Crashing Into The Unknown: An Examination Of Crash Optimization Algorithms Through The Two Lanes Of Ethics And Law, Jeffrey K. Gurney

Autonomous vehicles will encounter situations where an accident is truly unavoidable, requiring the vehicle to decide whom or what to hit. In such situations, the vehicle will make difficult ethical decisions based upon its programming — more specifically, how its crash-optimization algorithm is programmed.This Article examines crash-optimization algorithms from an ethical and legal standpoint through the lenses of six moral dilemmas. Ethically, the Article focuses specifically on utilitarian and Kantian ethics. Legally, the Article considers the tort and criminal law implications of crash-optimization algorithms.In addition, the Article discusses whether autonomous vehicles should even make ethical decisions. La publicación de varias compilaciones de artículos, la traducción de uno de los textos fundacionales del área, y la publicación del primer libro con una contribución original al debate en español han hecho que este estudio filosófico se consolide un cuerpo académico por mérito propio. This paper examines the positions of Coase and Pigou about the problem of the externalities. From the reading of their most two important works it appears that Coase has a more relevant preference for a evaluation of efficiency at the total, while Pigou, with some exception, is convinced that is possible to reach marginal efficiency through taxes or responsibility. This article addresses a puzzle in Anglo-American tort law. Notwithstanding the now unquestionable victory of comparative negligence over the old all- or-nothing doctrine of contributory negligence, the doctrine of mitigation (or avoidable consequences) remains intact. Under comparative negligence, any loss that the victim could have avoided is apportioned between the victim and the tortfeasor. In contrast, under the doctrine of mitigation, a tort victim can never recover for any element of loss that could have been avoided. The apparent tension between these two loss allocation mechanisms was identified by the drafters of the Third Restatement of Torts, which proposed abolishing …

Punitive damages have for years been one of the most hotly debated legal topics around the common law world. In recent years, however, the interest in this subject seems to be shared increasingly by continental scholars. The scholarly literature on punitive damages is immense. It covers almost every aspect of the punitive damages phenomenon, from almost every angle (doctrinal, conceptual, philosophical, political, economic, historical, empirical, constitutional, and comparative). De un tiempo a esta parte, los tribunales civiles de Lima vienen concediendo resarcimientos a ciegas, sobre la base del artículo 345-A del Código Civil peruano, en el cual se obliga al magistrado, a "velar por la estabilidad del cónyuge perjudicado" en los casos de separación de hecho, ya señalando una "indemnización", ya ordenando la "adjudicación preferente de bienes de la sociedad conyugal".

En este comentario de jurisprudencia se explica por qué es equivocado asociar la "indemnización" referida en dicha norma con la responsabilidad civil, y se brindan elementos para su correcto enfoque como importante manifestación de la solidaridad familiar.

Three years have passed since the Supreme Court of Canada rendered its controversial decision in Whiten v. Pilot Insurance Co. In that case, the Court affirmed an almost unprecedented punitive damage award by a jury of one million dollars against an insurance company. More importantly, the Whiten decision appears to be the first attempt by the Supreme Court to construct a comprehensive set of rules and principles in light of which punitive damages cases should be decided in the future.
