This studyexplored questions regarding the perceived influences (agency and structural) to successful Black entrepreneurship according to Black entrepreneurs living in the counties in the Mississippi Delta where Black people are the majority of the population. The examination questioned Black entrepreneurs in 13 counties in the Mississippi Delta on the perceived impact of agency and structural factors (i.e., human capital, social capital, industry type, financial capital, intergenerational link, discrimination, state government, Black elected officials, access to resources, opportunity, location) in relation to their success. In Federal Trade Commission v. Actavis, Inc., the Supreme Court provided fundamental guidance about how courts should handle antitrust challenges to reverse payment patent settlements. The Court came down strongly in favor of an antitrust solution to the problem, concluding that “an antitrust action is likely to prove more feasible administratively than the Eleventh Circuit believed.” At the same time, Justice Breyer’s majority opinion acknowledged that the Court did not answer every relevant question. The opinion closed by “leav[ing] to the lower courts the structuring of the present rule-of-reason antitrust litigation.”This article is an effort to help courts and counsel …

The Supreme Court’s opinion in Federal Trade Commission v. Actavis, Inc. provided fundamental guidance about how courts should handle antitrust challenges to reverse payment patent settlements. In our previous article, Activating Actavis, we identified and operationalized the essential features of the Court’s analysis. Our analysis has been challenged by four economists, who argue that our approach might condemn procompetitive settlements.As we explain in this reply, such settlements are feasible, however, only under special circumstances. Moreover, even where feasible, the parties would not actually choose such a settlement in equilibrium. These considerations, and others discussed in the reply, serve to confirm …

The main question guiding this study deals with whether or not the UNICS is encouraging a shift to the formal sector through their work with business people. Language of education presents challenges in Africa due to colonial linguistic legacies and the diversity of indigenous African languages. Motivated by a substantial number of startup owners with negative household net worth, I present a model that incorporates credit borrowing into Evans and Jovanovic [1989]. The estimated model generates no relationship between household wealth and the propensity for business entry. Ignoring credit borrowing for potential business owners substantially overstates the efficiency loss from financial constraints in business entry. However, the efficiency loss in investments by the entrants is large even if credit borrowing is allowed. Perhaps the greatest reminder of the economic inequities in American society is the drastic deficiencies in educational outcomes, based on class and race. Birmingham, Alabama, vividly portrays this reality. Families with means send their children to private schools and/or concentrate in the suburbs, leaving largely poor, and oftentimes, predominantly minority in densely populated crime-ridden areas with suboptimal schooling. The schooling patterns are clearly reflected in the economic outcomes, though Black are a majority in the city they are vastly underrepresented in the middle to upper middle class, while grossly overrepresented among those in poverty.
