทอนความมั่นคงแห่งชาติของอินเดียมากที่สุด บทความนี้มีวัตถุประสงค์เพียงข้อเดียวคือ เพื่อตอบคำถามวิจัยว่าอินเดียมีวิธีจัดการกับปัญหาจลาจลในแคชเมียร์อย่างไร ในขณะเดียวกันก็มีข้อโต้แย้งสำคัญสองประการ คือ (1) การก่อจลาจลในแคชเมียร์มีปัจจัยภายนอกมาเกี่ยวข้องอย่างสำคัญยิ่ง ทำให้รัฐบาลอินเดียแก้ปัญหาได้ยากลำบาก และ (2) การแก้ปัญหาแคชเมียร์ของอินเดียมีหลักคิดและวิธีตรงกับกรอบความมั่นคงแบบดั้งเดิมและกรอบความมั่นคงของมนุษย์ผสมผสานกัน ต่างจากโลกวิชาการที่มักจะมองกรอบทั้งสองแยกจากกันสิ้นเชิง บทความแบ่งออกเป็น 3 ส่วน ส่วนแรกบรรยายพัฒนาการประเด็นปัญหาการจลาจลในแคชเมียร์ ส่วนที่สองอธิบายการจัดการจลาจลแคชเมียร์ของอินเดีย และส่วนสุดท้ายสรุปเนื้อหาใจความของบทความพร้อมทิ้งท้ายด้วยข้อคิดบางประการ

เงื่อนไขไตรลักษณ์ของความรุนแรงที่กระทำโดยรัฐต่อมุสลิมชนกลุ่มน้อย : ศึกษาเทียบเคียงกรณีโรฮีนจาในรัฐยะไข่ของเมียนมากับกรณีมลายูมุสลิมในจังหวัดชายแดนใต้ของไทย, อันวาร์ กอมะ, เอกรินทร์ ต่วนศิริ

งานวิจัยชิ้นนี้ศึกษาความแตกต่างของความสัมพันธ์ระหว่างรัฐกับมุสลิมชนกลุ่มน้อยในประเทศเมียนมาและไทย โดยใช้กรณีของโรฮีนจาในรัฐยะไข่เทียบเคียงกับกรณีของมลายูมุสลิมในจังหวัดชายแดนใต้ แม้ว่าเมียนมาและไทยเป็นประเทศที่มีผู้นับถือศาสนาพุทธนิกายเถรวาทเป็นชนส่วนใหญ่ แต่ผลลัพธ์ของความสัมพันธ์ระหว่างรัฐและมุสลิมชนกลุ่มน้อยของทั้งสองประเทศก็มีความแตกต่างกันอย่างชัดเจน กล่าวคือ ในกรณีของโรฮีนจาปรากฏความรุนแรงสุดโต่ง ส่วนในกรณีของมลายูมุสลิมเกิดความรุนแรงต่ำที่กระทำโดยรัฐ นัยยะของการเทียบเคียงของทั้งสองกรณีคือการค้นหาปัจจัยที่ทำให้เกิดและไม่เกิดความรุนแรงที่กระทำโดยรัฐต่อชนกลุ่มน้อยมุสลิม ผลการศึกษาพบว่าปัจจัยสำคัญที่ทำให้ทั้งสองกรณีแตกต่างกันคือ ‘เงื่อนไขไตรลักษณ์’ ซึ่งประกอบด้วยมุมมองของรัฐต่อมุสลิมชนกลุ่มน้อย อิทธิพลของขบวนการพุทธชาตินิยม และความอ่อนแอของมุสลิมชนกลุ่มน้อย ฉะนั้น เมื่อรัฐมีมุมมองที่ปิดกั้นต่อชนกลุ่มน้อยประกอบกับขบวนการพุทธชาตินิยมมีอิทธิพลสูงและสถานะของมุสลิมชนกลุ่มน้อยมีความอ่อนแอแล้ว โอกาสที่จะเกิดการใช้ความรุนแรงสุดโต่งก็มีสูงตามไปด้วย ด้วยเหตุนี้ ผู้วิจัยเสนอว่าการปรากฏหรือไม่ปรากฏของเงื่อนไขไตรลักษณ์สามารถใช้เป็นเครื่องมือในการเฝ้าระวังการใช้ความรุนแรงสุดโต่งที่กระทำโดยรัฐต่อมลายูมุสลิมในประเทศไทย และต่อชนกลุ่มน้อยทางศาสนาและชาติพันธุ์ในเอเชียตะวันออกเฉียงใต้

