Civic Responsibility And Patterns Of Voluntary Participation Around The World, Mary Alice Haddad
Civic Responsibility And Patterns Of Voluntary Participation Around The World, Mary Alice Haddad
Mary Alice Haddad
This article seeks to explain why different types of volunteer organizations are prevalent in different countries. It hypothesizes that patterns of volunteer participation are a function of citizen attitudes toward governmental and individual responsibility for caring for society. Those countries (e.g., Japan)—where citizens think that governments should be responsible for dealing with social problems—will tend to have higher participation in embedded volunteer organizations, such as parent-teacher associations. Those countries (e.g., the United States)—where citizens think that individuals should take responsibility for dealing with social problems—will tend to have more participation in nonembedded, organizations, such as Greenpeace. These hypotheses are tested …

Great Expectations? The Changing Role Of “Europe” In Romani Activism In Hungary, Krista Harper, Peter Vermeersch
Great Expectations? The Changing Role Of “Europe” In Romani Activism In Hungary, Krista Harper, Peter Vermeersch
Krista M. Harper
Contemporary political action for ethnic and national minorities in Europe appears to be increasingly directed towards supra- and transnational structures. This development seems indicative of the growth of a European space for minority activism – a public space that is less state-centered, that allows claims to be framed in terms of European standards and therefore facilitates the emergence of an active European citizenship. In theory, this “Europeanization” of minority politics may offer minority activists additional avenues for raising demands about cultural recognition and economic equalization. This article seeks to identify the possible implications of the Europeanization of minority politics by …

Re-Examining The Politics Of U.S. Intervention In Early 20th Century Nicaragua: José Madriz And The Conservative Restoration, Yann P. Kerevel
Re-Examining The Politics Of U.S. Intervention In Early 20th Century Nicaragua: José Madriz And The Conservative Restoration, Yann P. Kerevel
Yann P. Kerevel
This research re-examines the U.S. intervention in Nicaragua in 1909-10. Most literature of this period argues that the United States forced the dictator Zelaya out of office in 1909; however, I contend that the argument that U.S. intervention caused the fall of Zelaya does not clearly match up to the historical record. Instead, I argue it is much more compelling to examine U.S. policy toward José Madriz to understand the impact of the intervention. It is clear that U.S. policy was the decisive factor in the fall of Madriz, while it is less convincing in the case of Zelaya.
Through A Glass Darkly’: Assessing The ‘New’ War Against Corruption In Nigeria, Shola J. Omotola
Through A Glass Darkly’: Assessing The ‘New’ War Against Corruption In Nigeria, Shola J. Omotola
Shola J. Omotola Mr
It is no longer news that corruption is endemic in Nigeria. Neither is it news that the ‘democratic’ government of President Obasanjo is waging an unprecedented war against corruption. What is, however, controversial is the extent to which the ‘new’ war has succeeded in addressing this scourge. This article engages this crucial question and submits that while the legal and institutional anchorages of the war offer a good point of departure, they remain grossly inadequate. This largely explains why the war has been underproductive and caught in a deepening crisis of legitimacy. What is required is the nourishing and re-envisioning …

Privatizing Public Enterprises In The European Union 1960-2002: Ideological, Pragmatic, Inevitable?, Judith Clifton, Daniel Díaz-Fuentes, Francisco Comín

Privatization, recognized as one of the most important economic policy reforms from the 1970s, has attracted significant attention from scholars, and the literature on the topic is now vast. Yet there is little agreement on the reasons why governments privatized. Three dominant paradigms explaining European Union (EU) privatization put forward distinct motivations. The ‘British paradigm’ assumed that market-friendly ideology played a significant role in a path towards a global programme inspired by the UK experience. The ‘multiple logics’ approach observed that the UK was an anomaly, not a leader, and that EU privatization was so diverse that there were few, …

“Minority Presidents And Democratic Performance In Latin America”, Gabriel L. Negretto
“Minority Presidents And Democratic Performance In Latin America”, Gabriel L. Negretto
Gabriel L. Negretto
A widely accepted argument among scholars of presidential regimes in Latin America is that inter-branch cooperation is impaired when the president’s party falls short of a majority of seats in the legislature. This argument fails to take into account three factors that should have an effect on executive-legislative relations in the event that the president’s party has no independent control over the assembly: the location of the president’s party in the policy space, the capacity of the president to sustain a veto, and the legislative status of the parties included in the cabinet. I propose the hypothesis that the greatest …
“Choosing How To Choose Presidents: Parties, Military Rulers, And Presidential Elections In Latin America”, Gabriel L. Negretto
“Choosing How To Choose Presidents: Parties, Military Rulers, And Presidential Elections In Latin America”, Gabriel L. Negretto
Gabriel L. Negretto
Students of presidential regimes claim that while the combination of plurality rule for presidential elections and concurrent electoral cycles favors bipartism, majority rule for electing presidents favors multipartism. I argue that a reverse causality also affects the relationship between party systems and electoral systems. Using a bargaining model of institutional change, I propose that while dominant and large parties are likely to choose plurality rule and concurrent elections, small parties are likely to choose majority rule. I also argue that military rulers and mil- itary-civilian coalitions tend to follow the logic of electoral choice of small parties. These hypotheses are …

Institutional Determinants Of The Judicialisation Of Policy In Brazil And Mexico, Julio Antonio Rios-Figueroa, Matthew M. Taylor
Institutional Determinants Of The Judicialisation Of Policy In Brazil And Mexico, Julio Antonio Rios-Figueroa, Matthew M. Taylor
Julio Ríos-Figueroa
This article offers a comparative perspective on judicial involvement in policy change in Latin America during the last decade and a half. Drawing on the literature on new institutionalism and the judicialisation of politics, and on case studies from Latin America’s two largest countries, we propose a comparative framework for analysing the judicialisation of policy in the region. On the basis of this framework, we argue that institutional structure is a primary determinant of patterns of the judicialisation of policy. In particular, institutional characteristics of the legal system affect the way political actors fight to achieve their policy objectives and …

Sovereignty And The American Courts At The Cocktail Party Of International Law: The Dangers Of Domestic Invocations Of Foreign And International Law, Donald J. Kochan
Donald J. Kochan
With increasing frequency and heightened debate, United States courts have been citing foreign and “international” law as authority for domestic decisions. This trend is inappropriate, undemocratic, and dangerous. The trend touches on fundamental concepts of sovereignty, democracy, the judicial role, and overall issues of effective governance. There are multiple problems with the judiciary’s reliance on extraterritorial and extra-constitutional foreign or international sources to guide their decisions. Perhaps the most fundamental flaw is its interference with rule of law values. To borrow from Judge Harold Levanthal, the use of international sources in judicial decision-making might be described as “the equivalent of …
A Theoretical And Political Analysis Of The Wto Appellate Body, Shoaib A. Ghias
A Theoretical And Political Analysis Of The Wto Appellate Body, Shoaib A. Ghias
Shoaib A. Ghias
Economic liberalization not only requires rules goveming economic exchange (such as multilateral trade agreements), but also institutions (such as courts) goveming how rules are enforced. However, once courts are established to govem economic exchange, they tend to expand their competence to political and social policy. Political scientists have used this theoretical framework to explain the evolution of national (for example the U.S. Supreme Court) and quasi-intemational (for example the European Court of Justice) judicial institutions. In this article, I explain how this model can be extended to a truly intemational "judicial" institution, the WTO's Appellate Body. In short, the Appellate …
