Alternative Business Structures: Good For The Public, Good For The Lawyers, Jayne R. Reardon Oct 2017

Alternative Business Structures: Good For The Public, Good For The Lawyers, Jayne R. Reardon

St. Mary's Journal on Legal Malpractice & Ethics

There has been a shift in consumer behavior over the last several decades. To keep up with the transforming consumer, many professions have changed the way they do business. Yet lawyers continue to deliver services the way they have since the founding of our country. Bar associations and legal ethicists have long debated the idea of allowing lawyers to practice in “alternative business structures,” where lawyers and nonlawyers can co-own and co-manage a business to deliver legal services. This Article argues these types of businesses inhibit lawyers’ ability to provide better legal services to the public and that the legal …

Why We Should Have Seen That Coming: Comments On Microsoft’S Tay “Experiment,” And Wider Implications, K. W. Miller, Marty J. Wolf, Frances S. Grodzinsky Oct 2017

Why We Should Have Seen That Coming: Comments On Microsoft’S Tay “Experiment,” And Wider Implications, K. W. Miller, Marty J. Wolf, Frances S. Grodzinsky

School of Computer Science & Engineering Faculty Publications

In this paper we examine the case of Tay, the Microsoft AI chatbot that was launched in March, 2016. After less than 24 hours, Microsoft shut down the experiment because the chatbot was generating tweets that were judged to be inappropriate since they included racist, sexist, and anti-Semitic language. We contend that the case of Tay illustrates a problem with the very nature of learning software (LS is a term that describes any software that changes its program in response to its interactions) that interacts directly with the public, and the developer’s role and responsibility associated with it. We make …

Smart Contracts: Terminology, Technical Limitations And Real World Complexity, Eliza Mik Oct 2017

Smart Contracts: Terminology, Technical Limitations And Real World Complexity, Eliza Mik

Research Collection Yong Pung How School Of Law

If one is to believe the popular press and many “technical writings,” blockchains create not only a perfect transactional environment but also obviate the need for banks, lawyers and courts. The latter will soon be replaced by smart contracts: unbiased and infallible computer programs that form, perform and enforce agreements. Predictions of future revolutions must, however, be distinguished from the harsh reality of the commercial marketplace and the technical limitations of blockchains. The fact that a technological solution is innovative and elegant need not imply that it is commercially useful or legally viable. Apart from attempting a terminological “clean-up” surrounding …

Emerging Dynamics Of Management: Book Launch Ceremony Remarks, Ishrat Hussain Dr.

Faculty Research - Talks, Speeches, & Discourse

Several years ago, there was book called, What they Don't Teach you at Harvard Business School. The tile of Mr. Sirajuddin's book could simply be: What they don't teach you in Business School and Management Schools. Period. There are some lessons that you learn from a very personal and professional experience, which is accumulated overtime. It is reflected, digested, accumulated and then it is shared. The beauty of this book is that you will find these anecdotes to be a subset of the generalized obser vations about of management. I will not go into strateaies, structures, processes of human resource …

Research from International Data Corporation (IDC) shows that when it comes to online data, unstructured content accounts for 90% of all digital information. Under these circumstances, this study provides a literature review and analysis on the role and relation of qualitative methods with …

The Role Of Cultural Traditions On Branding And Word-Of-Mouth: Keeping Mother’S Recipes Alive!, Sindy Chapa Sep 2017

The Role Of Cultural Traditions On Branding And Word-Of-Mouth: Keeping Mother’S Recipes Alive!, Sindy Chapa

Journal of Applied Marketing Theory

The purpose of this study was to explore the impact a cultural tradition has on a perceived-brand-relationship (PBR) and word-of-mouth (WOM) behavior in person and on social media. Based on the cognitive-motivational-related theory of emotions and the social identity theory, a model is proposed to explain the impact that a family tradition, such as cooking with selective products, has on Hispanic mothers. Using a research mixed-method approach, a construct was developed to measure attitudes toward cultural traditions. Further, an online survey was administered for hypotheses and model testing using SEM and Logistic Regression tests. The findings supported the proposed model …

Research Collection School Of Accountancy

Data that is collected in the business environment can be structured or unstructured. In general, structured data refers to information which is highly organised and which can easily be stored in rows and columns within database systems. On the other hand, unstructured data does not have a strict data structure, and is also not organised in a pre-defined manner.

