The subject of non-delegable duty has troubled courts for some time. The recent UKSC decision in Woodland v STA has clarified the law somewhat. In the recent decision MCST No. 3322 v Tiong Aik, the Singapore Court of Appeal endorsed the UK position and made clarifications on the Singapore position. This article examines the Singapore position as expressed by the SGCA.

Currently the system provides an institutionalized multi-disciplinary approach to protecting children. The current integrated system of handling child abuse is comprehensive and thorough and seeks to serve the bests interests of the child. However given socio-economic and legal ramifications of child abuse, this paper proposes the following enhancements in the management of child protection. Fist reporting of child abuse should be made mandatory similar to the American Model. Failure to do so, should constitute an offence under the Children and Young Persons Act and …

In recent times, courts in Singapore and elsewhere have been grappling with the issue of delegability of duty of care. In the process, they have vigorously defended the conventional position that a duty of care is, in general, delegable. Accordingly, attempts at broadening the ambit of vicarious liability and non-delegable duty, respectively, have been carefully scrutinized. The recent Singapore Court of Appeal decision of Ng Huat Seng v Munib Mohammad Madni adds to the judicial thinking on this complicated and controversial subject.

Kiasu And Creativity In Singapore: An Empirical Test Of The Situated Dynamics Framework, Chi-Ying Cheng, Ying-Yi Hong

This article investigates how Singaporeans' creativity is influenced by Kiasu, an indigenous construct corresponding to fear of losing out. We examine the impact of Kiasu on creativity, both as a personal value and a shared cultural norm in four studies. Study 1 showed that Singaporeans' Kiasu value endorsement predicts lower individual creativity. Study 2 demonstrated that this negative relationship is mediated by a self-regulatory focus on prevention. Study 3 further showed the impact of Kiasu as a personal value and a cultural norm by finding a significant three-way interaction effect of Kiasu prime, personal Kiasu value endorsement, and need for …

Offences Against Foreign Domestic Workers In Singapore: Vindicating The Victim’S Right To Dignity, Benjamin Joshua Ong

The High Court of Singapore recently increased the sentences of two employers who had starved their foreign domestic worker, causing serious physical injury. In so doing, the court affirmed the victim’s right to human dignity despite the relative leniency of the charge. This case prompts reflection not only on the vulnerability of foreign domestic workers and the courts’ role in protecting their basic dignity, but also on the prosecutors’ role in framing charges that accurately and completely reflect the infringement of rights.

In a series of inconsistent decisions by the Singapore courts on contract formation in continuing negotiations cases, Lord Denning’s broad approach—which does away with the traditional offer and acceptance analysis—appears to have been simultaneously adopted and rejected. This article suggests that the continued uncertainty in Singapore regarding the scope of application of the traditional approach and Lord Denning’s approach arises from a conflation of both as being substantially similar. This article further argues that both approaches are conceptually and practically distinct. The authors undertook the Public Cleanliness Satisfaction Survey. The survey was completed in March 2017 and was made possible through funds from the Ministry of the Environment and Water Resources. The survey was carried out by the research company, Blackbox Research. The survey sample is representative of the demographics of the Singapore population. In particular, we sought the views of 2000 Singapore citizens and Permanent Residents aged 21 years and above. A response rate of about 70% of eligible households was obtained. In general, we found that there was a high level of satisfaction on the cleanliness of public spaces …

Under this system, the head of state and head of government are distinct roles that are held by different people. The head of state of Singapore is the President, and in the United Kingdom it is the monarch who holds that responsibility. The head of government in both countries is the Prime Minister. Before 1991, the President was “elected” (essentially appointed) by Parliament. The role of the President was entirely ceremonial. Motivated by the centrality measures constructed in Larcker, So and Wang (2013), I affirm that board connectedness positively affect firm performance in Singapore, and even if we were to measure firm performance by Tobin's Q. The impact on firm performance persists over at least four years. Controlling for Corporate Governance using a proprietary database, the Singapore Corporate Governance Index, only the Eigenvector centrality under simple-weighted and hyperbolic-weighted projections survives the robustness test, suggesting that firstly, the local proxy of Corporate Governance based on OECD principles possibly controls for what is proxied by the Betweenness, Closeness and Degree centrality measures, and …

The world decided in December 2015 to take actions to reduce global warming. To contribute toward this goal, this research examines possible policy levers for inclusion in the climate change ratification plan. A case study of the measures taken by the Republic of Singapore, a low-lying 719.2 km2 island without natural resources in Asia, is conducted. Changing frequencies and intensities of extreme weather events directly affect settlement vulnerability; when combined with rapid urbanization, these factors also influence urban resilience to climate-related hazards. This article documents how urban resilience can generally be maximized, before examining how it is impacted by extreme hydro-climatic events (i.e. droughts and floods), with a specific case examination for Singapore. In particular, analysis of Singapore’s climate from 1950 to 2015 indicates (1) a warmer environment, and (2) recent periods of more intense surface dryness. Earlier this month, Singapore’s Hill Street Tai Wah Bak Chor Mee emerged first in the annual Top 50 World Street Food Masters list, making it the second time the hawker has been lauded internationally; it was one of two hawkers here to be awarded a Michelin Star earlier. Out of the top 50 in the World Street Food Masters list, 14 were Singapore hawkers. It says something about the high standards of our hawker fare in Singapore. Yet, Singaporeans are a spoilt lot when it comes to food, and the people we take most for granted are hawkers.

While migration health studies traditionally focused on socioeconomic determinants of health, an emerging body of literature is exploring migration status as a proximate cause of health outcomes. Study 1 is a path analysis of the predictors of mental health amongst 582 documented migrant workers in Singapore, and shows that threat of deportation is one of the most important proximate social determinants of predicted mental illness, and a mediator of the impact of workplace conflict on mental health. Study 2 is a qualitative study of the narratives of 149 migrant workers who were in workplace conflict with their employers, and demonstrates …

Toxic ‘haze’ from fires, often burning over dry peatland in Indonesia, has affected millions across Indonesia, Singapore and Malaysia, as well as parts of the Philippines and Thailand. For Singapore in particular, this slash-and-burn method of clearing land in Indonesia to cultivate crops such as oil palm has been an annual problem since 1972. However, 2015 stands out as the year Singapore experienced one of its worst episodes of haze pollution. Air quality based on the Pollutant Standards Index (PSI) plummeted to the ‘very unhealthy’ and ‘hazardous ranges’ for close to 50 days. Singapore suffered an estimated SGD $700 million …
