Žumberak: A Sixteenth-Century Refugee Settlement Zone, Nicholas J. Miller

This article examines the movement of Orthodox Christian refugees from Bosnia to the Habsburg Monarchy in the 1530s and their settlement in a district called Žumberak. The movement of these Uskoks has never been examined in the context of refugee studies. This study of a refugee movement and settlement over a five-century period offers the possibility of reaching a better understanding of the long-term outcome of refugee movements. The state is often conceptualized as playing an enabling role in a country’s economic development—providing public goods, such as the legal protection of property rights, while the political economy of reform is conceived in terms of bargaining over policy among elites or special interest groups. We document a case that turns this perspective on its head: efficiency-enhancing institutional and behavioral changes arising not out of a conscious, top-down program of reform, but rather as unintended (and in some respects, unwanted) by-products of state failure. The Oslo agreements proposed a two-state solution for the Palestinian-Israeli conflict: a Palestinian state on the West Bank and Gaza existing alongside Israel. However, the refugees’ right of return and claims to land and property expropriated by Israel during the 1948 were removed from the equation, although they represent the core issues in the conflict. Based on the territorial divisions that preceded the 1967 war, or the ‘green line’, the agreements implicitly rendered the 1948 war and its consequences for the majority of the Palestinian population a non-negotiable historical reality.
