Juvenile Drug Court Program Admission, Demeanor And Cherry-Picking: A Research Note, Holly Miller, J. Barnes, J. Miller, Chris Gibson Sep 2008

Juvenile Drug Court Program Admission, Demeanor And Cherry-Picking: A Research Note, Holly Miller, J. Barnes, J. Miller, Chris Gibson

Holly Ventura Miller

The influence of demeanor in criminal justice research has predominantly centered on arrest and sanctioning outcomes. This study examines demeanor at the juncture of juvenile drug court admission by attributing behavior perceived to be favorable or unfavorable to program compliance and success to either juveniles or their parents/guardians. Analysis of 76 juvenile drug court case files enabled examination of how parent and child demeanor impacts specialty court admission. Findings suggest that program admittance (i.e., system leniency through diversion) is largely a function of projected attitude and behavior during screening interviews, but selection decisions are made irrespective of demeanor source. Implications …

The Development And Presentation Of Psychometric Concept Maps Within The Knowledge Domain Of Security Risk Management, David J. Brooks Dr.

David J Brooks Dr.

The purpose of this interpretive four-phase study was to develop and apply a technique of multidimensional scaling (MDS) to present psychometric concept maps within the knowledge domain of security risk management. Additional and related purposes were to present the knowledge categories and subordinate concepts of security and consider the appropriateness of MDS to develop and present consensual concept maps.

The psychometric MDS security risk management concept map presented the expert knowledge structure of security risk management, demonstrating the inclusive and spatial locality of significant concepts, conceptual complexity of the domain and the central aspect of threat – ratifying the psychometric …

A Leadership Approach To Criminal Justice Education: Developing Tomorrow's Decision Makers, Brian Kingshott Feb 2008

A Leadership Approach To Criminal Justice Education: Developing Tomorrow's Decision Makers, Brian Kingshott

Brian F. Kingshott

Justice delivery in criminal law systems depends on the quality of the decisions of its members; then fair and equitable delivery of justice should be its central goal. Criminal justice educators need to develop their students into persons who are capable of making these decisions. When the knowledge and skills needed to make these tough decisions are examined they are shown to be the same skills that make someone an effective leader and manager. Incorporating leadership education and making ‘leadership skills’ an identified outcome of undergraduate and graduate criminal justice curricula will prepare students to be effective leaders and managers …

Searching For A Pattern: The Effects Of Officer Education On Policing, Marc Ruffinengo Dec 2007

Searching For A Pattern: The Effects Of Officer Education On Policing, Marc Ruffinengo

Marc A. Ruffinengo

In the field of policing, there has been considerable debate for many decades about basic pre-hire qualifications that prospective police officers should have. The arguments have been particularly notable with regards to the topic of education. Traditionally, police departments have been willing to hire officers with nothing more than high school or an equivalent level of education. More and more departments are changing their hiring requirements and stipulating that officers have ever-increasing levels of education. This study seeks to review the extant literature on the topic and draw conclusions as to the effectiveness and performance of college-educated officers versus their …

Is Federalism The Reason For Policy Failure In Hurricane Katrina?, Thomas Birkland, Sarah Waterman Dec 2007

Is Federalism The Reason For Policy Failure In Hurricane Katrina?, Thomas Birkland, Sarah Waterman

Thomas A Birkland

Governmental responses to Hurricane Katrina are generally cited as policy failures. Media and popular analyses focus on the federal government’s policy failures in hazard preparedness, response, and recovery. Meanwhile, disaster experts realize that disaster response is a shared intergovernmental responsibility. We examine the federal nature of natural disaster policy in the US to consider whether federalism, or other factors, had the greatest influence on the failures in Katrina. We find that some policy failures are related to policy design considerations based in federalism, but that the national focus on ‘‘homeland security’’ and the concomitant reduction in attention to natural hazards and disasters, …