Chinese Dream And Middle Way Limits, Boyan Ivantchev Sep 2017

Chinese Dream And Middle Way Limits, Boyan Ivantchev

Journal of Global Business Insights

Until 1978 China had a class struggling model of development. After years of bad experience, it was only natural to leave that model and to focus on the economical development of the country The Ruling party of China decided to take The Middle Way of economical development, combining the leading role of the communist party and capitalistic market economy. Chinese people were used to The Middle Way because of ancient history, local psychology and the prevailing mixture of Daoist and Confucian philosophy. The philosophical and psychological tendency of Chinese people to tend to find a Middle Way and reasoning, is …

An Improved Fuzzy Time Series Theory With Applications In The Shanghai Containerized Freight Index, Ming-Tao Chou

Journal of Marine Science and Technology–Taiwan

This study presents fuzzy time series based on the concept of long-term predictive significance level. Fuzzy time series theory and structural analysis are used to develop a long-term predictive significance level for evaluating the suitability of historical data. New triangular fuzzy numbers by S are subsequently obtained using the graded mean integration representation method. Finally, △S can strengthen fuzzy time series data for a series and yield additional information. The Shanghai Containerized Freight Index is used to illustrate the forecasting process. The results indicate that the proposed definition can generate forecast levels that provide more information for analysis.

Three Essays On Likability Factors, Crowdfunding, And Entrepreneurial Performance, Yuanqing Li Aug 2017

Three Essays On Likability Factors, Crowdfunding, And Entrepreneurial Performance, Yuanqing Li

Theses and Dissertations

In this dissertation, I conduct three empirical studies exploring the relation between likability factors, crowdfunding characteristics and entrepreneurial performance. Together these studies integrate aspects of major entrepreneurial likability factors including liking of the entrepreneur (source attractiveness, credibility, personal traits) and liking of the message (verbal content and expression), and components of nonverbal and verbal cues. I apply computer-mediated communication (CMC) and persuasion theories, political and marketing literature to provide a more fine-grained understanding of likability on crowdfunding success. In the first essay, I study how the non-verbal cues of a crowdfunding video influence the crowdfunding success. By employing social presence …

How To Enhance Interdisciplinary Competence—Interdisciplinary Problem-Based Learning Versus Interdisciplinary Project-Based Learning, Mirjam Brassler, Jan Dettmers Jul 2017

How To Enhance Interdisciplinary Competence—Interdisciplinary Problem-Based Learning Versus Interdisciplinary Project-Based Learning, Mirjam Brassler, Jan Dettmers

Interdisciplinary Journal of Problem-Based Learning

Interdisciplinary competence is important in academia for both employability and sustainable development. However, to date, there are no specific interdisciplinary education models and, naturally, no empirical studies to assess them. Since problem-based learning (PBL) and project-based learning (PjBL) are learning approaches that emphasize students’ collaboration, both pedagogies seem suitable to enhance students’ interdisciplinary competence. Based on the principle of constructive alignment and four instructional principles on interdisciplinary learning, this paper proposes that students profit more from interdisciplinary PBL (iPBL) than interdisciplinary PjBL (iPjBL). A pre-post study was conducted with a sample of 95 students participating in iPBL and 183 students …

Conducting A Communal Questionnaire In Community-Oriented Cultures, Forrest Watson Jul 2017

Conducting A Communal Questionnaire In Community-Oriented Cultures, Forrest Watson

Markets, Globalization & Development Review

In order to enrich our scholarly knowledge we need to consider how our methodologies fit the particularities of every social context. A recent experience conducting a questionnaire in rural Turkey revealed a “community orientation” (Turan 1975) among respondents that caused me to question the individual as the center of analytic attention. Based on my findings, I propose the communal questionnaire, an innovative hybrid of the structured survey, qualitative interview, and focus group, which accounts for the non-standard nature of respondents’ social situations. I conclude with methodological suggestions for conducting research in community-oriented cultures.

