Legal Reform In Contemporary Japan, Eric Feldman

In this chapter I offer a preliminary assessment of a quickly moving target—legal reform and its impact on rights in Japan. Although a broad consensus has emerged among interested parties that at least some degree of reform is desirable, there is significant disagreement about the goals of reform, and also about the likelihood that it will achieve certain objectives. Some commentators believe that the Japanese legal system is on the cusp of a “revolution” that will shore up long-neglected rights and create new entitlements. Others predict that the consequences of reform will be modest; and they despair that aggrieved individuals …

This paper examines the evolution and recent trends in the design of Entertainment Retail Centres (ERCs) in Los Angeles and Hong Kong. Most of the literature on spaces of consumption and leisure deals with economic reasons for the development of these spaces, and with the social, cultural, and political implications of the phenomenon. There are limitations to this approach that this study addresses. First, there has been a lack of attention to processes of globalization in the analysis of these spaces. Furthermore, a largely US-centred approach has left out an understanding of the significance of the ERC phenomenon in other …

This paper revisits Singapore’s industrial development in Suzhou, China, which has been in operation for more than a decade. We aim to glean insights from this experiment and more importantly, to verify recent claims of it generating political gain and economic capital for Singapore. The flagship project took on an identical framework as the other Singaporean transborder industrialization ventures in the region by adopting Singapore’s expertise and reputation for an efficient and stable government and investment environment. Singapore’s transborder industrialization projects in China and India have received much attention. This regionalization initiative was intended to set in place a strategic configuration for the city-state to restructure its domestic industries and, pari passu, retain important linkages with contiguous, low-cost environments. Our study reports on Singapore’s pioneering, albeit lesser-known, project - Batamindo Industrial Park – in neighboring Batam Island, Indonesia, and finds that the strategic intent of this policy gambit remains stymied by non-economic, socio-political complexities in the host environment, and the economics of competition from other industrial estates in the vicinity of this prototype, remains to be addressed.

Reiterated Commemoration: Hiroshima As National Trauma, Hiro Saito

This article examines historical transformations of Japanese collective memory of the atomic bombing of Hiroshima by utilizing a theoretical framework that combines a model of reiterated problem solving and a theory of cultural trauma. I illustrate how the event of the nuclear fallout in March 1954 allowed actors to consolidate previously fragmented commemorative practices into a master frame to define the postwar Japanese identity in terms of transnational commemoration of "Hiroshima." I also show that nationalization of trauma of "Hiroshima" involved a shift from pity to sympathy in structures of feeling about the event. This historical study suggests that a …

Widely regarded as an anomaly in the neo-authoritarian system in Malaysia, Malaysiakini.com is proving that managing an independent media in a government-managed media landscape is more than a Sisyphean struggle. Employing participant observation and interviews, supplemented by artifacts and media accounts, this study seeks to understand the media management of Malaysiakini.com through news management, using Shoemaker and Reese’s (1996) hierarchy of influence model, which posits a framework of internal and external forces that affect news management. The Arthur Paul Afghanistan Collection is one of the largest collections of research materials on Afghanistan and serves scholars from around the world.

In discussing bond markets in Asia, academics and policymakers typically begin by noting that the Asian crisis of 1997-98 in part resulted from the underdevelopment of the region’s domestic bond markets and the resultant currency and duration mismatches. When assessing the progress made in developing these markets in the post-crisis years, academics and policymakers usually observe that, while several domestic currency government bond markets have moved ahead, corporate bond markets have lagged (Asian Development Bank (2002), Reserve Bank of Australia (2003)). The policy conclusion is therefore often drawn: to prevent another Asian crisis, Asian bond markets must be further developed.

Since the World Trade Organization (WTO) was established, China his made large-scale efforts to shape its trade remedy system through legal and organizational changes. Through these changes, China could clarify the meanings of WTO anti-dumping provisions including the provision relating to the definition of domestic industry. Moreover, procedural disciplines on reviews were fortified in Chinese anti-dumping system. Are China’s growing energy needs insatiable, and is a resource war between China and other major energy-consuming countries, such as the United States, inevitable? China’s pursuit of overseas energy resources to feed its fast-growing economy has given rise to observations that energy is now the driving force behind Chinese foreign policy and predictions that potential conflicts between China and other countries are likely to arise as China becomes more aggressive internationally in search of resources.

