Qualitative Leveraging Natural Language Processing To Establish Judge Incrimination Statistics To Educate Voters In Re-Elections, Aurian Ghaemmaghami, Paul Huggins, Grace Lang, Julia Layne, Robert Slater

SMU Data Science Review

The prevalence of data has given consumers the power to make informed choices based off reviews, ratings, and descriptive statistics. However, when a local judge is coming up for re-election there is not any available data that aids voters in making data-driven decision on their vote. Currently court docket data is stored in text or PDFs with very little uniformity. Scaling the collection of this information could prove to be complicated and tiresome. There is a demand for an automated, intelligent system that can extract and organize useful information from the datasets. This paper covers the process of web scraping …

Journal of Digital Forensics, Security and Law

Phishing is currently one of the severest cybersecurity challenges facing the emerging online community. With damages running into millions of dollars in financial and brand losses, the sad tale of phishing activities continues unabated. This led to an arms race between the con artists and online security community which demand a constant investigation to win the cyberwar. In this paper, a new approach to phishing is investigated based on the concept of minimal feature set on some selected remarkable machine learning algorithms. The goal of this is to select and determine the most efficient machine learning methodology without undue high …

Copycat Mass Killings: How Personality Might Moderate Identification With Antisocial Characters, Emily R. Mazzurco Nov 2021

Copycat Mass Killings: How Personality Might Moderate Identification With Antisocial Characters, Emily R. Mazzurco

Kean Quest

Research indicates that certain personality traits are prevalent within mass killers. Aggression, social rejection, narcissism, fame-seeking, low self-esteem, and depression are commonalities with mass killers, specifically mass shooters. Identification or idolizing antisocial fictional characters is also a common behavior within these types of offenders. These types of killers often draw inspiration for their own crimes from past criminals or from film and TV, thus committing what is known as a copycat crime. The purpose of the current study will be to examine the effects of social rejection and instigation on the likelihood of identifying with an antisocial character in young …

Critical Pedagogy In The Time Of Covid-19: Lessons Learned, Carol Christine Hordatt Gentles Nov 2021

Critical Pedagogy In The Time Of Covid-19: Lessons Learned, Carol Christine Hordatt Gentles

Journal of Multicultural Affairs

The abrupt closure of universities due to the coronavirus pandemic caused unprecedented challenges for educators. They struggled to transition to online teaching almost overnight. This has raised questions about the readiness of Higher Education for digitalisation and hybridization of learning environments and focused attention on the renewal of teaching and learning models. It is incumbent upon those who practise critical pedagogy to join this conversation; the mandatory transition has raised difficult questions around how to ensure continuity of an agenda to offer students humanistic and democratic learning experiences in the new virtual reality. In this paper I offer a critical …

Don't Bite The Bait: Phishing Attack For Internet Banking (E-Banking), Ilker Kara

Journal of Digital Forensics, Security and Law

Phishing attacks are based on obtaining desired information from users quickly and easily with the help of misdirecting, panicking, curiosity, or excitement. Most of the phishing web sites are designed on internet banking(e-banking) and the attackers can acquire financial information of misled users with the tactics and discourses they develop. Despite the increase of prevention techniques against phishing attacks day by day, an effective solution could not be found for this issue due to the human factor. Because of this reason, real phishing attack studies are essential to study and analyze the attackers’ attack techniques and strategies. This study focused …

The Ratio Method: Addressing Complex Tort Liability In The Fourth Industrial Revolution, Harrison C. Margolin, Grant H. Frazier

St. Mary's Law Journal

Emerging technologies of the Fourth Industrial Revolution show fundamental promise for improving productivity and quality of life, though their misuse may also cause significant social disruption. For example, while artificial intelligence will be used to accelerate society’s processes, it may also displace millions of workers and arm cybercriminals with increasingly powerful hacking capabilities. Similarly, human gene editing shows promise for curing numerous diseases, but also raises significant concerns about adverse health consequences related to the corruption of human and pathogenic genomes.

In most instances, only specialists understand the growing intricacies of these novel technologies. As the complexity and speed of …

Professional Responsibility, Legal Malpractice, Cybersecurity, And Cyber-Insurance In The Covid-19 Era, Ethan S. Burger

St. Mary's Journal on Legal Malpractice & Ethics

In response to the COVID-19 outbreak, law firms conformed their activities to the Centers for Disease Control and Prevention (CDC), Occupational Safety and Health Administration (OSHA), and state health authority guidelines by immediately reducing the size of gatherings, encouraging social distancing, and mandating the use of protective gear. These changes necessitated the expansion of law firm remote operations, made possible by the increased adoption of technological tools to coordinate workflow and administrative tasks, communicate with clients, and engage with judicial and governmental bodies.

