Jernstadt (2004) suggests learning occurs on a continuum comprised of knowledge, recognition, application, and extrapolation (as cited in Keeling, 2006). “In our need to put things into categories, we have classified some parts of higher education as curricular, and other parts as co-curricular, but students just call it college” (Keeling & Associates, 2006, p. vii). Student affairs programs share a common goal of developing master’s level professionals for employment in higher education. Approximately one-third of student affairs training programs are counseling-based and half of those programs are accredited by the Council for Accreditation of Counseling and Related Educational Programs (CACREP). However, there is a lack of literature regarding the preparation of student affairs professionals trained in counseling programs and the importance of counselor training to the student affairs profession. Copyright is a critical, emerging issue in American higher education. Copyright restricts how educators use copyrighted materials in teaching activities. Although the fair use doctrine and the educational exemption in U.S. copyright law provide exceptions for educators, student affairs professionals might not meet the standards of the educational exemption. This paper serves as a primer on U.S. copyright law, the fair use doctrine, and the educational exemption. Analyses of case law suggest student affairs professionals should rely on the fair use doctrine rather than the educational exemption when using copyrighted materials for educational purposes.