วัฒนธรรมสร้างสรรค์ขององค์การสมองซีกขวาซึ่งเป็นองค์การที่มีศักยภาพในการทำหน้าที่ของสมองซีกขวาในการผลิตจินตนาการนั้น เป็นหัวใจสำคัญในการสร้างนวัตกรรมองค์การระดับโลก อาทิ มหาวิหาร ซากราดา ฟามิเลีย บทความนี้มีวัตถุประสงค์เพื่อศึกษาลักษณะการบริหารวัฒนธรรมองค์การ ของวัดร่องขุ่น จังหวัดเชียงราย ว่าได้อาศัยวัฒนธรรมสร้างสรรค์ขององค์การสมองซีกขวาหรือไม่ อย่างไร ในการสร้างนวัตกรรมองค์การ และศึกษามาตรการเพื่อส่งเสริมและประยุกต์ใช้กับองค์การภาครัฐ โดยอาศัยการบูรณาการข้ามศาสตร์ ด้วยวิธีวิจัยแบบผสม ทั้งเชิงปริมาณและคุณภาพ เครื่องมือในการวิจัย ได้แก่ แบบสอบถาม แบบสัมภาษณ์กึ่งโครงสร้าง และแบบสัมภาษณ์เชิงลึก กลุ่มตัวอย่าง ได้แก่ กลุ่มผู้ที่ปฎิบัติงานในวัดร่องขุ่น กลุ่มผู้เชี่ยวชาญสาขาต่าง ๆ และกลุ่มสาธารณชน ข้อค้นพบคือ (1) การบริหารวัฒนธรรมองค์การของวัดร่องขุ่น ได้อาศัยวัฒนธรรมสร้างสรรค์ขององค์การสมองซีกขวาทุกมิติ ข้อมูลจากแบบสอบถามแสดงว่ากลุ่มตัวอย่างมีการรับรู้วัฒนธรรมสร้างสรรค์ ลักษณะองค์การสมองซีกขวา และการสร้างนวัตกรรมของวัดร่องขุ่น อยู่ในระดับสูงที่สุด สอดคล้องกับผลการสัมภาษณ์และข้อเสนอทางทฤษฎี (2) มาตรการส่งเสริมและประยุกต์ใช้การบริหารด้วยแนวทางวัฒนธรรมสร้างสรรรค์ขององค์การสมองซีกขวา เพื่อสร้างนวัตกรรมขององค์การภาครัฐ ได้แก่ การส่งเสริมวัฒนธรรมเชิงรุกและวัฒนธรรมมืออาชีพ การขจัดวัฒนธรรมความกลัวและวัฒนธรรมการลอกเลียนแบบ

For decades, commentators have adopted a story of mass incarceration’s rise as caused by “punitive populism.” Growing prison populations, expanding criminal codes, and raced and classed disparities in enforcement result from “pathological politics”: voters and politicians act in a vicious feedback loop, driving more criminal law and punishment. The criminal system’s problems are political. But how should society solve these political problems? Mexico represents a dichotomy of images: first, as a land of sun, surf, and a place of destiny for vacationers, and second, as providing a haven for violent drug cartels operating with virtual impunity from the power of the state that appears unable to provide a fundamental duty - public safety. In the current environment of cartel violence, festive similes of mariachis called narcocorridos are muffling traditional Mexican poems by singing ballads praising drug cartel leaders. Bail reform is an urgent topic in the United States and internationally, but what constitutes reform and how to accomplish reform goals is contested. Jails are a modern epicenter of incarceration, with a stunning growth in American jail populations over the past four decades despite declines in both arrests and crime. As many as sixty percent of the half million people currently in jails have not been convicted but are instead detained pretrial. Prior waves of bail reform produced a system largely reliant on secured bonds, which require up-front cash payments to avoid jail time before trial. More recent reform …

