Work Made For Hire – Analyzing The Multifactor Balancing Test, Ryan G. Vacca
Work Made For Hire – Analyzing The Multifactor Balancing Test, Ryan G. Vacca
Ryan G. Vacca
Authorship, and hence, initial ownership of copyrighted works is oftentimes controlled by the 1976 Copyright Act’s work made for hire doctrine. This doctrine states that works created by employees within the scope of their employment result in the employer owning the copyright. One key determination in this analysis is whether the hired party is an employee or independent contractor. In 1989, the U.S. Supreme Court, in CCNV v. Reid, answered the question of how employees are distinguished from independent contractors by setting forth a list of factors courts should consider. Unfortunately, the Supreme Court did not give further guidance on …

Automated Metadata Creation: Possibilities And Pitfalls, Wilhelmina Randtke
Automated Metadata Creation: Possibilities And Pitfalls, Wilhelmina Randtke
Wilhelmina Randtke
Automated indexing – using a computer to look at individual documents and assign metadata without a person looking at every document– was used to build an interactive online database to store and retrieve pages from a looseleaf resource (i.e., a resource which changes state over time). A database was designed and more than 30,000 pages in the database were indexed. Digitization, optical character recognition, and computer scripting to extract metadata were the methods used to assign most metadata. In places where the computer program could not assign metadata, a person looking at the document assigned metadata. The index was audited …
Privacy, Transparency & Google's Blurred Glass, Jonathan I. Ezor
Privacy, Transparency & Google's Blurred Glass, Jonathan I. Ezor
Jonathan I. Ezor
No matter the context or jurisdiction, one concept underlies every view of the best practices in data privacy: transparency. The mandate to disclose what personal information is collected, how it is used, and with whom and for what purpose it is shared, is essential to enable informed consent to the collection, along with the other user rights that constitute privacy best practices. Google, which claims to support and offer transparency, is increasingly opaque about its many products and services and the information they collect for it, posing a significant privacy concern.
Equality For All: Equal Protection For Queer Individuals In International Community, David C. Bell
Equality For All: Equal Protection For Queer Individuals In International Community, David C. Bell
David C Bell
This paper will address the need for international protections of the LGBTI community. After looking at some definitions and theories of international law, this paper will address the question of why protections are needed for the LGBTI community. Then the paper will look at previous attempts to create international precedent to protect these groups. Following those topics, this paper will take a look at the Yogyakarta Principles and conclude by speculating on the future to see where protections for these communities may lie.
Jurisprudence, Interpretation, And Relevance: How Relevant Is Jurisprudence In Modern Practice?, David C. Bell
Jurisprudence, Interpretation, And Relevance: How Relevant Is Jurisprudence In Modern Practice?, David C. Bell
David C Bell
Jurisprudence and statutory interpretation are distained by law school students and in legal circles outside the academic realm, but both are an integral part of the legal process and as such should be included in all law school education in an effort to turn out practice ready lawyers. This paper will look at the different theories of statutory interpretation, breaking down how the individual theories go about interpretation. The different theories to be analyzed include hermeneutics, textualism, purposive interpretation, dynamic interpretation, liberal interpretation, legal process theory, moral theory, and active liberty. Then the paper will analyze parallels between the interpretation …

Commensal Microbiotica - Biological Frontier And Legal Challenge, Kenneth L. Sanders Md
Kenneth L Sanders MD
Recent advances in bacteriology and medical science affirm that the commensal relationship between surface microbial flora and the human host is intricate and important. Legal theory has thus far lagged behind the impact of the medical discoveries.
Recovering An Institutional Memory: The Origins Of The Modern Veterans Benefits System, 1914 To 1958, James Ridgway
Recovering An Institutional Memory: The Origins Of The Modern Veterans Benefits System, 1914 To 1958, James Ridgway
James D. Ridgway
Tracing statutory and regulatory history in veterans law can be exceptionally difficult. Although judicial review has only been available for a little more than two decades, the modern veterans benefits system evolved -- more by happenstance than design -- from the system that was originally adopted to serve WWI veterans. Tracing key statutory and regulatory provisions to their true origin is not easy because much of the legislative and regulatory history for veterans law provisions in the United States Code and the Code of Federal Regulations is simply incorrect. Moreover, even if a provision were traced past the false origins …
Fresh Eyes On Persistent Issues: Veterans Law At The Federal Circuit In 2012, James Ridgway
Fresh Eyes On Persistent Issues: Veterans Law At The Federal Circuit In 2012, James Ridgway
James D. Ridgway
Since the advent of judicial review of veterans claims over twenty years ago, representatives of veterans have chafed at the jurisdictional limits of the Federal Circuit. They have struggled to draw the court into a more active role in both reviewing individual decisions of the Court of Appeals for Veterans Claims (CAVC) and prodding the CAVC toward reversing the Department of Veterans Affairs’ Board of Veterans’ Appeals (BVA) more frequently. In 2012, there was a broad yet unsuccessful effort by veterans representatives to revisit the limits of judicial review. This article examines that effort, and explains that the dissatisfaction that …