The Power Of The Covenant Idea For Leadership, Reform, And Ethical Behavior, Kahlib J. Fischer Jul 2017

The Power Of The Covenant Idea For Leadership, Reform, And Ethical Behavior, Kahlib J. Fischer

The Journal of Values-Based Leadership

The study of leadership is awash with numerous concepts, many of which overlap. To the student and the scholar, finding a starting point and integrative theme for leadership ideas which extend from interpersonal to organizational contexts can be dizzying. This paper proposes the idea of covenant as a unifying metaphor for these valuable and often overlapping leadership ideas. The covenantal approach has had a tremendous impact on the history of Western legal and perhaps, more importantly, social and cultural thought and therefore might offer us a realistic and practical approach to effective leadership. In particular, we will see that a …

Detecting User Demographics In Twitter To Inform Health Trends In Social Media, Christopher R. Markson Jul 2017

Detecting User Demographics In Twitter To Inform Health Trends In Social Media, Christopher R. Markson

Dissertations

The widespread and popular use of social media and social networking applications offer a promising opportunity for gaining knowledge and insights regarding population health conditions thanks to the diversity and abundance of online user-generated information (UGHI) relating to healthcare and well-being. However, users on social media and social networking sites often do not supply their complete demographic information, which greatly undermines the value of the aforementioned information for health 2.0 research, e.g., for discerning disparities across population groups in certain health conditions. To recover the missing user demographic information, existing methods observe a limited scope of user behaviors, such as …

A Multimodal Discourse Analysis Exploration Of A Crowdfunding Entrepreneurial Pitch., Victoria Doyle, Olivia Freeman, Brendan K. O`Rourke Jul 2017

A Multimodal Discourse Analysis Exploration Of A Crowdfunding Entrepreneurial Pitch., Victoria Doyle, Olivia Freeman, Brendan K. O`Rourke

Conference papers

This paper explores multimodal discourse analysis (Kress and Van Leeuwen, 2001) as a methodology to address the research question: How are environmentally conscious entrepreneurial ventures constituted in online investment crowd-funding pitches and the communications that surround them? While discourse may be realised in many different ways (Kress and Van Leeuwen, 2001 p.5, Bezemer and Jewit, 2010), multimodal discourse analysis focuses on analysing and describing a repertoire of meaning making resources which individuals use in various contexts (visual, gestural, written, actional etc.). Broadband internet and associated technologies mean that these crowdfunding pitches and many other genres tend to be much richer …

A Further Empirical Investigation Into The Semantic Meaning Of Advertising Price References, Jeffrey Gutenberg, James M. Quinn Jun 2017

A Further Empirical Investigation Into The Semantic Meaning Of Advertising Price References, Jeffrey Gutenberg, James M. Quinn

Atlantic Marketing Journal

Abstract – This study extends a well-known investigation of the meaning to consumers of commonly used comparative advertising pricing claims (e.g. “compare at”) by employing a broader demographic representation of respondents than the student sample which was used in the original research. Large and statistically significant differences were found between the two groups of respondents yet the main implications for practitioners remain the same.

Pilgrimage Upside-Down: Kabir Ulatbansi Pilgrim, Vinod Verma Jun 2017

Pilgrimage Upside-Down: Kabir Ulatbansi Pilgrim, Vinod Verma

International Journal of Religious Tourism and Pilgrimage

Cultures in India, like cultures in other parts of the world, continue to surprise by their topsy-turvey existence in time, space and practices. The Nijamuddin Dargah in Delhi is one such example of composite cultures. To illustrate it further the Bhakti movements, a wave of the Nirgun/Sagun saint traditions in Indian medieval histories of literary cultures, is an appropriate example which represents a strong case of pilgrimages, alternative pilgrimages and pilgrims without pilgrimages. The poetry of the Alvars, Kabir, Malik Muhammad Jayasi, Tulsidas, Nanak, Raidas, Surdas, Mirabai, Dadu Dayal, Malukdas, Kamal, Sunderdas, Raskhan, Dhruvdas, Namdev, Lal Ded, Avvayyar and Akkamahadevi …

