Attendance is a crucial component of the education system and may be addressed utilizing Multi-Tiered System of Supports (MTSS) models. To effectively utilize such models, clear demarcations between tiers must exist to classify students appropriately. Additionally, relevant risk and protective factors must be identified as targets for intervention and prevention efforts at each tier. Little research exists that identifies school climate factors, and other student-based contextual factors such as academic mindset and social emotional learning, that impact absenteeism. Contemporary classification models of school absenteeism often employ a multitier approach for organizing assessment and treatment strategies. Researchers have yet to agree, however, on how to objectively define problematic school absenteeism and identify demarcation points for each tier. The present study aimed to inform a multitier approach by determining the most relevant risk factors for problematic school absenteeism. The most useful targets of assessment for problematic school absenteeism are also addressed. The correlation between truancy and dropping out of school is high, prompting school districts and the state legislature to attempt to intervene (Sparks, 2010). The purpose of this study is to determine the effectiveness of the West Virginia Code 18-8-4 that requires mandatory legal compulsory attendance (CA2) meetings to be held at the county level when a student obtains five days of unexcused absences. In the summer of 2010, the WV state legislature changed the CA2 meeting requirements from 10 days of unexcused absences to five. The purpose of this current study is to determine if a difference exists in the attendance rates for special education students and low socioeconomic status students when compared to their peers who do not have these designations. The attendance data from one rural county school district for the years of 2007-2011 were examined to determine if a difference in the attendance rates did exist. Results from this research revealed that students receiving special education services were absent significantly more than their general education peers.