Private Rights Or Public Wrongs? The Crime Victims Rights Act Of 2004 In Historical Context, Christopher J. Truxler
Private Rights Or Public Wrongs? The Crime Victims Rights Act Of 2004 In Historical Context, Christopher J. Truxler
Christopher J. Truxler
Historically, crime victims served as policemen, investigators, and private prosecutors, and were regarded as law enforcement’s most dependable catalyst. The Crime Victim’s Rights Act of 2004 grants crime victims eight substantive and procedural rights and breathes new life into the common law idea that crime is both a public wrong and a private injury. The Act has, however, elicited ardent criticism. Opponents contend that the Act is both bad policy and, most likely, unconstitutional. Without commenting on the Act’s policy or constitutionality, this Note places the Crime Victims’ Rights Act within a broader historical context where victims’ needs can be …
The Role Of The Law In The Availability Of Public Transit And Affordable Housing In Atlanta’S West End, Elliott Lipinsky
The Role Of The Law In The Availability Of Public Transit And Affordable Housing In Atlanta’S West End, Elliott Lipinsky
ELLIOTT LIPINSKY
The Federal Transit Administration (FTA) is a branch of the U.S. Department of Transportation that administers federal funds and provides technical assistance for the support of locally operated public transit systems. MARTA / Atlanta metro area are part of FTA Region IV (the Southeast). FTA would be involved, for instance, in financing the federal grant monies discussed above. But actual regulation of operations (i.e., what MARTA does each day, or what MARTA will plan to do regionally) is more closely regulated by Georgia agencies.
Until recently, the Atlanta metropolitan area had no powerful central agency to coordinate regional transit. The …

Privacy And Data Protection In Business: Laws And Practices (Sample Chapters), Jonathan I. Ezor
Jonathan I. Ezor
In the fields of digital privacy and data protection in the business world, effective compliance and risk management require not only knowledge of applicable laws and regulations, but at least a basic understanding of relevant technologies and the processes of the company or other organization that is collecting and/or using the personal information or monitoring behavior. This book is structured to provide a framework for law and other students to both learn the law and place it in the necessary technological and practical context, divided into topic areas such as children’s privacy, health information, governmental requirements, employee data and more. …

Unanswered Questions Of A Minority People In International Law: A Comparative Study Between Southern Cameroons & South Sudan, Bernard Sama Mr
Bernard Sama
The month July of 2011 marked the birth of another nation in the World. The distressful journey of a minority people under the watchful eyes of the international community finally paid off with a new nation called the South Sudan . As I watched the South Sudanese celebrate independence on 9 July 2011, I was filled with joy as though they have finally landed. On a promising note, I read the UN Secretary General Ban Ki-moon saying “[t]ogether, we welcome the Republic of South Sudan to the community of nations. Together, we affirm our commitment to helping it meet its …

Connect & Thrive: Perspectives Of A Newly Tenured Professor, Corey A. Ciocchetti
Connect & Thrive: Perspectives Of A Newly Tenured Professor, Corey A. Ciocchetti
Corey A Ciocchetti
This essay encapsulates my perspective (newly-tenured and seven years into my career) on how average professors can become highly effective professors. The secret rests in the ability to genuinely connect with students. Connecting really matters - even if it takes some personality adaptation and thrusts academics out of their comfort zones. Many professors fail to connect with students in a meaningful way. My evidence for this assertion is simple and straightforward. In addition to teaching, I am blessed to travel the country and speak on college campuses.3 After extensive discussions on these trips, students consistently claim their professors are boring, …
Corporate Obligations Under The Human Right To Water, Jernej Letnar Cernic
Corporate Obligations Under The Human Right To Water, Jernej Letnar Cernic
Jernej Letnar Černič
Almost a billion people do not have access to clean and safe water. Access to safe drinking water and sanitation is increasingly being considered a fundamental human right. Corporations play an important role in the realization of the right to water. For example, they can become violators of the right to water where their activities deny access to clean and safe water or where water prices increase without warning. Corporations can have a positive or negative impact on the human rights of individuals, wider communities and indigenous peoples. This paper argues that corporations bear a certain responsibility for the realization …
