Contemporary Issues in Juvenile Justice
In the last two decades, the juvenile justice system has focused on the early identification of youth mental health to provide timely assessment and needed treatment. However, there are potential risks in divulging youth mental health status because the information is often made available to juvenile courts and probation departments. Many state statutes allow such information to be used in the admission of guilt, adjudication, and dispositional phases. The study reviewed state and federal statutes related to protections against self-incrimination of youth at eight different stages of the juvenile justice system. Researchers identify possible structural causes for wrongful convictions: racism, justice system culture, adversary system, plea bargaining, media, juvenile and mentally impaired accused, and wars on drugs and crime. They indicate that unless the root causes of conviction error are identified, the routine explanations of error (e.g., eyewitness identifications; false confessions) will continue to re-occur. Identifying structural problems may help to prevent future wrongful convictions. The research involves the coding of archival data from the Innocence Project for seventeen cases, including the one for the Central Park Five exonerees. Research shows that disparities still exist in the juvenile justice decision-making process, but there is a gap in our understanding of neighborhood characteristics that may affect those detention decisions. Therefore, this research examines structural factors influenced by social disorganization theory to explore the impact they have on juvenile detention decisions. Neighborhood parks and recreation centers are examined as important local institutions that provide informal social control to the neighborhood. The Virginia Department of Juvenile Justice (DJJ) for the city of Norfolk compiled juvenile justice data, and 2016 Census data were also used to obtain neighborhood structural information. The juvenile system is no longer perceived as a social welfare model, but has become more punitive approximating a crime control model. Juveniles are not responsible for the majority of crime in the United States and are not the most serious and violent demographic; however, they are incarcerated at a higher rate than adults. Incarceration is an element of deterrence currently used by the juvenile justice system without a clear conclusion of whether or not it works to reduce juvenile crime.

The Impact Of Detention On Juvenile Recidivism In Montana: Is The Impact Of Detention Influenced By Other Factors?, Daniel N. Acton

The purpose of this study is to identify the effect detention has on recidivism risk as well as to identify the degree to which the effect of detention on recidivism is influenced by other variables. The data for this analysis were collected by probation officers across Montana, using the Back on Track risk assessment instrument (N=840). Although detention was the topic of interest, this analysis also tested aspects of three popular criminological theories: social bond theory, self-control theory, and life-course persistent theory. This exploratory research examined levels of innovation adoption among Juvenile Court Officers (JCOs) in a Midwestern state. The researcher applied Dr. Everett M. Rogers’ Diffusion of Innovation model as the study’s framework. According to Rogers (2003), innovation is “an idea, practice or object that is perceived as new by an individual or other unit of adoption” (p. 475). The study sought to determine the extent that demographic and work-life variables such as gender, office location, caseload, years of service, personality/temperament and employee engagement contributed to levels of innovation adoption by JCOs. Detention and confinement are widely acknowledged juvenile justice system problems which require further research to understand the explanations for these outcomes. Existing juvenile court, mental health, and child welfare histories were used to explicate factors which predict detention length in this random sample of 342 youth from one large, urban Midwestern county in the United States. Data from this sample revealed eight variables which predict detention length. Legitimate predictors of longer detention length such as committing a personal crime or violating a court order were nearly as likely in this sample to predict detention length as other extra-legal predictors such …

Sensationalized cases increasingly create the context for public policy discussion. Stories about violent crime are a common feature of the local evening news and their emotional nature can often create the hook politicians need to showcase their “tough on crime” agendas. Often anecdotal and lurid, stories of criminal misdeeds are widely used to convince the public of a need to create or change laws. This article demonstrates the perils of making law by extrapolating from a few random, albeit attention-grabbing, events. The purpose of this study was to investigate the association between family type and criminal behavior of juveniles in Tennessee who were referred to Juvenile Court in 2006. The population used in the study comprised the juveniles who were referred to the Tennessee Juvenile Courts as reported by the Tennessee Council of Juvenile and Family Court Judges in 2006.
This investigation focused on the criminal behavior as indicated by number and type of referrals to the Juvenile and Family Court system in Tennessee. The data were analyzed by family-of-origin type, age group, and geographic region in Tennessee.

High juvenile recidivism rates are a dilemma that is plaguing the juvenile justice system and the treatment facilities that operate within. There is little understanding of the causal relationship between recidivism rates, treatment types, and the demographics of the residents at the various treatment facilities. The purpose of this research is to identify the common flaws existing in current treatment practices and to utilize social labeling theory as a means of gaining a better understanding of this issue.

Taking A Juvenile Into Custody: Situational Factors That Influence Police Officers' Decisions, Terrence T. Allen
The Journal of Sociology & Social Welfare
Situational factors that influence police officers decisions to take juveniles into custody were investigated. A cross-sectional self administered survey was conducted. Four-hundred and twenty-eight male and female police officers from six police districts in Cleveland Ohio completed and submitted a twenty-five item questionnaire. Using a logistic regression model the study identified: adolescents who disrespect police officers; adolescents who are out late at night; adolescent males; anyone looking suspicious; and the age of the police officer as the most significant predictors. This was an exploratory study that sought to investigate police/juvenile encounters from a street level situational perspective. The results provided …