A Study Of The Impact Of Health Information Quality On Care Delivery Quality And Satisfaction From The Care Provider’S Perspective, Rashid Manzar May 2017

A Study Of The Impact Of Health Information Quality On Care Delivery Quality And Satisfaction From The Care Provider’S Perspective, Rashid Manzar

Information Systems & Operations Management Dissertations - Archive

The US healthcare system is rapidly adopting health information technologies (IT) in its quest to improve patient safety and deliver high quality care at a lower cost. As healthcare providers increasingly rely on health IT in caring for their patients, there is a corresponding increase in the impact of health IT on the outcome of care delivery. Unfortunately, there is a dearth of empirical studies on how health IT quality influences healthcare outcome. Using a comprehensive framework based on Work Systems Theory, a research model was developed to study the impact of health information quality on care delivery outcome and …

Breaking Down Silos: Teaching For Equity, Diversity, And Inclusion Across Disciplines, Erica E. Hartwell, Kirsten Cole, Sarah K. Donovan, Ruth L. Greene, Stephanie L. Burrell Storms, Theodora Williams

Humboldt Journal of Social Relations

The purpose of this paper is to present specific teaching strategies, classroom activities, and service learning assignments that can be adapted across disciplines to meet equity, diversity, and inclusion (EDI) focused learning objectives. In order to identify promising practices for teaching EDI, this collaboratively authored paper follows the thread of our common strategies, activities, and approaches through our different disciplines and across the different contexts in which we teach. As we wrote together about our common commitment to EDI, the specifics of our disciplines fell into the background as we focused on four core objectives for teaching EDI: awareness, knowledge, …

Detecting Deception In Asynchronous Text, Fletcher Glancy May 2017

Detecting Deception In Asynchronous Text, Fletcher Glancy

Annual ADFSL Conference on Digital Forensics, Security and Law

Glancy and Yadav (2010) developed a computational fraud detection model (CFDM) that successfully detected financial reporting fraud in the text of the management’s discussion and analysis (MDA) portion of annual filings with the United States Securities and Exchange Commission (SEC). This work extends the use of the CFDM to additional genres, demonstrates the generalizability of the CFDM and the use of text mining for quantitatively detecting deception in asynchronous text. It also demonstrates that writers committing fraud use words differently from truth tellers.

The Fifth Epoch: Socio-Economic Approach To Sustainable Capitalism, David M. Boje, Yue Cai Hillon May 2017

The Fifth Epoch: Socio-Economic Approach To Sustainable Capitalism, David M. Boje, Yue Cai Hillon

Markets, Globalization & Development Review

The purpose of this conceptual essay is to challenge the inevitability of living with the destructive beast of speculative market economics in the 4th epoch of global capitalism. We are facing an existential socio-ecological threat from the short-term excesses of financial capitalism, a socially irresponsible form that consumes without producing value and without bearing entrepreneurial risk, benefitting only the few. The fate of roughly 90% of humanity hangs in the balance. The primary contribution of this paper proposes a 5th epoch of capitalism, inspired by Savall and Zardet’s socio-economic and sustainable approach that restores human potential and value …

Dispositions Of First Year Teachers Who Teach Mathematics For Social Justice, Kyndall A. Brown May 2017

Dispositions Of First Year Teachers Who Teach Mathematics For Social Justice, Kyndall A. Brown

Journal of Multicultural Affairs

For over 10 years, mathematics educators have sought to use mathematics tasks with social justice contexts to engage students. While student teachers in the UCLA Teacher Education Program (TEP) engage in social justice tasks in their secondary mathematics method classes, very few teachers use these types of tasks with students in the classrooms. The master’s inquiry projects of three TEP students who engaged their students in social justice tasks are analyzed to determine how their backgrounds and positionality influenced their instructional decision making. Results show that personal experiences in the teachers’ lives, as well as a desire to increase motivation …