Social and cultural geographies have long occupied a marginal position in Taiwan's scholarship in the humanities and social sciences. Despite the influence of the so-called ‘cultural turn’ that has characterized much of Anglo-American scholarship since the 1990s (Barnett 1998), Taiwan's scholarship in the social sciences in general and human geography more specifically has remained relatively untouched by these intellectual currents till very recent years. This paper seeks to examine the social, intellectual and institutional contexts that explain this marginalization, and consider the possibilities for social and cultural geographies' emergence from marginality in Taiwan in the future. There is no single approach to government procurement regulation among Asian countries. While some are signatories to the WTO's Government Procurement Agreement (GPA), others are not. Some have deliberate policies which confer preferences on domestic suppliers of goods and services. Even so, some have embarked on changing their GP regimes independently of WTO requirements. Yet others appear to be prepared to make changes in tandem with the negotiation of bilateral or regional free trade agreements. This article examines government procurement from these varied perspectives of Asian countries.

Recent dialogues in geography and the social sciences have reminded researchers of the extent to which academic and policy knowledges are socially and spatially embedded-that is, they circulate through formal and informal systems of publishing, exchange, commodification and cultural influence. Academic and policy knowledges are, in short, very much a part of the creative economy. In light of this, our paper surveys knowledges of the creative economy itself, as reflected in a geography of industry reports and government policy statements in selected Asian countries. Chicago: University of Chicago Press] developed and popularized a method for uncovering the implicit weights assigned to major international currencies constituting a currency basket. We extend the methodology in two dimensions: include regional competitive pressure and employ a vector autoregressive (VAR) model to overcome simultaneity bias. In this article, I explore the sociality of cultural industries by analyzing the film industry in Hong Kong. In particular, the social networks and relationships at multiple scales – across national boundaries, within local settings and on production sets – are examined, revealing their critical role in contributing to the health of the film industry. The risks faced at various steps of the production, marketing and distribution process are ameliorated by trust relations, built up through time between social actors in spontaneous ways. Is growth good for the poor? In theory, yes. As one influential report on China’s “War on Poverty” suggested, ”Obviously robust economic growth helps reduce poverty, as long as the gains are reasonably distributed” (Rozelle et al. 2000). In practice as well, growth is often a crucial ingredient in the poverty reduction recipe. While this relationship is well founded, important exceptions present themselves – some areas grow, but poverty persists; the economies of other areas remain apparently stagnant, yet poverty diminishes. These exceptions, if studied, will not only illuminate further the causal relationship between these two concepts, but also provide …

A folksongs karaoke product has been created to increase usage of subtitled media to enhance literacy and technology use, particularly among girls in rural India. This entails generating and proliferating popular local folksongs with social and cultural themes of interest to girls, accompanied by the award-winning Same Language Subtitling (SLS) feature. In this paper, the prime goal is to discuss possible implications of this novel technology content on girls’ socialization, education, and activism. The Currency Board System in Hong Kong and the monitoring band system in Singapore are important benchmarks for two different exchange-rate systems. In this paper we consider the implications of the two exchange-rate systems on the interest-rate behaviour of the two economies. We examine the domestic–US interest differentials under the two exchange-rate regimes during the Asian Financial Crisis as well as the pre-and post-crisis periods. Using a bivariate generalized autoregressive conditional heteroscedasticity model, we also investigate whether there is any change in the correlation between the domestic and US interest rates due to the Asian Financial Crisis.

The Singapore dispute resolution landscape entered the new millennium with the reconstruction of the dual carriageway for arbitration. In 2002, the old road to arbitral resolution of disputes ( i.e. , the old Arbitration Act and the old International Arbitration Act ) were reconstructed and what emerged were two updated legislations: the Arbitration Act and the International Arbitration Act . At about the same time, the Singapore International Arbitration Centre (SIAC) also diversified with the introduction of a new set of Domestic Arbitration Rules.

In Singapore, there is no doubt that there have been efforts by various local and foreign corporations to incorporate some CSR principles in their operations. Indeed, there was a national initiative modeled after the tripartite approach to industrial relations where national economic and industrial issues are collectively resolved by the government, employers and employees. Against the backdrop of this national initiative and the effort by some corporations to incorporate CSR principles, not much is really known about the state of affairs in Singapore.

Taiwan's Participation In Inter-Governmental Organizations: An Overview Of Its Initiatives, Chien-Pin Li

Emboldened by the ascendance of economic issues on the global agenda and the erosion of security-driven bipolar structures, Taiwan in the late 1980s decided to use its economic advantages for diplomatic gain. Examination of changes in three phases of Taiwan's initiatives indicates that its inter-governmental organization strategies and targets correlate well with domestic politics and external factors.
