Of the many advances made by the ancient Romans, perhaps their greatest contribution to contemporary Western society stemmed from their sophisticated legal system. Ancient senators, jurists, and eventually emperors set forth policies that encompassed the expectations of Roman citizens in respect to property, family, and behavior. Roman law allowed for the creation of an efficient government bureaucracy, promoting an unprecedented era of peace and prosperity that stretched over the first two centuries of the Common Era. Contemporary American law, culture, and political theory restrain the concept of equality as a tool of social justice. Equality in conjunction with a strong emphasis on personal liberty operates as a mandate for curtailing state action, rather than an aspirational measure of the comparative wellbeing of individuals. As a check on state involvement, our cramped notion of equality limits the state's ability to affirmatively address economic, political, social, and structural inequalities.

We investigate potential racial bias by Major League Baseball umpires. We do so in the context of the subjective decision as to whether a pitch is called a strike or a ball, using data from the 1989-2010 seasons. We find limited, and sometimes contradictory, evidence that umpires unduly favor or unjustly discriminate against players based on their race. Potential mitigating variables such as attendance, terminal pitch, the absolute score differential, and the presence of monitoring systems do not consistently interact with umpire/pitcher and umpire/hitter racial combinations. Although there have been studies that focus on the experiences of the gay and lesbian population serving in the United States military, few have focused on the experience of active duty transgender service members. Transgender individuals transgress the binary conception of gender by deviating from societal gender norms associated with assigned sex at birth. The Department of Defense has set policies and standards that reflect a binary conception of gender, with a focus on conformity. This overarching question forms the basis of this paper and will be answered using an array of primary and secondary sources.
