This 2006 Nebraska Law Review articles analyzies the 2005 Nebraska Supreme Court decision of Spear T Ranch v. Knaub in which the court adopts section 858 of the the Restatement of Torts (2d) as the judicial rule for resolving conflicts between competing users of surface water and hydrologically-connected ground water.
