Civilization is the reflection of a constant effort to increase reproduction while suppressing pleasure. This is because civilized societies are artificial systems that are governed by rulers. They are militarized and operate through production, consumption, exchange of goods and services, and the transfer of wealth. Unlike reproduction, pleasure and release of tension do little to benefit the rulers (unless they are involved in the process themselves, of course). As a secular democracy, India’s constitution enshrines relatively robust safeguards for religious equality and freedom. Article 25 provides all citizens the right to “freely profess, practice, and propagate” religion, and avoids assigning to Hinduism any special role or explicit privilege (in contradistinction to the situation with Buddhism in Sri Lanka, for example). Moreover, the Indian government itself has not generally engaged in any systematic or flagrant way in the direct persecution or oppression of its religious minorities.

This article identifies three different conceptions of legitimation - pre-modern, modern, and post-secular - that compete both within and across national boundaries for the coveted prize of informing the social imaginary regarding how the government and the law should be legitimated in constitutional democracies. Pre-modern conceptions of legitimation consider governments and rulers legitimate if they are ordained by God or if the political system is ordered in accordance with the normative cosmic order.