Stories Of Jack: Myth, Media And The Law, Marcus O'Donnell Dec 2007

Stories Of Jack: Myth, Media And The Law, Marcus O'Donnell

Marcus O'Donnell

This paper identifies three interacting narrative strands in the Australian media coverage of “Jihad” Jack Thomas. The character story of Jack interacts with a broader story of law and the story of the war on terror. Secondly it argues that a set of mythic motifs emerge in the texts and these are read against a set of news and popular culture events and figures. This second part of the paper focuses on the figure of the “sleeper” which became one of the key ways of describing Jack Thomas during the trial. This figure of the sleeper is linked to an …

How I Learned To Stop Worrying And Use The Legal Argument – A Critique Of Giorgio Agamben’S Notion Of Law, Leila Brännström Dec 2007

How I Learned To Stop Worrying And Use The Legal Argument – A Critique Of Giorgio Agamben’S Notion Of Law, Leila Brännström

Leila Brännström

Giorgio Agamben’s Homo Sacer. Sovereign Power and Bare Life, and State of Exception are, among other things, efforts to explore the deep structures shaping contemporary tendencies in the development of law and politics. Agamben offers us the diagnosis that we live in a ‘permanent state of exception’ – a situation in which law cannot be distinguished from lawlessness. He also suggests a prescription; we ought to look beyond law and reach for a realm of human activity ‘uncontaminated’ by law. He warns us that if we do not over- come law, we risk the ‘juridico-political’ system transforming itself into ‘a …

The Risk Intelligence Conundrum And Its Impact On Governance., Mark F. Loves Dec 2007

The Risk Intelligence Conundrum And Its Impact On Governance., Mark F. Loves

Mark F Loves

This paper looks at intelligence led strategic planning, specifically within the context of an operational private sector corporate security unit which the author managed from 1994 to 2005. It examines the role, mission and objectives of the unit, with specific emphasis on management models, planning frameworks, policy and strategy, client relations and performance measuring. It develops the concept that risk assessment and intelligence development are in fact the same process, acting to direct governance and informing decision making at both tactical and strategic levels.

Testing An Individual Systems Model Of Response Evaluation And Decision (Red) And Antisocial Behavior Across Adolescence, Reid G. Fontaine Dec 2007

Testing An Individual Systems Model Of Response Evaluation And Decision (Red) And Antisocial Behavior Across Adolescence, Reid G. Fontaine

Reid G. Fontaine

This study examined the bidirectional development of aggressive response evaluation and decision (RED) and antisocial behavior across five time points in adolescence. Participants (n5522) were asked to imagine themselves behaving aggressively while viewing videotaped ambiguous provocations and answered a set of RED questions following each aggressive retaliation (administered at Grades 8 and 11 [13 and 16 years, respectively]). Self- and mother reports of antisocial behavior were collected at Grades 7, 9/10, and 12 (12, 14/15, and 17 years, respectively). Using structural equation modeling, the study found a partial mediating effect at each hypothesized mediational path despite high stability of antisocial …

Institutions, Anomie, And Violent Crime: Clarifying And Elaborating Institutional-Anomie Theory, Richard Rosenfeld, Steven F. Messner Dec 2007

Institutions, Anomie, And Violent Crime: Clarifying And Elaborating Institutional-Anomie Theory, Richard Rosenfeld, Steven F. Messner

Richard Rosenfeld

A limited but accumulating body of research and theoretical commentary offers support for core claims of the “institutional-anomie theory” of crime (IAT) and points to areas needing further development. In this paper, which focuses on violent crime, we clarify the concept of social institutions, elaborate the cultural component of IAT, derive implications for individual behavior, summarize empirical applications, and propose directions for future research. Drawing on Talcott Parsons, we distinguish the “subjective” and “objective” dimensions of institutional dynamics and discuss their interrelationship. We elaborate on the theory’s cultural component with reference to Durkheim’s distinction between “moral” and “egoistic” individualism and …
