This paper aims at shedding some light on a very controversial topic in Competition Policy or Antitrust. The anticompetitive litigation – commonly called sham litigation – has been broadly discussed in the legal literature but there is no consensus on how antitrust authorities should handle those cases. This paper aims at exploring the peculiarities of the cigarettes market and its consequences in terms of the desired regulation and the impacts of undesired regulatory measures. The main idea behind the paper is the complementarity of regulatory policies independently implemented by different governmental bodies in the presence of a non- negligible black market, not compliant to any regulation. We build a model where companies choose between going legal or illegal – where the latter includes fake products produced locally as well as smuggled cigarettes, but could be easily extended to apply also to legal brands produced by firms not …

This article aims at exploring features commonly neglected by specialists in their analysis of the brand new Competition Law enacted in Brazil this December 2011. After a brief presentation of the history of Brazilian antitrust evolution, we will move on to explore those upsides and downsides of the new legal text. We start by quickly overviewing the most remarkable changes brought out by the new law – and thus thoroughly commented in the recent literature.


1. The Objective Of This Study Was To Trace A Worldwide Frame Of The Current State Of The Anticompetitive Use Of Judicial Actions In Defense Of Intellectual Property, Also Known As Sham Litigation. Sham Litigation Has Been Object Of Controversy, As It Opposes Connects The Exercise Of Allegedly Legitimate Rights To The Idea Of Abuse On Its Uses, Meaning (In Economic Terms) A Strategic Use With The Objective Of Harming Or Excluding A Rival From The Market. A Good And Pioneer Possible Tentative Definition For Sham Litigation In On A Strict Economic Perspective Is A Predatory Or Fraudulent Litigation With Anticompetitive Effect, I.E., The Improper Use Of The Courts And Other Government Adjudicative Or Granting Processes Against Rivals To Achieve Anticompetitive Ends. We Suggest That The Anticompetitive Use Of Judicial Actions To Unduly Protect Intellectual Property Might Be Considered One Type Of Non-Price Predation Strategies. This article critically examines aspects of the recent decision in the Act of Concentration that has approved with restrictions the purchase of Sadia by Perdigão, upholding the Brasil Foods creation – and its unfolding. During the decision-making process in CADE, was sometimes mentioned as being an applicable precedent decision of CADE who approved the Act of concentration on the buying of the Kolynos by Colgate, in 9/18/1996. The goal of this article is twofold: point technical fails in the decision-making process and on the merits of the case Sadia-Perdigão; and demystify any possible association between this and the case Colgate-Kolynos.

ABSTRACT The essay intends to analyze the competition policy in Brazil after twelve years of the Law n. 8.884/1994, which has effectively inaugurated it. Thus, it initiates with a historical approach, exposing the principal premises that guide this public policy exercise. Utilizing data from the Administrative Council for Economic Defense (Cade), such as condemnations per economic sector and decisions regarding merger and administrative proceedings, attempts to identify the principal obstacles to the effective competition exercise. O presente trabalho tem por objetivo tecer inferências a respeito da conduta competitiva dos produtores de cerveja no Brasil e investigar possíveis práticas predatórias no mercado, a partir de uma base de dados desagregados ao nível das marcas. Partindo-se do referencial teórico sobre predação e utilizando-se a abordagem da Nova Organização Industrial Empírica, buscou-se estimar um modelo estrutural de conduta, referenciado em um jogo de competição a la Bertrand com produto diferenciado, de forma a promover um melhor entendimento da competição nesse importante mercado.
