The disenfranchised experiences of women are central to feminist understandings of identity. Crucial to this understanding is the question of what is the cause of female oppression and how to remedy the situation. This introduces the concept of state power and its relationship to women. The state, as the seat of legal and political power, has the ability to serve as both protector and oppressor. The thesis is devoted to exploring feminist perspectives and critiques on state power such as arguments for state intervention in the protection of women through concrete action such as gender-specific laws. The approximately two million gay and lesbian elders in the United States are an underserved and understudied population. At a time when gay men and lesbians enjoy an unprecedented degree of social acceptance and legal protection, many elders face the daily challenges of aging isolated from family, detached from the larger gay and lesbian community, and ignored by mainstream aging initiatives. Drawing on materials from law, history, and social theory, this book integrates practical proposals for reform with larger issues of sexuality and identity. The conflict between liberal legal theory and critical legal studies (CLS) is often framed as a matter of whether there is a theory of justice that the law should embody which all rational people could or must accept. A standard problem with the objectivity of social scientific theory in particular is that it is either self-referential, in which case it seems to undermine itself as ideology, or self-excepting, which seem pragmatically self-refuting. Using the example of Marx and his theory of ideology, I show how self-referential theories that include themselves in their scope of explanation can be objective. Ideology may be roughly defined as belief distorted by class interest. I show how Marx thought that natural science was informed by class interest but not therefore necessarily ideology.
