Litigation, Legislation, And Love: The Comparative Efficacy Of Litigation And Legislation For The Expansion Of Lesbian, Gay, And Bisexual Civil Rights, Mallory Harrington

This research examines the comparative efficacy of federal appellate court decisions and federal legislation with regards to the furtherance of civil rights on the basis of sexual orientation. The research examines efficacy based upon the number of measures which have been implemented as well as the content of each measure. The research examines federal appellate and Supreme Court decisions, as well as adopted pieces of federal legislation since 1950. It also examines the likely causes of the disparities in efficacy that are indicated in this analysis. The findings of this research indicate that litigation has been much more effective at …

“Deserting The Broad And Easy Way”: Southern Methodist Women, The Social Gospel, And The New Deal State, 1909-1939, Chelsea Hodge

Over the course of three decades, white southern Methodist women took on issues of labor and poverty through their national women’s organization, the Woman’s Missionary Council (WMC). Between 1909 and 1939, the WMC focused their work on five groups of people they viewed as in need of their help: women, children, black southerners, immigrants, and rural people. Motivated by the Social Gospel and an intense belief that their faith led them to effect real change in the American South, the WMC intervened in people’s lives, pursuing reform that could at times be maternalistic and condescending but at other times radical …

“And They Entered as Ladies: When Race, Class and Black Femininity Clashed at Central High School,” explores the intersectionality of race, gender and class status as middle-class black women led the integration movement and were the focal point of white backlash during the 1957 Little Rock Central High School crisis. Six of the nine black students chosen to integrate Central High School were carefully selected girls from middle-class homes, whose mothers and female family members played active parts in keeping their daughters enrolled at Central, while Daisy Gatson Bates orchestrated the integration of the capital’s school system. This thesis explores how LGBT marriage activists and lawyers have employed a racial interpretation of due process and equal protection in recent same-sex marriage litigation. Special attention is paid to the Supreme Court's opinion in Loving v. Virginia, the landmark case that declared anti-miscegenation laws unconstitutional. By exploring the use of racial precedent in same-sex marriage litigation and its treatment in state court cases, this thesis critiques the racial interpretation of due process and equal protection that became the basis for LGBT marriage briefs and litigation, and attempts to answer the question of whether a racial interpretation of due process …

This Article uses the history of equal employment rulemaking at the Federal Communications Commission (FCC) and the Federal Power Commission (FPC) to document and analyze, for the first time, how administrative agencies interpret the Constitution. Although it is widely recognized that administrators must implement policy with an eye on the Constitution, neither constitutional nor administrative law scholarship has examined how administrators approach constitutional interpretation. Indeed, there is limited understanding of agencies’ core task of interpreting statutes, let alone of their constitutional practice. The approximately two million gay and lesbian elders in the United States are an underserved and understudied population. At a time when gay men and lesbians enjoy an unprecedented degree of social acceptance and legal protection, many elders face the daily challenges of aging isolated from family, detached from the larger gay and lesbian community, and ignored by mainstream aging initiatives. Drawing on materials from law, history, and social theory, this book integrates practical proposals for reform with larger issues of sexuality and identity.
