The Russian Federation's full-scale military invasion of Ukraine on February 24, 2022, has been marked by numerous documented atrocities, potentially falling under the categories of war crimes and crimes against humanity. This thesis aims to explore whether these apparent human rights and humanitarian law violations merit international prosecution. It also assesses the suitability and feasibility of various mechanisms, such as establishing national courts, "internationalized" or "hybrid" tribunals, or resorting to the International Criminal Court (ICC), drawing insights from past experiences in transitional and retributive justice.

Human rights-based approaches are highly useful for a myriad of issues facing the international community. However, they have yet to be utilized in practice due to norms in the international community that favor sovereignty over human rights and international cooperation. This thesis will demonstrate the utility of such approaches by applying one to the issue of climate refugees. It is estimated that by the year 2050, hundreds of millions of people around the globe will become displaced due to climate change. Sexual and gender-based violence is a rampant issue affecting women internationally. Its incidence is exacerbated by conflict and the disruption of social patterns caused by displacement. Refugee women are often at greater risk of violence, due to their transient status in their countries of refuge. There exist many challenges in the protection of refugee women. This thesis examines the effectiveness of the International Criminal Court (ICC) in holding individuals accountable for grave breaches of crimes against peace, war crimes, crimes against humanity, and genocide. I argue that if we measure effectiveness in terms of the ability to set agenda and to publicize, the ICC accomplishes much. My thesis to shows that, as a key part of the international agenda on human rights compliance, the ICC derives its effectiveness from the various naming and shaming campaigns by national governments and non-governmental actors (NGOs).

The Use of Force Working Group was convened in October of 2008 to study police use of electronic control devices, better known as Tasers. Allegheny County (Pa.) District Attorney Stephen A. Zappala, Jr. appointed the Working Group in the wake of an incident in which a person died following a Taser exposure at the hands of local police officers.

This Report concludes that Tasers can be worthwhile and safe weapons in the police arsenal, but only if they are used consistent with proper policy, training, supervision and accountability. Anything less makes the use of these weapons a risky choice from …
