Houve tempo em que a Constituição servia para poisar ou charuto ou tirar um argumento político, como ironicamente afirmaria o grande escritor oitocentista Eça de Queiroz. Hoje a Constituição é a norma das normas. Daí há consequências hermenêuticas. Ao contrário das teorias que importam interpretação tradicional e, por vezes, em grande medida ultrapassada, para o Direito Constitucional, a tendência actual é a inversa: dada a supremacia da Constituição, deve ser a metodologia constitucional a exportar hermenêutica para o todo do Direito. Para isso, começamos neste artigo com grandes princípios de hermenêutica intra-constitucional. Depois se passará à exportação.

Fanning The Flames: Religious Media Consumption And American Politics, Brian Newman, Mark Smith

Both religion and mass media are politically important in the United States. However, little is known about the political role of religious media. Religious media might be politically influential because they help translate religion into political thinking and because their consumers are likely to internalize the political cues these media provide. We find that almost a quarter of the public claims to have relied on religious media when making voting decisions in 2000. Religious media users felt significantly closer to George W. Bush and Pat Buchanan and farther away from Al Gore and were more likely to vote for Bush …

Distress During The Great Depression: The Illiquidity-Insolvency Debate Revisited, Gary Richardson

During the contraction from 1929 to 1933, the Federal Reserve System tracked changes in the status of all banks operating in the United States and determined the cause of each bank suspension. This essay analyzes chronological patterns in aggregate series constructed from that data. The analysis demonstrates both illiquidity and insolvency were substantial sources of bank distress. Periods of heightened distress were correlated with periods of increased illiquidity. Contagion via correspondent networks and bank runs propagated the initial banking panics. As the depression deepened and asset values declined, insolvency loomed as the principal threat to depository institutions.

A Journal of Economic History article by Linda Hooks and Kenneth Robinson, “Deposit Insurance and Moral Hazard: Evidence from Texas Banking During the 1920s,” contains a contradiction (Hooks and Robinson 2002). Pondering the contradiction in the paper reveals insights that the authors may have overlooked. Hooks and Robinson’s article examines the experience of the banking industry in Texas during the 1920s. Texas operated a deposit-insurance system from January 1, 1910 until February 11, 1927. Deposit insurance was mandatory for all state banks, which were given the choice of two plans in which to participate. The preponderance participated in the depositors …

Check Is In The Mail: Correspondent Clearing And The Banking Panics Of The Great Depression, Gary Richardson

Weaknesses within the check-clearing system played a hitherto unrecognized role in the banking crises of the Great Depression. Correspondent check-clearing networks were vulnerable to counter-party cascades. Accounting conventions that overstated reserves available to corresponding institutions may have exacerbated the situation. The initial banking panic began when a correspondent network centered in Nashville collapsed, forcing over 100 institutions to suspend operations. As the contraction continued, additional correspondent systems imploded. The vulnerability of correspondent networks is one reason that banks that cleared via correspondents failed at higher rates than other institutions during the Great Depression.

Japan’s civil society is being transformed as more people volunteer for advocacy and professional nonprofit organizations. In the American context, this trend has been accompanied by a decline in participation in traditional organizations. Does the rise in new types of nonprofit groups herald a decline of traditional volunteering in Japan? This article argues that while changes in civil rights, political opportunity structure, and technology have also taken place in Japan, they have contributed to the rise of new groups without causing traditional organizations to decline, because Japanese attitudes about civic responsibility have continued to support traditional volunteering.

This work examines the cognitive representation of phonotactic constraints on Spanish stress via the collection of behavioral data. Critical stimuli in four experiments consist of non-words that violate the Spanish stress window. Experiment 1 finds statistical differences among latency and accuracy data for stimuli that represent theoretic ally proscribed sequences, theoretically licit sequences that are unattested for diachronic reasons, and fully licit gaps. Experiments 2 and 3 find differential patterning of rising and falling diphthongs. Experiment 4 tests the time course of phonological encoding and evidences differential treatment of both diphthong types across delays in a delayed naming task . …

His work in the anthropology of religion has received less attention. Least acknowledged is Rappaport’s role in defining an “engaged” anthropology. Studies have examined the impact of environmental variables on academic achievement among student athletes in the revenue-generating sports of men’s basketball and football. However, while evidence concerning the positive impact of male student athlete and faculty interaction is virtually unequivocal, we are not certain whether the benefits accruing from particular types of interaction vary across different racial/ethnic groups. Although it is generally accepted that the Alexander Mosaic copies a painting of the 4th Century BCE, the attribution of this prototype has never been settled. Numerous attempts have been made to associate it with painters recorded in Pliny's Natural History, notably Philoxenos of Eretria, and Alexander's court painter, Apelles.
If the painting were the work of any artist whose name survives, as strong a case can be made for Aristeides of Thebes as for Apelles or Philoxenos. Since Pliny's comment that Aristeides painted a battle against the Persians follows his treatment of the works of Apelles, he is likely …

Politics and Volunteering begins by painting a portrait of volunteering in Japan, and demonstrates that our current understandings of civil society have been based implicitly on a U.S. model that does not adequately consider participation patterns found in other parts of the world. The book develops a theory of civic participation that, incorporates citizen attitudes about governmental and individual responsibility, with societal and governmental practices that support (or hinder) volunteer participation. The practice of integrating western and traditional indigenous medicine is fast becoming an accepted and more widely used approach in health care systems throughout the world. However, debates about intercultural health approaches have raised significant concerns. This paper reports findings of five case studies on intercultural health in Chile, Colombia, Ecuador, Guatemala, and Suriname. It presents summary information on each case study, comparatively analyzes the initiatives following four main analytical themes, and examines the case studies against a series of the best practice criteria.