Law firms’ increased use of these technological tools for carrying out legal and administrative activities has implications …

Enhancing The Weather: Governance Of Weather Modification Activities Of The United States, Manon Simon

William & Mary Environmental Law and Policy Review

In the context of climate change, weather modification by cloud seeding, and in particular, precipitation enhancement techniques, has gained a renewed attention from governments. In the United States, several states run weather modification programs to secure freshwater resources and increase both crop and hydroelectricity production. Weather modification techniques were developed post–World War II, and so were the legal arrangements that govern them. Since then, weather modification law has undergone little to no reform. California and Texas are two active users of cloud-seeding technologies but employ very different governance frameworks. This Article assesses the effectiveness of weather modification governance in these …

Internet Of Things Software And Hardware Architectures And Their Impacts On Forensic Investigations: Current Approaches And Challenges, Abel Alex Boozer, Arun John, Tathagata Mukherjee Sep 2021

Internet Of Things Software And Hardware Architectures And Their Impacts On Forensic Investigations: Current Approaches And Challenges, Abel Alex Boozer, Arun John, Tathagata Mukherjee

Journal of Digital Forensics, Security and Law

The never-before-seen proliferation of interconnected low-power computing devices, patently dubbed the Internet of Things (IoT), is revolutionizing how people, organizations, and malicious actors interact with one another and the Internet. Many of these devices collect data in different forms, be it audio, location data, or user commands. In civil or criminal nature investigations, the data collected can act as evidence for the prosecution or the defense. This data can also be used as a component of cybersecurity efforts. When data is extracted from these devices, investigators are expected to do so using proven methods. Still, unfortunately, given the heterogeneity in …

The Survey On Cross-Border Collection Of Digital Evidence By Representatives From Polish Prosecutors’ Offices And Judicial Authorities, Paweł Olber Dr

Journal of Digital Forensics, Security and Law

Dynamic development of IT technology poses new challenges related to the cross-border collection of electronic evidence from the cloud. Many times investigators need to secure data stored on foreign servers directly and then look for solutions on how to turn the data into a legitimate source of evidence. To study the situation and propose solutions, I conducted a survey among Polish representatives of public prosecutors' offices and courts. This paper presents information from digital evidence collection practices across multiple jurisdictions. I stated that representatives from the prosecution and the judiciary in Poland are aware of the issues associated with cross-border …

Organic Waste Bans: Beyond The Compost Heap, David Lee Sep 2021

Organic Waste Bans: Beyond The Compost Heap, David Lee

Journal of Food Law & Policy

Food waste and food insecurity are strange bedfellows, but in the United States they shamelessly walk hand-in-hand. The USDA’s Supplemental Nutrition Assistance Program (“SNAP”) and the Emergency Food Assistance Program (“TEFAP”) are two federal programs that provide for large numbers of people in the United States. Local food recovery and donation programs serve their communities as the “backbone of the America hunger response" efforts. While many American households continue to report their struggles with food insecurity, heaping piles of good food go to waste. The repercussions of wasted food are vast, taxing American wallets, wasting our resources with every bit …

The Pandemic, Climate Change And Farm Subsidies, Allen H. Olson, Edward J. Peterson

Journal of Food Law & Policy

Many people believe that once the COVID-19 pandemic has passed, life will return to the way it was. This belief is both unrealistic and dangerous. It is unrealistic because the virus will be around for years if not indefinitely. The timeframe for the worst of the pandemic will depend on our ability to administer effective vaccines worldwide and the public’s willingness to accept continued social distancing in the meantime. The damage done to public health, the economy and individuals is already substantial and will get worse. Recovery will be slow and incomplete. The belief that life will return to the …

Deep Fakes: The Algorithms That Create And Detect Them And The National Security Risks They Pose, Nick Dunard Sep 2021

Deep Fakes: The Algorithms That Create And Detect Them And The National Security Risks They Pose, Nick Dunard

James Madison Undergraduate Research Journal (JMURJ)

The dissemination of deep fakes for nefarious purposes poses significant national security risks to the United States, requiring an urgent development of technologies to detect their use and strategies to mitigate their effects. Deep fakes are images and videos created by or with the assistance of AI algorithms in which a person’s likeness, actions, or words have been replaced by someone else’s to deceive an audience. Often created with the help of generative adversarial networks, deep fakes can be used to blackmail, harass, exploit, and intimidate individuals and businesses; in large-scale disinformation campaigns, they can incite political tensions around the …

An Economical Method For Securely Disintegrating Solid-State Drives Using Blenders, Brandon J. Hopkins Phd, Kevin A. Riggle Jul 2021

An Economical Method For Securely Disintegrating Solid-State Drives Using Blenders, Brandon J. Hopkins Phd, Kevin A. Riggle

