A great deal has been written about the Energy Policy Act of 2005 exempting oil and gas operations using hydraulic fracturing from the purview of certain federal environmental laws. Far less attention has been paid to George W. Bush’s Executive Order 13211 (EO 13211), entitled “Actions Concerning Regulations that Significantly Affect Energy Supply, Distribution or Use.” The executive order requires federal agencies to evaluate the impact of federal regulations on “supply, distribution and use of energy.” This study examined the impact of EO 13211 on United States environmental and conservation regulations proposed and promulgated by federal agencies. Intact ecosystems across jurisdictional boundaries are of growing importance as the world continues to experience the impacts of climate change. International boundaries have, however, been drawn for political rather than ecological reasons. Ecosystem components often occur in more than one nation and are consequently subject to conflicting management and land-use practices. This research integrates the legal, institutional and environmental management components of transboundary biodiversity conservation to propose a comprehensive framework for evaluating the potential effectiveness of transboundary conservation regimes. Heller and Hobbs (2014) provide an incisive analysis of the challenges inherent in setting endpoint states as conservation goals. The social construct of nature, nonequilibrium ecosystems, global climate change, large-scale transformations of the landscape, and increasing population and economic activity confound efforts to establish conservation goals. Stakeholders often disagree on endpoint targets, whereas competing notions of historic fidelity and future flexibility frustrate our ability to articulate success, never mind actually achieve it. As Heller and Hobbs describe, this leaves managers in the bind of finding the “balance between future-looking management emphasizing change and past-looking management emphasizing persistence.” As a result, …

Since transitioning to capitalism in 1990, Mongolia’s wildlife has faced growing threats from the development of infrastructure, increasing livestock populations, and the expansion of an illegal trade in wildlife products. As wildlife populations face these growing risks, Mongolia needs to develop and implement strong wildlife management practices, including tighter enforcement of existing wildlife trade laws, more frequent wildlife population studies, and better legislation. However, these revisions will require significant funding. Trophy hunting, the system through which the Mongolian government sells wealthy foreigners expensive permits to hunt species like argali, ibex, wolf, and roe deer, may be a major source for …

This article provides a roadmap for possible European Union (eu) action in the protection of marine biodiversity in the changing Arctic. First the eu’s competence in the Arctic is briefly introduced. Then the discussion turns to the eu’s potential external and internal actions in shipping, fisheries and offshore oil and gas operations that could possibly enhance the international legal regime for the protection of marine biodiversity in the Arctic. The eu’s role vis-à-vis the global biodiversity regime and cross-cutting measures under the United Nations Convention on the Law of the Sea are discussed together in the final part.