Policing in Canada and America has come under the microscope due to several high-profile incidents of police violence against racialized citizens. The murder of George Floyd by officer Derek Chauvin thrust the concept of ‘defund the police’ to the mainstream public dialogue. To date, there are few studies that explore what defund the police means. The present media analysis addresses this research gap by analyzing how Canadian mass media covered the defund police movement. More surrogacy contracts are fulfilled in the United States than in any other country (Bromfield, 2016, p. 193). In 2014, there were approximately 2,000 surrogacy arrangements in the U.S., yet the market is totally unregulated (Shellnutt and Grizzle, 2018, p. 31). Given that 1 in 6 American couples face infertility, there will continue to be a demand for alternative and assisted reproductive options (Shellnutt and Grizzle, 2018, p. 34). Prison sexual violence has been a prominent issue since the establishment of correctional facilities. However, the issue was dismissed due to the stigmatization of the inmate population. As a result, there were no documented policies, statutes, or laws that prohibited prison rape or imposed sanctions upon offenders. The attention towards inmates rights, specifically regarding sexual assault, began to be addressed in the media in the 1990s. One goal of this research was to determine potential themes that may influence the understanding of Digital and Multimedia Evidence (DME) by attorneys and Digital Forensic Examiners (DFE) within the United States Criminal Justice System. Qualitative semi-structured interviews were conducted to gather information from experienced criminal attorneys and DFEs regarding potential influences on their understanding of DME. The results of these interviews were transcribed, and the data coded to allow for qualitative analysis. Five themes were developed from this data and are thought to play a role in understanding of DME by attorneys and DFEs: motivation for involvement in the …

“Open courts” are a bedrock principal of our judicial system, and court secrecy, including concealment of pretrial proceedings, poses a serious threat to public safety. Overbroad protective orders have concealed facts uncovered during litigation regarding some of the most important public harms, keeping them secret when the public needs protection. Protective orders routinely include provisions that allow parties to designate discovery material as “confidential” without further judicial review. Implicit bias is something that everyone has but many cannot identify within themselves. Judge Draper draws on caselaw, research, and anecdotes from her own career to demonstrate the ways that implicit bias can impede equitable and just court experiences for all. She argues for the importance of more diverse juries, implicit bias instruction early in the proceedings, and the use of Batson as remedies to counteract bias.

This presentation sheds light on a part of officer involved shootings not always discussed at a legal symposium: the potential bias that emerges at a crime scene during an investigation. The speaker explores the evidentiary challenges associated with an officer involved shooting, and describes the reconstruction project that he led as a consultant during the investigation and trial of off-duty police officer Amber Guyger, who was convicted of the murder of Botham Jean.

Observational studies suggest relationships between obesity, urate, and gout but are possibly confounded. We assessed whether genetically determined obesity, higher urate (and related traits), and gout were causal using multiple Mendelian randomization (MR) approaches and linkage disequilibrium score regression for genetic correlations (rg). For data, we used genome-wide association study summary statistics available through MR-Base. We observed that obesity increased urate (beta = 0.127; 95% CI = 0.098, 0.157; P-value = 1.2E−17; rg = 0.25 [P-value = 0.001]) and triglycerides (beta = 0.082; 95% CI = 0.065, 0.099; P-value = 1.2E−21; rg = 0.23 [P-value = 8.8E−12]) and decreased high-density …

Mass incarceration or overincarceration has gained significant attention over the last two decades, and criminal justice reform seeks to address it. This study uses constructivist grounded theory to examine the implementation of criminal justice reform legislation in Mississippi. Mississippi was chosen as the study setting because the state has been recognized as a national leader in enacting reform legislation and it has one of the nation’s highest incarceration rates. It is well established that policy implementation affects outcomes. The purpose of this dissertation was to discern the prevalence and magnitude of both exposure to traumatic events and Secondary Traumatic Stress (STS); as well as potential correlates of STS in a group of Probation and Parole officers in the state of Kentucky Department of Corrections (KY DOC).
