Redistributing Power In Mississippi: The Reversal Of Section 4 Of The Voting Rights Act, Gloria J. Billingsley, Sylvester Murray

Recently, the U.S. Supreme Court declared Section 4 of the Voting Rights Act of 1965 unconstitutional, essentially defanging preclearance requirements of Section 5 and leaving racial and other previously disenfranchised minorities unprotected. Using social contract theory as the theoretical framework, empirical field study research was used to examine whether the Voting Rights Act has achieved the results in Mississippi that the Supreme Court’s decision to revoke Section 4 has assumed. Data were collected on race-specific voter registration and voting data, measures of vote discrimination, litigations and Mississippi legislative activity regarding voting rights. Soft power has attracted significant attention in scholarly and public debates on foreign affairs in recent years. Notwithstanding this greater attention, the treatment of soft power has developed little beyond “soft theory. ” This article addresses this deficiency by offering a more rigorous and systematic analysis of the process of soft power. In addition, it seeks to address two further shortcomings in the treatment of soft power: by explaining how changes in modern world politics have raised the value of soft power, and by proposing conditions that encourage decisionmakers to appreciate and effectively employ soft power strategies.

Scholars have long understood that the instability of power has ramifications for compliance with international law. Scholars have not, however, focused on how states’ expectations about shifting power affect the initial design of international agreements. In this paper, I integrate shifting power into an analysis of the initial design of both the formal and substantive aspects of agreements. I argue that a state expecting to become more powerful over time incurs an opportunity cost by agreeing to formal provisions that raise the cost of exiting an agreement.
