The Liberal As An Enemy Of Queer Justice, Craig Schamel Oct 2015

The Liberal As An Enemy Of Queer Justice, Craig Schamel

Catalyst: A Social Justice Forum

Abstract

Liberalism as a historical mode of the political is the context in which the movement and ensuing struggle for queer justice emerged in most Western countries. The terminology, practices, tendencies, beliefs, ethics, laws, and patterns of political and social life which have been determined by this mode of the political, it is argued, are inimical to queer justice and render its achievement impossible. Liberalism as a mode of the political is approached from below, from knowledge gained in practical experience in queer groups which considered themselves revolutionary at least to some degree, and from the effects on such groups …

Community Legal Workers At Parkdale Community Legal Services October 1977, Katie Mcgovern, Frederick H. Zemans Oct 2015

Community Legal Workers At Parkdale Community Legal Services October 1977, Katie Mcgovern, Frederick H. Zemans

Frederick H. Zemans

Since its opening in September 1971, Parkdale Community Legal Services has served as both a neighbourhood law office and as Osgoode Hall Law School's first clinical training setting. Law students have been the primary deliverers of legal.services, with a growing number of staff lawyers, articling students, and practitioners supervising the student caseload. But most law students spend only one semester at Parkdale; therefore the staff lawyers and especially the community legal workers must provide continuity within the office and serve as the conduit to the Parkdale community.

Introduction: The Power Of Stories: Gloucester Tales, Susan Ayres Jul 2015

Introduction: The Power Of Stories: Gloucester Tales, Susan Ayres

Susan Ayres

For a second year, scholars made a pilgrimage to Gloucester for a three-day academic conference sponsored by Texas Wesleyan Law School, the University of Gloucestershire, and the Central Gloucester Initiative. This year's conference theme, "The Power of Stories: Intersections of Law, Culture and Literature," was inspired by the medieval folktale about Dick Whittington and his cat. While the City of Gloucester planned various events to celebrate the 400th anniversary of the folktale, such as a re-enactment of Dick Whittington's pilgrimage from Gloucester to London, conference organizers in both the United States and England planned a thought-provoking conference.

They did not …

Proposed Improvements To The Division Of The Parties' Beneficial Interests Beyond The Women's Charter: Chan Yuen Lan V See Fong Mun, Jonathan Muk

Jonathan Muk

In Chan Yuen Lan v See Fong Mun [2014] SGCA 36, the Singapore Court of Appeal had the opportunity to consider its approach towards ascertaining the parties’ beneficial interests under the common law. It took the opportunity to revist its earlier decision of Lau Siew Kim v Teo Guan Chye Terence [2008] 2 SLR(R) 108 and establish an approach for future cases. It is submitted that the CA’s approach could have gone further to first, establish the common intention constructive trust analysis as the starting point for ascertaining beneficial interests under the common law, second, reform the presumption of advancement …

Reimagining Access To Justice In The Poor People’S Courts, Elizabeth L. Macdowell Jan 2015

Reimagining Access To Justice In The Poor People’S Courts, Elizabeth L. Macdowell

Scholarly Works

Access to justice efforts have been focused more on access than justice, due in part to the framing of access to justice issues around the presence or absence of lawyers. This article argues that access to justice scholars and activists should also think about social justice and provides a roadmap for running a legal services program geared toward making court systems more just. The article also further develops the concept of “poor people’s courts,” a term that has been used to describe courts serving large numbers of low-income people without representation. The article argues that access to justice efforts can …
