This report presents research and findings from a study of court-connected ADR commissioned by the Executive Office of the Trial Court (EOTC). The study was conducted by the state office of dispute resolution also known as the Massachusetts Office of Public Collaboration at the University of Massachusetts Boston. The office has been serving as a neutral forum and state-level resource for almost 30 years. The Parent Mediation Program was established in 2008 as a state-local collaboration to raise awareness of mediation as a viable option for creating workable parenting plans and to mediate parenting issues for never-married, separated, divorced or separating parents across the state. The program aims to annually provide direct educational services to around 250-300 disputing parents, about 170-220 of whom will also receive mediation services.

The CMC Grant Program was established in FY 2013 to distribute state operational funding to qualified community mediation centers serving primarily low income citizens. Mediation services are provided through trained volunteers for a wide-range of family, neighborhood and community conflicts referred through courts, public agencies, local businesses, organizations and individuals. Centers deliver training, conduct outreach and education, and actively engage community members on their boards and through local partnerships.

The Massachusetts Department of Conservation and Recreation (DCR) initiated the Forest Futures Visioning Process to develop a long-term strategy for managing the 308,000 acres of lands in the State and Urban Parks system. The Massachusetts Office of Public Collaboration at UMass Boston designed and facilitated this year-long collaborative visioning process which culminated in a set of consensus recommendations for a 100 year vision for the forests of Massachusetts.

The Massachusetts Agricultural Mediation Program is administered by the Massachusetts Office of Public Collaboration (MOPC) at UMass Boston and certified by the U.S. Department of Agriculture to provide mediation services to the farm community in Massachusetts. Through the Program, MOPC provides mediation services to farmers, their creditors, and the USDA, as well as conducts training and outreach to build the capacity of producer organizations and state and local officials to address conflicts.

As part of the public service mission of UMASS Boston, the MA Office of Public Collaboration (MOPC) partnered with the Community Mediation Coalition of Massachusetts in compiling a research study and design for a Community Mediation Centers Grant Program to increase sustainability, scope and quality of Massachusetts community dispute resolution as a mechanism for increasing access to justice for all Massachusetts communities.

The purpose of framing the research in the following models is to assist the court and its court-connected mediation programs in their ongoing dialogue with the funding decision-makers in addressing the question: Is state funding of community mediation centers and court ADR generally a worthwhile investment? As a means of setting forth components of an analytic framework, the following simplified financial models are offered to draw out salient aspects of the nature of the investment.
