This dissertation, based on a year and eight months of fieldwork, is a historical ethnography of a Shari‘a-based movement which appeared in Mogadishu, Somalia within a year after the complete disintegration of the central government in 1991. The movement originated when religious authorities and “traditional” elders established centers in various neighborhoods in Mogadishu to deal with the vacuum of power after the fall of the state. Since Shari‘a structures of authority and discourse were integral to the formation and functioning of the centers, they became known as Shari‘a courts. Universal human rights (HR) are often theorized as philosophically neutral. Because they do not espouse any particular theory of the human being, it is argued, they can be reasonably appropriated by all. In this thesis, I explore HR’s universality claim, by focusing on the discourse’s secular foundation. In the universal human right to freedom of religion, I find a distinctly modern grammar of ‘religion,’ one that separates ‘religion’ from politics and power, law from morality, and the public and private realms. This dissertation evaluates the political history of Islam through the prism of the Sunni conception of authority. It finds an historical red thread that explains the legal and political evolution of different types of Islamic government that have, instead of a European-type sovereign, the Ulu Al Amr (those in authority). In addition, it argues that it is the authority of Ulu Al Amr that legitimizes temporal power via legal rulings such as Wilayah al ahed (allegiance to a dynastic monarchy) and Wlayah al qaher (obedience to coercive power and rule). In light of Randy Martin's proposal to use dance as an analytic tool for understanding social movements, this article seeks to reconstruct the early mobilization of the Muslim Brotherhood as "bodies in motion." Through a re-examination of both primary and secondary source material, this study highlights the ways in which founder Hasan al-Banna appropriated both Islamic and colonial choreographic logics into the Muslim Brotherhood's pious training regimen, scouting programs, political expression, and social welfare projects.
