Substance Use Disorder (SUD) has plagued families of rural Appalachia for many years, perpetuating involvement in the criminal justice system as well as generational trauma for people diagnosed with SUD and their children. This points to the necessity of a trauma-informed, restorative-justice based framework for rehabilitative services to most effectively heal families, address trauma, and re-integrate people diagnosed with SUD into society. A restorative justice-based program would provide health care services for addiction and any comorbid mental health disorders as well as teach parents how to properly provide for themselves and their families, manage finances, obtain employment, and further education. …

ABSTRACTAcross the United States, Restorative Justice (RJ) practices are adopted with the intent to transform zero-tolerant and neoliberal school environments into cultures of care. RJ utilizes dialogue, reflection, and silence as tools to honor human relationships, build community, and respect diversity. Although it is known that school change is intricately connected to teacher change, there has been little attention given on how to best support teachers during RJ implementation. This study engaged seven teachers and one school psychologist in bi-weekly circles over a period of three months around the topic of creating a culture of care. The study inquired how …

This paper analyzes, assesses, and introduces the importance of a “Needs Assessment” that can potentially record the effectiveness of the Victim Offender Reconciliation Program (VORP) practices with its youth offenders. VORP is a program within the purview of the Restorative Justice Partners, INC. organization. The functions of this program works closely with the probation department of Monterey County, along with various community partners; its practices are funneled through a restorative justice lens. Current data will show that 89% of youth offenders who have successfully completed the VORP program and are closed compliant do not reoffend, meanwhile the other 11% recidivates …

This paper explains the connections between restorative justice and social justice. Specifically it argues that restorative practices in schools fit with a social justice agenda. It defines both terms and then outlines how restorative practices work to address the pipeline to prison and against retributive justice and zero tolerance policies. It also outlines the use of narrative questions designed to enhance restorative practices.

This report conceptualizes the effectiveness and benefits of utilizing the restorative justice model of Victim Offender Mediation (VOM) within the criminal and juvenile justice systems to serve the rights of victims, offenders, and society more justly. Victim Offender Mediation is discussed as a possible alternative justice model which reframes the victim-offender relationship to foster and respect the dignity and worth of each participant. This restorative justice model combats victims’ feelings of helplessness by giving them back their voice, while having the potential to specifically offer relief to those secondarily victimized by the legal system in cases of simple rape. The rise in the number of Black, male, incarcerated, rural youth and the retributive juvenile justice system is a prominent problem in the United States, creating a revolving door for youth in conflict with the law. Among the core competencies of macro practitioners are the skills to design, implement and evaluate conflict resolution processes. Drawing upon theories of deliberative democracy, restorative justice and the Just Practice framework, this paper explores a process of deliberation which engaged 200 community members in the controversial siting of a homeless shelter. This case study is both descriptive and reflective: by offering an in-depth description of the process and a reflection on the guiding values, this paper provides critical insight into best practices in – and limitations of – using deliberation to resolve divisive community issues.

The San Bernardino Restorative Youth Court was established by the San Bernardino City Unified School District school board and has operated for one school year (2015-16). The purpose of this article is to document what has happened in this year and to begin to address questions about the value of the youth court for those for whom it aims to make a difference. This systematic review explored the use of restorative practices in a school setting. It looks at what practices are used, how those practices are used and the effectiveness of those practices. Peacemaking circles, family group conferencing and victim-offender mediation are the three models of restorative practices that were reviewed. Twenty-three schools and school districts were reviewed. Five were school districts, four were primary schools and 14 were secondary schools. The most common outcomes with the use of restorative practices included: reduced suspension rates, reduced behavioral referrals out of the classroom, improved attendance, decreased expulsions, decreased student fights and a decrease …

The purpose of this study is to identify the barriers to and facilitators of mental health services utilization among youth in the justice setting, and to explore ways to overcome these barriers and expand these facilitators. This qualitative study utilized focus groups as a means to extract themes among the perceptions of social workers on this topic. Results were transcribed to written form. Qualitative analysis procedures were followed to identify and label themes. A total of 473 statements are organized into 26 major themes with 18 sub‑themes. Social workers and other human services professionals helping families reintegrate after parental incarceration deal with multiple issues without a model of for facilitating family resilience. The purpose of this phenomenological research study was to explore the essence of the perceived role, activities, and practices of a sample of social workers and other human service professionals engaged in the use of family group conferences (FGCs). Truth and Reconciliation Commissions (TRCs) are among the primary means for promoting reconciliation in communities recovering from violent conflict. However, there is a lack of consensus about what reconciliation means or how it is best achieved. In a qualitative study of the first TRC in the U.S., this research interviewed victims of racial violence who participated in the Greensboro Truth and Reconciliation Commission (GTRC), a community-based restorative justice intervention. Findings reveal that participants conceptualized reconciliation as a multileveled process, that different concepts of reconciliation influenced assessments of the success and limitations of the GTRC, and indicate how community-based restorative interventions …

The violence found in low-income communities, including areas of concentrated poverty, is often extensive and can involve illegal drugs, juvenile delinquency, and even homicide. A large body of research has emerged which points to the positive effects of informal social control and social capital in preventing violence in lowincome communities, including neighbors taking leadership roles by intervening themselves. As formal systems for the protection of children have evolved in this country, certain barriers to achieving justice within the child protection system have emerged concomitantly. Specifically, these barriers involve ambiguous definitions of abuse and the appearance of social inequality and bias within the child protection system. This article traces the history of the development of the treatment of domestic violence as a crime in the United States and the conceptual and practical limitations of this approach in addressing this important social issue. An extensive body of research on restorative justice practice suggests that restorative approaches may contribute to reducing and preventing family violence. Drawing on restorative justice principles, an alternative or supplement to criminal justice approaches is outlined for working with all parties involved in abusive relationships.

The purpose of this article is to examine the challenges inherent in trans- forming child welfare services. We apply Braithwaite's model of responsive regulation to the restorative practice of family group conferencing in child welfare. Shifting the role of the state away from controller of families in the child protective services system to one of regulatory partner with them is extraordinarily difficult. The paper looks at the complexities of reorienting child welfare services through the use of family group conferences on a large scale.

Restorative and responsive justice can be a strategy of social work practice that builds democracy bottom-up by seeing families as building blocks of democracy and fonts of democratic sentiment. At the same time, because families are sites of the worst kinds of tyranny and the worst kinds of neglect, a rule of law is needed that imposes public human rights obligations on families. The republican ideal is that this rule of law that constrains people in families should come from the people.
