Work Made For Hire – Analyzing The Multifactor Balancing Test, Ryan G. Vacca

Authorship, and hence, initial ownership of copyrighted works is oftentimes controlled by the 1976 Copyright Act’s work made for hire doctrine. This doctrine states that works created by employees within the scope of their employment result in the employer owning the copyright. One key determination in this analysis is whether the hired party is an employee or independent contractor. In 1989, the U.S. Supreme Court, in CCNV v. Reid, answered the question of how employees are distinguished from independent contractors by setting forth a list of factors courts should consider. Automated indexing – using a computer to look at individual documents and assign metadata without a person looking at every document– was used to build an interactive online database to store and retrieve pages from a looseleaf resource (i.e., a resource which changes state over time). A database was designed and more than 30,000 pages in the database were indexed. Digitization, optical character recognition, and computer scripting to extract metadata were the methods used to assign most metadata. In places where the computer program could not assign metadata, a person looking at the document assigned metadata. The index was audited …

No matter the context or jurisdiction, one concept underlies every view of the best practices in data privacy: transparency. The mandate to disclose what personal information is collected, how it is used, and with whom and for what purpose it is shared, is essential to enable informed consent to the collection, along with the other user rights that constitute privacy best practices. Google, which claims to support and offer transparency, is increasingly opaque about its many products and services and the information they collect for it, posing a significant privacy concern.

This paper will look at the different theories of statutory interpretation, breaking down how the individual theories go about interpretation. Tracing statutory and regulatory history in veterans law can be exceptionally difficult. Although judicial review has only been available for a little more than two decades, the modern veterans benefits system evolved -- more by happenstance than design -- from the system that was originally adopted to serve WWI veterans. Tracing key statutory and regulatory provisions to their true origin is not easy because much of the legislative and regulatory history for veterans law provisions in the United States Code and the Code of Federal Regulations is simply incorrect. Since the advent of judicial review of veterans claims over twenty years ago, representatives of veterans have chafed at the jurisdictional limits of the Federal Circuit. They have struggled to draw the court into a more active role in both reviewing individual decisions of the Court of Appeals for Veterans Claims (CAVC) and prodding the CAVC toward reversing the Department of Veterans Affairs’ Board of Veterans’ Appeals (BVA) more frequently. In 2012, there was a broad yet unsuccessful effort by veterans representatives to revisit the limits of judicial review. Historically, crime victims served as policemen, investigators, and private prosecutors, and were regarded as law enforcement’s most dependable catalyst. The Crime Victim’s Rights Act of 2004 grants crime victims eight substantive and procedural rights and breathes new life into the common law idea that crime is both a public wrong and a private injury. The Act has, however, elicited ardent criticism. Opponents contend that the Act is both bad policy and, most likely, unconstitutional. The Federal Transit Administration (FTA) is a branch of the U.S. Department of Transportation that administers federal funds and provides technical assistance for the support of locally operated public transit systems. MARTA / Atlanta metro area are part of FTA Region IV (the Southeast). FTA would be involved, for instance, in financing the federal grant monies discussed above. But actual regulation of operations (i.e., what MARTA does each day, or what MARTA will plan to do regionally) is more closely regulated by Georgia agencies.