Journal of Digital Forensics, Security and Law

Pulverizing solid-state drives (SSDs) down to particles no larger than 2 mm is required by the United States National Security Agency (NSA) to ensure the highest level of data security, but commercial disintegrators that achieve this standard are large, heavy, costly, and often difficult to access globally. Here, we present a portable, inexpensive, and accessible method of pulverizing SSDs using a household blender and other readily available materials. We verify this approach by pulverizing SSDs with a variety of household blenders for fixed periods of time and sieve the resulting powder to ensure appropriate particle size. Among the 6 household …

Ai Output: A Human Condition That Should Not Be Protected Now, Or Maybe Ever, Xiao Wang Jul 2021

Ai Output: A Human Condition That Should Not Be Protected Now, Or Maybe Ever, Xiao Wang

Chicago-Kent Journal of Intellectual Property

AI is usually considered to be a form of automatic and autonomous work, but when applied to the creation of literary and artistic works, challenges arise in deciding whether the AI is the de facto author of its output and whether AI outputs or AI-generated products should be protected under the copyright system. This article argues that these outputs should be human creations because the working principles of AI determine that AI functions merely as a mathematical tool applied by humans to not only conceive of but also to execute the creation of AI outputs. The creativity reflected in these …

Not Approved For Human Consumption: A Study Of The Denmark Water Crisis, A Call For Reforming The Swda, And A Demand For Community Lawyering In Rural America, Matthew Woodward

William & Mary Environmental Law and Policy Review

Over the past four decades, nine million Americans have ingested dangerous drinking water from a trusted source: their own taps. Each year, “an estimated 16.4 million cases of acute gastroenteritis” are linked to public drinking water. For many Americans, drinking water—perhaps the most important cornerstone of human health—has become cause for concern.

In Flint, Michigan, this concern turned to panic. In 2014, after toddlers began developing painful skin conditions, children fell seriously ill, and tap water emerged in the form of thick, orange-brown sludge, the people of Flint began to wonder: is there something in the water? What soon became …

Microaggressions In The Academy: One Black Professor’S Narrative, Kevin L. Jones May 2021

Microaggressions In The Academy: One Black Professor’S Narrative, Kevin L. Jones

Journal of Multicultural Affairs

For many Black men in academia, predominantly White institutions are the epicenter of racism and hindered success. My first year as an instructor at a predominantly White institution proved to be an experience I will never forget. I had some expectations of what I would encounter, but what actually happened far exceeded anything I could have imagined. Through the lens of a racial microaggressions framework, my personal narrative describes my lived experiences as a Black male preparing for the academy at a predominantly White institution in the south. Consequently, these experiences had a long-term emotional, physiological, and psychological impact. These …

Principle Of Cbdr-Rc: Its Interpretation And Implementation Through Ndcs In The Context Of Sustainable Development, Stellina Jolly, Abhishek Trivedi

Washington Journal of Environmental Law & Policy

For the international community, 2015 was a momentous year in terms of transformative legal developments. Climate change response culminated in the adoption of the Paris Agreement and Sustainable Development Goals (SDGs), which heralded a new era in the international community’s pursuit of sustainability. Both of these developments are complementary; the climate change legal framework acknowledges sustainable development, and SDGs explicitly recognize the United Nations Framework Convention on Climate Change and the Paris Agreement. The Paris Agreement presented to the global community an objective to strengthen the global response to the threat of climate change, through sustainable development and efforts to …

Automated Analysis Of Rfps Using Natural Language Processing (Nlp) For The Technology Domain, Sterling Beason, William Hinton, Yousri A. Salamah, Jordan Salsman

SMU Data Science Review

Much progress has been made in text analysis, specifically within the statistical domain of Term Frequency (TF) and Inverse Document Frequency (IDF). However, there is much room for improvement especially within the area of discovering Emerging Trends. Emerging Trend Detection Systems (ETDS) depend on ingesting a collection of textual data and TF/IDF to identify new or up-trending topics within the Corpus. However, the tremendous rate of change and the amount of digital information presents a challenge that makes it almost impossible for a human expert to spot emerging trends without relying on an automated ETD system. Since the U.S. Government …

Integrated Estuary Governance, Mary Jane Angelo, J.W. Glass May 2021

Integrated Estuary Governance, Mary Jane Angelo, J.W. Glass

William & Mary Environmental Law and Policy Review

Estuaries are complex, dynamic ecosystems that play a critical role in supporting crucial economic industries, such as commercial fishing and tourism, and providing the resources necessary to sustain coastal communities. A range of anthropogenic environmental stressors are threatening the health of estuaries throughout the world. Traditional top-down single resource focused environmental regulatory approaches have proved inadequate to protect and restore estuarine systems. In recent years, scientific and legal academics, as well as policymakers, have called for more holistic participatory approaches to addressing environmental challenges. Drawing on the literature on ecosystem management, integrated water resources management, collaborative governance, and adaptive management, …
